OPOAM 3008.405-6(a)(4)

Template - Limited-Sources Justification (LSJ) For orders or BPAs exceeding the Simplified Acquisition Threshold

LSJ Template > SAT Rev. 2/5/2016 4- 1 - LSJ No.:FY20-0200

LSJ No.: FY20-0200

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity: The Department of Homeland Security (DHS), Office of Procurement Operations (OPO) Cybersecurity and Infrastructure Security Agency Acquisitions Division (CISAAD) on behalf of the Cybersecurity Security and Infrastructure Security Agency (CISA), Office of the Chief Human Captial Officer (OCHO) proposes to award an order pursuant to FAR 8.405-6(a), Limiting-Sources.

2. Nature and/or description of the action being approved. DHS/OPO/CISAAD intends to limit the number of sources solicited pursuant to FAR Part 8.405-6(b)(1) for the procurement of LinkedIn Licenses and Subscription Services. DHS/OPO/CISAAD intends to solicit LinkedIn Licenses and Subscription Services from Carahsoft Technology Corporation (Carahsoft), as they are the only authorized Federal Supply Schedule (FSS) reseller of LinkedIn services on the General Services Administration’s (GSA) Information Technology (IT) Schedule 70 under Contract No. GS-35F-0119Y.

3. Description of Supplies/Services. The requirement is to provide LinkedIn Licenses and

Subscription Services for CISA at a total cost of $409,715.00 for a one-year base period.

The LinkedIn Licenses and Subscription Services is peculiar to one authorized GSA Reseller, Carahsoft. The Office of Management and Budget (OMB) has mandated recruiting and hiring goals for the CISA therefore CISA utilizes online recruitment platforms such as LinkedIn (amongst others online recruiting websites) to meet their recruiting and hiring goals. Therefore it is critical for CISA to continue to recruit for their job openings using these online platforms, including LinkedIn given OMB’s ever-increasing hiring goals for CISA in FY21 and beyond.

4. Authority and supporting rationale DHS/OPO/CISAAD intends to procure LinkedIn

Licenses and Subscription Services through the Multiple Award Schedule Program under the authority of 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies. The specific FAR Subpart supporting the justification of limiting sources is FAR 8.405-6(a)(1)(B) - only one source is capable of providing LinkedIn Licenses and Subscription Services required at the level of quality required because the LinkedIn Licenses and Subscription Services are unique or highly specialized. As the only authorized reseller, Carahsoft, is the only vendor capable of providing these services using the GSA IT Schedule 70. In relation to other online recruiting platforms, LinkedIn specializes in recruiting support for executives and managers for CISA. CISA currently maintains a business page on LinkedIn for advertising and marketing the agency to prospective employees that require special License and Subscription Services from LinkedIn in order to http://uscode.house.gov/ http://uscode.house.gov/ http://uscode.house.gov/ http://uscode.house.gov/

LSJ Template > SAT Rev. 2/5/2016 4- 2 - LSJ No.:FY20-0200 maintain their presence and utilize other critical hiring and recruiting tools such as communication with qualified candidates, collaboration with hiring managers, and posting job opportunities. The need CISA to continue to recruit for their job openings on LinkedIn with the procurement of these specailized Licenses and Subscription Services is a critical tool and service given OMB’s ever-increasing hiring goals for CISA in FY21 and beyond.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d). The Contracting Officer has determined that issuing the proposed Task Order for providing LinkedIn Licenses and Subscription Services represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. GSA has already negotiated fair and reasonable prices under its IT Schedule 70. Discounts from the GSA schedule prices will be requested.

6. A description of the market research. Market Research was conducted for this acquisition, and Carasoft is the only GSA approved FSS vendor under GSA IT Schedule 70 able to offer these LinkedIn License and Subscription Services due to exclusive licensing agreements.

7. Any other facts supporting the justification. LinkedIn License and Subscription Services have been historically acquired through limiting sources on the GSA IT Schedule 70 with Carasoft; previous justifications include FY19-0397.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. While DHS/OPO/CISAAD intends to acquire these services utilizing competition to the maximum extend possible in the future, at this time, competition is restricted to the sole vendor until Carahsoft’s exclusive licensing agrrement expires and are available to other FSS vendors.

9. DHS intends to post this requirement on e-buy pursuant to FAR 8.405-6(b)(3)(i)(B).
