Because the anticipated value is above $35,000 and does not exceed $150,000, the successful Contractor shall furnish alternative payment protection in accordance with FAR 52.228-13.
Within ten (10) calendar days after award and before the Notice to Proceed, the Contractor shall submit one of the following forms acceptable to the Contracting Officer: (1) a payment bond; or
(2) an irrevocable letter of credit. The amount shall be 100 percent of the contract price and shall remain effective through the full performance period plus one year. No separate offer guarantee, performance bond, or payment bond is required at the offer stage.
G.2 INSURANCE
The Contractor shall provide and maintain all insurance required by Turkish law and the project-specific minimum coverages stated below. FAR 52.228-5 is included under FAR 28.310(b) in the Government’s interest because performance will occur inside an occupied official residence and involves demolition, plumbing, fabricated materials, and protection of Government property.
Before commencing work, the Contractor shall submit certificates of insurance acceptable to the Contracting Officer. The minimum general liability limits are:
Coverage Per Occurrence Cumulative Bodily Injury $15,000 $60,000 Property Damage $15,000 $60,000
The Contractor shall also maintain legally required workers’ compensation, employer’s liability, motor vehicle liability where vehicles are used, and insurance against loss or damage to materials and equipment in transit or storage. The general liability policy shall name the United States of America, acting by and through the Department of State, as an additional insured for operations under this contract, to the extent permitted by local law.
G.3 DEFENSE BASE ACT AND WORKERS’ COMPENSATION
The offeror shall complete the employee-category schedule implementing DOSAR 652.228-70 in Section L. FAR 52.228-3 applies to United States citizens or residents and to individuals hired in the United States, and it applies to other covered employees unless an authorized waiver or the DOSAR 652.228-70 local-law treatment applies. When the Contracting Officer determines that Turkish workers’ compensation laws cover local-national or third-country-national employees, the Contractor shall comply with those laws and assume the related war-hazard liability under FAR 52.228-4. The offered firm-fixed price shall include all required Defense Base Act, war-hazard, local statutory, and other insurance costs.
G.4 SITE ACCESS, SECURITY, AND PERSONNEL
The Contractor shall submit with its offer a complete list of proposed employees and supervisors.
Access is subject to Embassy security screening and approval. No person may enter the site or begin work until approved. The Government may deny or revoke access at any time. G.6 MATERIALS, SUBSTITUTIONS, AND GOVERNMENT APPROVAL
All materials shall be new, suitable for their intended purpose, and consistent with the approved submittals. Proposed substitutions must be submitted in writing with complete technical data and shall not be used unless approved in writing by the COR for technical acceptability and by the Contracting Officer when the substitution affects contractual requirements. Government approval does not relieve the Contractor of responsibility for performance and compatibility.
G.7 WARRANTIES
The Contractor shall provide manufacturer warranties and a minimum two-year written service warranty for installation and workmanship defects as required by the SOW. These warranties are in addition to the Government’s rights under FAR 52.246-21. If the contractual two-year warranty provides greater protection than FAR 52.246-21, the two-year requirement controls.
G.8 SAFETY AND OCCUPIED-RESIDENCE PROTECTION
The Contractor shall comply with DOSAR 652.236-70, the applicable portions of EM 385-1-1 or OSHA standards, Turkish occupational safety law, the accepted Site Safety and Health Plan, and COR safety directions. Dust-producing work, cutting, drilling, demolition, electrical tools, hot work, hazardous materials, and other high-risk activities require task-specific Activity Hazard Analyses and controls before work begins. The Contractor shall immediately report mishaps, damage, spills, fire, and unsafe conditions.
G.9 SALVAGE, DEBRIS, AND DISPOSAL
The Embassy retains salvage rights to removed materials. The Contractor shall obtain COR disposition instructions before removal from the site. Materials authorized for disposal shall be removed legally and documented upon request. No removed Government property may be sold, retained, or reused by the Contractor without written authorization.

(NONCOMMERCIAL) (DEPARTMENT OF STATE RFO CLASS DEVIATION)
(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post acceptance rights—
(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(b) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence. Examples of occurrences include acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. When an excusable delay occurs, the Contractor shall—
(1) Notify the Contracting Officer in writing as soon as possible;
(2) Remedy the delay as quickly as possible; and
(3) Notify the Contracting Officer when the occurrence is over.
(c) Termination for the Government’s convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price

The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor’s records. The Contractor shall not be paid for any work performed or costs incurred which reasonably could have been avoided.
(d) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance.
The Government will send a cure notice to the Contractor, unless the reason for the termination is late delivery.
In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.
(e) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.
H.3 AUTHORIZED DEVIATIONS AND REGULATORY IMPLEMENTATION
The RFO provisions and clauses identified in this solicitation apply in lieu of superseded legacy model language. FAR Part 12 clauses are not used because this is a noncommercial construction acquisition. FAR 52.236-26, 52.236-27, and 52.236-28 are reserved under the Department of State RFO Part 36 deviation; therefore, the organized site visit is stated as a solicitation instruction in Section J rather than as FAR 52.236-27. FAR 52.228-5 is included under FAR 28.310(b) because performance will occur inside an occupied official residence and involves protection of Government property.
