About this file

This document is the Twelfth Amendment to a Technology Contract for a Voting Tabulation System Replacement between the State of North Dakota, specifically involving the Office of Management and Budget, State Procurement Office, Secretary of State Elections Unit, and Election Systems & Software, LLC, a Delaware limited liability company. The amendment builds upon a previous contract originally dated June 28, 2019, which has been modified through eleven prior amendments.

The amendment extends the contract for twelve months, with the new expiration date set to December 31, 2025. It details annual maintenance fees for voting system hardware and firmware, totaling $478,028.00 for the period of January 1, 2025 to December 31, 2025, and an additional $317.00 for a smaller set of equipment from March 1, 2025 to December 31, 2025. The contract covers maintenance and support for specific voting equipment, including 454 DS200 units, 510 ExpressVote 2.1 BMD units, and 58 DS450 units, with associated firmware licenses. The amendment also updates insurance requirements in line with statutory changes, increasing liability coverage limits across several categories. No further renewal options remain, though a renegotiation option is preserved.
