Source Selection Information – See FAR 2.101 and 3.104

The Independent Government Estimate (IGE) shown in the table above was developed by EODGRU

TWO based on historical prices paid and prior quotes received and includes a 4.0% inflation rate for all ordering periods after year one (1).

FLC Norfolk is working this contract action in anticipation of the receipt of appropriate Fiscal Year

2023 funding. The requiring activity has agreed to provide the minimum funding in time for contract award.

The Government specified IDIQ minimum guarantee for the resultant contract will be funded at time of award with FY23 Operations and Maintenance, Navy (O&MN) funds. The Government anticipates a minimum IDIQ obligation amount of $2,500.00.

Task/Delivery Orders under the prospective IDIQ contract will be funded utilizing appropriations Navy

O&MN of the fiscal year in which each Task/Delivery Order is issued.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) - the supplies or services needed by the agency are available from only one responsible source, Arne Freefall

Solutions, LLC, and no other type of supplies or services will satisfy agency requirements, as implemented by FAR 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority.

The authority cited at 10 U.S.C. 3204(a)(1), is applicable because it was determined that Arne Freefall

Solutions, LLC is the only vendor capable of providing the services required. The current contract, N0018918D0034, was originally solicited as a 100% SDVOSB set-aside. However, only one (1) vendor, Arne Freefall, submitted a proposal. After receipt of only one (1) proposal, two (2) additional vendors who had originally expressed interest in the solicitation, were contacted. It was determined that neither vendor could provide the extent of services required at the locations necessary in the requirement. With that, Arne Freefall Solutions, LLC was awarded N0018918D0034.

Additionally, a sources sought, as described in the section below, also verified that Arne Freefall

Solutions, LLC is the sole source capable of providing the required services.

Lastly, it is important to note that while Arne Freefall Solutions, LLC was a SDVOSB at the time of award of the existing contract; this company is no longer a SDVOSB.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a

Description of Market Research, if applicable, and a List of Interested Sources, if any.

Market research was conducted in accordance with FAR part 10 and included a review of potential sources, contacting knowledgeable individuals in the Government, querying the Government-wide database of contracts and other procurement instruments intended for use by multiple agencies, a review of previous acquisitions for similar requirements, and reviewing publicly available information regarding market capabilities.
