SOLICITATION 19SP5021R0001

JANITORIAL SERVICES FOR THE U.S. EMBASSY MADRID, SPAIN

QUESTIONS AND ANSWERS # 4

Question 1: Section I.6 – RIGHT OF FIRST REFUSAL. The list with the information provided by the current contractor pertaining to the personnel rendering services under the existing contract includes a “Limpiador (cleaner with seniority at the company 4/10/2017 and Type of employment TC-401 Obra y servicio”. Is this worker a permanent assigned worker or is he covering a sick leave of another employee included in that list? The reason for asking is that, if that is the case, his seniority at the job is 10/01/2020 (October 1 or January 10?), and if when the employee he/she is replacing returns from his/her sick leave, that employee will have to leave. Could this employee be a staff reinforcement due to COVID19.

Answer 1: The current contractor informs that this employee is a permanent assigned worker, whose been assigned to the job for more than 4 months and therefore he/she is subject to the right of first refusal in accordance with Spanish law with a senority of 4/10/2017.

All dates follow the English format MM/DD/YY.

Question 2: Why the list under Section I.6 does not include a Supervisor and the solicitation in 2015 did?

Answer 2: The labor categories to be considered for the purpose of the right of first refusal are those listed in Section I.6 of the current solicitation. HOWEVER, we have noticed that the information pertaining to the employee listed below is missing a monthly bonus of 63.23 Euros. Amendment no. 1 is being issued to correct and update this information as follows:

Peón especialista (Specialist pawn)

06/03/2002
06/03/2002
39 hours
TC 100 – Indefinido (Indefinite)

Plus a monthly bonus of 63.23 Euros

IMPORTANT NOTE: No more questions will be taken in connection with this solicitation.
