The General Services Administration (GSA) is setting aside this procurement under the clause 52.219-6, Notice of Total Small Business Set Aside. NAICS Code454310- Fuel Dealers, Size Standard in Number of Employees: 100, pursuant to 13 CFR § 121.201.
I. GENERAL INFORMATION
I.A. STATEMENT OF WORK
The General Services Administration (GSA), Public Buildings Service (PBS), Region 1 has a need to procure Fuel and delivery to multiple Federally Owned and Operated Buildings in various locations in Vermont.
The contractor shall provide all management, supervision, labor, materials, supplies, and equipment; and shall plan, schedule, coordinate and ensure effective supply and delivery of propane and/or fuel oil in accordance with requirements described herein. See Exhibit 1 for building specifications and Attachment 1 for pricing information.
The Contractor shall automatically (i.e., without a separate request or order from the Government) deliver the appropriate fuel to each location in order to maintain a minimum of 35% of the tank(s) capacity at all times at each location. The sole exception is the Cargo Building propane tank at Highgate Springs, Vermont, which shall be maintained at a minimum level of 45%. In addition, prior to anticipated severe weather and ice storms, at the Government’s request, the contractor shall fill the tank to 100% capacity levels.
Contractor shall comply with current state and local regulations regarding sulfur content of heating oil.
Most locations operate 24 hours per day, 365 days per year, including all holidays. However, regardless of the building hours, the contractor shall deliver to all locations at all hours, including weekends and holidays, necessary to maintain the minimum required levels in each tank.
The Contractor shall provide a metered delivery ticket, via email, to the Contracting Officer’s Representative (COR) identified in Section immediately upon delivery or by the next business day if the delivery takes place after hours, or on the weekend or holiday. The delivery ticket shall include the following information at a minimum:
mailto:kristin.cusack@gsa.gov mailto:huy.le@gsa.gov
• Date of delivery;
• Total gallons delivered;
• Price per gallon. The ticket shall clearly indicate each of the following prices o Index Rate o Contractor Margin o Total Unit Price
The Period of Performance under the resulting Contract will be for one (1) base year, plus four (4) option years in accordance with FAR 52.217-8 Option to Extend Services (NOV 1999) FAR 52.217-9 Option to Extend the Term of the Contract (MAR 2000)
Government Surveillance. The COR shall verify that the correct pricing is indicated on each delivery ticket in accordance with Section I.B. Price. The COR shall also verify that each delivery by verifying fuel level and delivery ticket match. All deliveries shall be tracked, including gallons and price, to ensure that the Contractor does not proceed beyond the ceiling price for each location.
I.B. PRICE
The unit price per gallon of oil and propane will consist of two components – the current index rate and a margin that is inclusive of all contractor markup. The unit price is expressed as follows: Price per Gallon = Current Index Rate + Contractor Margin.
Index Rate. Contractor shall propose the CURRENT index rate(s) to be used for this contract and provide supporting documentation including platform used (i.e. website) to verify the current index rate. Contractor shall highlight the proposed index rate on its supporting documentation. This index rate shall be based on the most current rate one (1) day prior to submission of proposal. This rate will be used for purposes of calculating the total evaluated price.
The total unit price per gallon of fuel will depend upon the individual delivery date, as the index rate fluctuates. The applicable index rate will be the rate in effect on the delivery date.
The contractor shall provide to the Government a receipt for all fuel deliveries in accordance with Section 1 above. The receipt shall clearly indicate the quantity of fuel delivered the index rate, and the awarded margin rate.
Contractor Margin. The Contractor Margin is fixed and includes all markup above the index rate. This includes, but is not limited to: delivery charge (including labor and transportation), overhead, profit, applicable taxes and duties, etc. The awarded contractor margin rate is fixed and will not fluctuate with changes to the index rate.
Ceiling Price. In accordance with Section I.A. above, the Contractor shall make continuous deliveries on an as-needed basis, but shall not exceed the stated contract ceiling amount per location. The Ceiling Price for each location and fuel type will be the total lump sum price for each contract line item. Contractor shall notify the Contracting Officer two weeks before Contractor anticipates any contract line item will reach 80% of the Total Lump Sum Contract Ceiling Price. Additional funds may be allotted as necessary by the Contracting Officer.
