52.212-2 Evaluation—Commercial Products and Commercial Services (NOV 2021)

The Government intends to award a firm-fixed-priced contract resulting from this RFQ to the responsible

Offeror whose offer is conforming to the solicitation will be the most advantageous to the government, price and other factors considered. The type of source selection utilized in this procurement is the Best

Value Trade-Off IAW Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial

Products and Commercial Services, and Part 13 Simplified Acquisition Procedures.

The following factors shall be used to evaluate offers:

(i) Technical Capability

(ii) Past Performance

(iii) Price

For those offers determined to be technically acceptable, a trade off will be conducted between price and past performance. Past performance and price are approximately equal in importance.

The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offer. The Government reserves the right to make award solely on initial offers received.

Although price is not the most important evaluation factor, it has the potential to become more significant during the evaluation process. The degree of importance of price will increase with the degree of equality of the offers in relation to the other factors on which selection is to be based.

Price

The Government will evaluate price offers in accordance with FAR 13.106-3(a), Award and

Documentation. The Government may evaluate any and all information submitted by the Offeror to support the reasonableness of the prices offered. The method of evaluation used by the Contracting

Officer is solely within the discretion of the Contracting Officer.

Price will be evaluated by multiplying the estimated quantities provided to the Government by the offered unit price for each line item provided by the Offeror and then adding the totals together, thereby identifying the Offeror’s total estimated price for each line item. The unit price should be evenly incremented so that it adds up to the total price without rounding past the second digit right of the decimal point for total prices for all contract line items (CLINs).

All options, including that of FAR 52.217-8, Option to Extend Services, will be evaluated pursuant to solicitation provision FAR 52.217-5, Evaluation of Options.

For award purposes, the Government will evaluate offers by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

Unbalanced pricing may be evaluated IAW FAR 15.404-1(g) as applicable to assess potential performance risks which could result in unreasonably high prices. A quote may be rejected if the

Contracting Officer determines that the lack of balance poses an unacceptable risk to the

Government.

Note: Offers that do not offer all items (including options) or which offer only partial CLIN pricing will be considered non-responsive. Failure to furnish the price offer in accordance with the instructions above will render the offer ineligible for award.

Technical Capability: The technical rating reflects whether the proposed approach meets or does not meet the minimum performance or capability requirements. Failure to provide all items listed in the technical volume will result in an unacceptable rating. Failure to provide washers, dryers and maintenance

IAW Sections 2.0 and 3.0 of the PWS will result in an unacceptable rating. If the offeror is found to be

“Unacceptable”, then the offeror will be removed from further consideration of the award.

Acceptable

The offeror has provided equipment and maintenance plan that meets the specifications in the PWS.

Unacceptable

The offeror has provided equipment and maintenance plan that does not meet the specifications in the PWS.

Past Performance - The past performance evaluation results in an assessment of the offeror probability of meeting the solicitation requirements. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying services that meet the contract requirements. The recency and relevance of the information, source of the information, context of the data, and general trends in Contractor’s performance shall be considered. These are combined to establish one performance confidence assessment rating for each offeror. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination.

Recency is defined as a contract performed by the offeror within the last three (3) years prior to the date of the synopsis/solicitation.

Relevancy for the purpose of this evaluation is described as past or current contracts (including Federal, State, and local government and private) with at least one year of evaluated performance completed. Past

Performance relevancy will be rated as either “relevant” or “not relevant”.

Rating Definition

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

A review of all past performance, general trends, and usefulness of the information will be incorporated into an overall performance confidence assessment rating. The past performance confidence assessment rating is based on the offeror overall record of recency, relevancy and quality of performance and will be rated as stated below.

Performance Confidence Assessment

Rating Description

Satisfactory Confidence Based on the offerors recent/relevant performance record, the

Government has a reasonable expectation that the offerors will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offerors performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offerors recent/relevant performance record, the

Government has a low expectation that the offerors will successfully perform the required effort.

In the case of offerors for which there is no information on past contract performance or where past contract performance is not available, the offerors may not be evaluated favorably or unfavorably on the factor of past contract performance. In this case, the offerors past performance is unknown and assigned a confidence rating of “neutral.” Past performance ratings of Satisfactory Confidence hold more value than a Neutral Confidence rating and will be considered superior to Neutral and Limited Confidence ratings.

Contractor Responsibility

To be eligible for award, a Offeror must be determined by the Contracting Officer to be a responsible prospective contractor under FAR 9.104. To be determined responsible, a Offeror must:

1. Have adequate financial resources to perform the contract, or the ability to obtain them;

2. Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and Governmental business commitments;

3. Have a satisfactory performance record;

4. Have a satisfactory record of integrity and business ethics;

5. Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor an subcontractors);

6. Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and

7. Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

Failure to submit all required documentation shall render a offer non-responsive and the offer will not be considered for award.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options including FAR 52.217-8 to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

If the solicitation includes the provision 52.222-18, Certification Regarding Knowledge of Child Labor for Listed End Products, or the equivalent at 52.212-3(i), the Contractor agrees to cooperate fully with authorized officials of the contracting agency, the Department of the Treasury, or the Department of Justice by providing reasonable access to records, documents, persons, or premises upon reasonable request by the authorized officials.
