FROM:
A/OPE/EAD – Latoya Polk (NEA/SCA- Desk Procurement Officer)
SUBJECT:
Mobile Phone Voice and Data Services
Solicitation No. 19M05519Q0001
Contract Award No: 19M05519D0005
[Source Selection Information – See FAR 3.104]
Thank you for allowing me time to review the award documentation submitted on July 10, 2019, I am approving the proposed award to Maroc Telecom in the amount of $7,142,087.99 ($751,799.00)), for the base and the four option periods.
Approval
After the contractor signs the contract and you have verified that the contractor is registered within CCR, which is part of SAMs, you may sign this contract, even though it exceeds your warrant limitation subject to the conditions in this memorandum. This is a one-time re-delegation of authority from the Procurement Executive. Additionally, you or any successor holding a Certificate of Appointment as a Contracting Officer may sign this contract. [Desk Officer add if IDIQ contract: This is also a blanket delegation, as an IDIQ contract, for any task orders that will be issued under the contract, even though one or more of those orders may exceed your warrant limitation.]
FedBizOpps Award Synopsis
If the solicitation was advertised on FedBizOpps in accordance with PIB 2010-11 and FAR 5.101, once the contract has been awarded, you will need to post the award synopsis in accordance with FAR 5.301(a) (1) and (c) as well as FAR 5.302.
Please ensure the award date coincides with the actual award date. The award synopsis date (e.g. Block 2) must coincide with the date the synopsis is being posted. Finally, you will need to ensure you manually archive the synopses and solicitation.
Copy of Contract
Please email or send a copy of this contract to me after it is signed and any modifications issued. We can help you administer them more effectively if we have the entire contract on file.
Letters to Unsuccessful Offerors
Once the contract has been awarded, please ensure the letters to unsuccessful offerors are sent no later than 3 days after contract award. Please do not issue these letters prior to award of the contract.
Debriefing Letter if you receive a debriefing request, please prepare a response in accordance with FAR 15.5 and State 230843 and submit it for our review. The debriefing normally must occur within five work days after receipt of the written request. Also, to support this review, we will need to see the unsuccessful offeror letter sent, and the contractor’s written request for debrief.
Reporting & Funding Please make sure to enter this contract into FPDS with the requisite funding. In the “Description of Requirement” block of the FPDS report insert: a brief description of the requirement, such as “gardening services” or “janitorial services” followed by “approved by OPE on (insert date of this approval memo).” Please contact the ILMS help desk if you need any assistance in reporting.
[Desk Officer: If this is an IDIQ add the following: Since this is an Indefinite Delivery Indefinite Quantity (IDIQ) contract the fiscal data and funding are not on the award document so “zero” will be put in the funding field. All funding/fiscal data is on the delivery orders issued against the contract. Please note that you must obtain (just not obligate at this point) the necessary funding for the first delivery order to ensure you won’t be anti-deficient. Please ensure that you track the task orders issued under this contract to ensure that you do not exceed the maximum quantity for each performance year. Also, you may not increase the maximum quantity stated for each year of performance since this amount represents the contract ceiling.
COR Designation Letter
CO will need to ensure the COR designation letter is sent, the COR acknowledges receipt and a copy is provided to the contractor. In addition, before the letter is issued, the CO needs to ensure the COR has had the required training set forth in DOSAR subpart 642 and is in compliance with PIBs 2010-20, 2010-25, and 2011-05. Also, the COR will need to be certified through the Department’s FAC – COR on-line system before you may appoint (refer to PIB 2012-15).
Post Award Conference
Please review Chapter 7 of the Overseas Cookbook and the sample agenda on our website for conducting the post award conference. You will need to address the clauses and requirements in the contract to ensure successful performance of the contract.
TIPS Monitoring
This contract includes the clause FAR 52.222-50 Combating Trafficking in Persons (TIPS). The COR has monitoring responsibilities detailed in PIB 2011-09. These responsibilities include ensuring the contractor is aware of the requirements of the clause through post award discussion, verification that the contractor is briefing employees, inspection of adequacy of employer furnished housing among other responsibilities.
Past Performance
Please ensure compliance with PIB 2011-18 regarding the recording of past performance for this contract. If the contract’s estimated value (base and all option years) is over US $250K then it will automatically be included into Contractor Performance Assessment Reporting System (CPARS) as a result of the FPDS input. As the OPE Desk Officer I will register your contract into CPARS but I will need:
1. The full name and email of the Vendor rep responsible for contracts (not the Program Manager or sales rep);
2. the COR/GTM (ensuring that they are certified referencing PIB 2012-15 RTFP) to be identified as the Assessing Official Rep (AOR); and
3. CO/GSO to be identified as the Assessing Official (AO)
CPARS requires a Performance Assessment at the end of the contract term or if the contract has option years at the end of each contract term (base period and each option period). The assessment is entered into CPARS by post. If you have problems with the CPAR database the Department’s POC, Luis Kagalis, may be able to assist.
