Exhibit A: Representations and Certifications for DART Locally Funded Contracts

This is a Representations and Certifications form (Exhibit A) for the Dallas Area Rapid Transit Authority (DART) applicable to locally funded supply, service, or construction contracts under Solicitation No. 2093213. The form addresses a procurement for 10 Gigabit XTran transport cards and SFP modules, which are proprietary system components already operated by DART's Communications and Control Systems (CCS) with no alternate brands permitted. The document does not specify quantities, response deadlines, due dates, site visits, bidders' conferences, or award dates, as it functions as a standardized form to be completed and returned with all offers submitted in response to DART solicitations.

Offerors must complete and certify compliance with seventeen representations and certifications covering contingent fees, gratuities, conflicts of interest, business structure, small business enterprise status, debarment and suspension status, independent price determination, boycott policies regarding energy companies and Israel, firearm entity non-discrimination, drug-free workplace programs, and non-discrimination assurance. The form requires disclosure of parent company information, prior DART contracts, organizational and personal conflicts of interest, litigatory claims against DART, and contracts with DART member cities and competing transit agencies. False statements in the offer may constitute criminal violations under Texas Penal Code Section 37.10, and knowing submission of erroneous certifications may result in contract termination for default or debarment from future DART contracting. All certifications must be signed and dated by an authorized representative of the offeror.
