About this file
This is a Notice of Intended Decision to Enter Into a Single Source Contract issued by the Florida School for the Deaf and the Blind (FSDB) for the procurement of Apple Products and proprietary software for fiscal year 2026-2027. The procurement encompasses computers (commodity code 43211500) and operating system software (commodity code 43233004). The advertisement period runs from July 7, 2026, at 4:00 PM through July 28, 2026, at 4:00 PM, constituting the statutorily mandated fifteen business day notification period. The intended sole source provider is Apple, Inc., located at 12545 Riata Vista Circle, MS-183-ED, Austin, TX 78727. Prospective vendors who believe they can fulfill this procurement must submit relevant information to Kim Whitwam, Director of Purchasing, at whitwamk@fsdbk12.org during the fifteen business day advertising window. The Agency retains discretion to conduct a competitive procurement based on responses received.
The not-to-exceed estimated dollar amount for this single source acquisition is $135,000.00. FSDB justifies the single source designation based on Apple, Inc.'s status as the sole source provider of Apple Products for K-12 education institutions in the United States. The definition of "Apple Products" includes Services, CTO Products (custom-modified products available only by special order), hardware, and software manufactured, distributed, or licensed under Apple-owned or licensed brand names. Apple maintains direct sales and purchasing relationships with K-12 educational institutions and will continue to be the exclusive source for all Apple Products sold to such institutions. Any protests regarding this procurement determination must be filed within the timeframe prescribed in Florida Statute 120.57(3), or the right to protest will be waived.
