SINGLE SOURCE JUSTIFICATION NOT EXCEEDING THE SIMPLIFIED ACQUISTION THRESHOLD

SECTION 1: IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

Department of State Contracting Activity
☐ Office of Acquisitions Management

☐ Foreign Service Institute ☐ Office of Foreign Missions ☐ U.S. Mission to the United Nations ☒ Overseas Post Paramaribo

Requiring Activity
OEM maintenance replacement parts and OEM certified Eaton breaker service

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

Approval is requested to award on a sole source basis to Eaton Electric US, Hanover, MD for the supplies and/or services described in Section 3 on behalf of the Requiring Activity.

SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

The requirement is to provide OEM maintenance replacement parts and OEM-certified Eaton breaker service at U.S. Embassy Paramaribo. The estimated value for the entire period of performance is $87,000.00 USD, including options. These supplies/services require OEM service of 18 Magnum DS Drawout Air Circuit Breaker, which is a proprietary Eaton system. This will allow the Office of Facility Management in Post Paramaribo to accomplish the correct preventive maintenance to critical electrical breakers.

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting Officer has deemed only one source reasonably available based on the following:

☐ Urgency ☒ Exclusive licensing agreements ☒ Brand-name ☐ Industrial mobilization ☐ Other

SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED

Eaton Electric US is the equipment manufacturer; consequently, Eaton Electric can provide OEM-certified technicians for the breaker maintenance required on the Eaton proprietary system at U.S. Embassy Paramaribo. Regional Eaton Service Centers in Brazil and Colombia did not respond to requests.

The requirement was not publicized due to the specific details required in this installation that are only known by the manufacturer/installer. The system is critical to mission operations and the risk of having other companies attempt repairs could result in a major power loss. In addition, incorrect repairs would damage the system, resulting in total loss of power without an emergency generator backup and/or damage to equipment.

The Contracting Officer believes the cost to the USG is fair and reasonable. Market survey not possible to conduct due to use of one proprietary source and system.

SECTION 6. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT IS FAIR AND REASONABLE

By signing the justification, the Contracting Officer makes a determination that the price to the Government is anticipated to be fair and reasonable.

SECTION 7. CERTIFICATIONS

All reviews and approvals should be completed in the order listed unless otherwise authorized or required.
