About this file

This document is a Federal Terms and Conditions attachment applicable to contracts involving the Texas Office of the Attorney General (OAG) related to child support enforcement programs funded under Title IV, Part D of the federal Social Security Act. The attachment establishes mandatory compliance requirements for all contractors and subcontractors performing work under such agreements, including adherence to applicable state and federal laws, regulations, and guidelines that may be amended throughout the contract term at the OAG's sole discretion.

The Federal Terms and Conditions impose comprehensive obligations on contractors encompassing equal employment opportunity compliance with Executive Order 11246 and 41 CFR Part 60, Americans with Disabilities Act compliance, certification of non-debarment status, and environmental protection standards under the Clean Air Act and Clean Water Act. Contractors must retain all financial records, supporting documents, and statistical records for seven years following contract expiration or until all audit and legal matters are resolved, whichever is longer, and must grant access to these records to the OAG, Texas State Auditor, U.S. Department of Health and Human Services, and the Comptroller General. Additional requirements include compliance with the Lobbying Disclosure Act and Byrd Anti-Lobbying Amendment with mandatory certification and potential disclosure of lobbying activities on Standard Form LLL for subcontracts exceeding $100,000. Contractors may copyright original works developed under the contract subject to the OAG and federal government retaining royalty-free, nonexclusive, irrevocable licenses for government purposes, and must provide one copy of any publications to the OAG at no charge following prior review and approval.
