SOLE SOURCE JUSTIFICATION
1. Identification of Agency and Contracting Activity.
Requiring Activity: Commanding Officer Navy Cyber Defense Operations Command (NCDOC) 112 Lake View Parkway Suffolk, Virginia, 23435

2. Description of the Action Being Approved.
This requirement is for Cyber Security Technical training for NCDOC personnel�s professional development through a Continuous Learning Program (CLP). The instant acquisition is a follow-on procurement to an existing contract, N0018917P1574. N0018917P1574 was awarded on 28 September 2017 as a firm fixed price, Service Disabled Veteran Owned Small Business (SDVOSB) direct award, in accordance with FAR 19.1406, to Freewater Technology Inc and expires on 29 September 2022. This is a sole source action to be awarded as a new contract to Freewater Technology; 816 Greenbrier CIR STE 201, Chesapeake, VA, 23320-2642, under the direct SDVOSB authority at FAR 19.1406.
3. Description of Supplies/Services.
The proposed acquisition is for Cyber Security Technical training for NCDOC personnel�s professional development through a Continuous Learning Program (CLP). Cyber Network Defense (CND) is defined as the actions taken to protect, monitor, analyze, detect and respond to unauthorized activity within DoD information systems and computer networks. Under the DoD 8570.01M, there are certification requirements that must be met, or exceeded, by personnel working within Cyber Security. The Cyber Workforce Improvement Program (CWIP) establishes baseline skills among personnel performing Information Assurance (IA), Computer Network Defense Services Provider (CNS SP), Information Assurance System Architect and Engineer (IASAE), Certification and Accreditation (C&A) and other IA related functions within the NCDOC domain. The course curriculum are all ANSI and DoD 8140.01M certified courses and built on the Office of Personnel Management (OPM)�s National Initiative for Cybersecurity Education (NICE) Cyber Core Competencies (CCCs): (1) Computer Network Defense, (2) Technology Awareness, (3) Vulnerabilities Assessment, (4) Infrastructure Design,
(5) Information Assurance, and (6) Information Systems/Network Security.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any.
Market research included a review of potential sources, contacting knowledgeable individuals in the Government, querying the Government-wide database of contracts and other procurement instruments intended for use by multiple agencies, a review of previous acquisitions for similar requirements, and reviewing publicly available information regarding market capabilities.
In addition, a sources sought notice for service-disabled veteran-owned small businesses was posted to the Government-wide Point of Entry (GPE) on 26 January 2022 under posting N0018922Q0070. Six (6) firms responded to the Sources Sought Notice. NCDOC reviewed all provided information to ascertain whether any of the respondents were capable of meeting the Government�s minimum need for this procurement. Based on that review, a determination was made that none of the respondents possessed the technical capability to perform the required tasks and meet the Government�s minimum need.
Therefore, market research indicates there is only one SDVOSB, Freewater Tech Inc., capable of satisfying the requirement.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government of the services covered by this Justification will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
In accordance with DFARS 206.303-2(b)(i) and PGI 206.304(a)(S-70)), a sources sought notice was issued on 26 January 2022. Six (6) responses were received in response to the sources sought notice from the following firms:
The Requiring Activity reviewed the information provided by each firm that responded to the sources sought notice to ascertain whether any of the responders were capable of meeting the Government�s minimum needs. Based on this review, the Requiring Activity determined that none of the responders possess the technical capability to perform the required tasks. Furthermore, market research has determined that Freewater Technologies Inc., can meet the government�s minimum needs.
