JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend that Embassy Lima, Peru use other than full and open competition for the acquisition of maintenance stock INTERFACE modular carpet or equal used for Lima Post buildings. The estimated cost is $65,000.00.

2. Nature and./or description of the action being approved

Follow-on Contract - Currently, Lima Post has installed on their compound buildings only INTERFACE modular carpets. The requested modular carpet would be used strictly for replacement of the deteriorated carpet on the building. The use of this specific carpet would guarantee the same and uniform appearance with the rest of the areas or sections and would avoid duplication of cost to the Government for keeping in our warehouse multiple stocks of carpet.

3. A description of the supplies or services required to meet the agency's needs

The requested TNTERFACE modular carpet or equal shall match exactly with the required dimensions, color, texture and rough-in with our existing installed modular carpet at Chancery and Annex Buildings. The modular carpet shall meet the following specifi cations :

Brand: Interface or equal Model: Tatami (1835) or equal Traffic Classification: Heavy Tile Size: 50x50cm Pile Height: 3.9mm (0.14") Pile Thickness: 3.0mm (0.12") Pile Density: 248.6 glm3 Total Thickness: 6.6mm (0.26")

4. An identification of the statutory authority permitting other than full and open competition.

Only One responsible Source (FAR 6.302-l)

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

INTERFACE Manufacturer is a GSA Supplier, and their products are protected for patent rights, which allow them to manufacture the products with the same style, color and pattern, which is being used in Lima Post Buildings.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a

FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 60s.202-70).

Lima Embassy has confirmed that this supply needs to be provided by Interface source because it hasn't been possible to get carpet with the same color, pattern and style as Lima Post has installed on their buildings. The requirement will be posted on

FedBidzOpps to get the best price from Interface dealers or distributors.

7. A determination by the Contracting Officer that the anticipated cost to the

Government will be fair and reasonable.

The carpet would be competed with Interface dealers and distributors including Interface manufacturer in order to get the best competitive and reasonable price.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

Due to the required Interface carpet would be used for remodeling Lima Chancery Offices, it is interest of Lima Post to keep the same standard in the buildings because it was determined any change of the model of carpet would impact with the Post budget trying to keep multiple stocks in the warehouse.

9. Any other facts supporting the use of other than full and open competition.

The purchase of this specific brand name would allow getting important savings because it wouldn't be necessary to get more stocks of carpets with different colors, styles, and patterns.

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.

N/A

I I . A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
