Justification for Other than Full and Open Competition
Western Area Power Administration
FAR 13.5, Simplified Acquisitions for Certain Commercial Items
19WA130195
1. Identification of the agency and the contracting activity.
Western Area Power Administration (WAPA), Upper Great Plains Region, Billings, Montana.
2. The nature and/or description of the action being approved.
This requirement is for the renewal of software maintenance. WAPA is currently on contract with ABB and utilize their nMarket Scheduling and Settlements and their Archiving tool Dataglance ArcPlus along with the implementation/configuration for our custom nMarket application.
3. A description of the supplies or services required to meet the agency’s needs.
WAPA is currently on contract with ABB’s DataGlance ArcPlus add-on software product, which is customized to their nMarket system and fully integrated with the nMarket database. The integration and support provided by ABB is unique to this product. This solution will allow the administrator to move data out of the production system based on date, but still allows access to the data via nMarket application and reporting tools. The product is fully supported and maintained by ABB and includes
WAPA’s Custom Allocations module.
4. The statutory authority permitting other than full and open competition.
Citation: Section 4202 of the Clinger-Cohen Act of 1996
5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
ABB the sole provider of their proprietary software and services. The nMarket database is a proprietary system developed and maintained by ABB. Because a Data Archiving solution must be integrated with the database, it will require modifications to the proprietary system. No vendor other than ABB has the legal rights to this proprietary data, and therefore it is the only vendor who can provide these products to the Government.
