1. 1.0 General
1.1 Introduction
The U.S. Embassy in Brazzaville requires the services of the contractor to construct the concrete caissons for a cantilevered covered area at the U.S Embassy Brazzaville. The work includes layout, excavation, sub-base preparation, reinforcing steel placement, concrete placement, curing, protection, and clean-up, limited to the concrete caissons only, as part of the U.S.
Mission to the Republic of Congo, Embassy Brazzaville. Bids should include all labor, materials, equipment, debris/trash removal, transportation and services for completion of work outlined and shall be in accordance with Local and US Standard construction specifications. All bidders need to possess a minimum of five (5) years’ experience. All bidders must provide three (3) references (telephone numbers of the companies the bidder has done similar jobs in the past five (5) years.
The contractor shall be required to take his own measurements and prepare a bill of materials, quality control schedules, a safety plan and drawings. These documents shall provide the necessary interfaces, coordination, and communication between the Embassy and the contractor.
1.1. Background
1.2. The Consular Section regularly serves a high volume of customers who must wait outdoors before accessing services. Currently, there is no designated covered area to protect visitors from adverse weather conditions, including rain, excessive sun exposure, and other environmental elements. This lack of shelter creates discomfort and inconvenience for customers, particularly during periods of extreme weather. It may also disproportionately affect vulnerable individuals such as the elderly, children, and those with medical conditions. Additionally, prolonged exposure to weather conditions can negatively impact the overall customer experience and perception of service delivery.
The proposed project aims to address this gap by constructing a covered parking and waiting area at the main CAC. The structure will provide adequate protection from weather elements, improve safety and comfort, and support orderly queue management.
By enhancing the physical environment, the project will contribute to more efficient operations and a higher standard of customer service within the Consular Section.
1.3. Scope
1.3.1. The contractor shall prepare a work plan for structural repairs including the driveway platform repairs and finish work. Build an additional pit to supplement the existing undersized structures. Build a concrete slab base for the new skid pump installation. Perform miscellaneous concrete repairs. This schedule must be approved by the Contracting Officer Representative (COR).
1.3.2. The Contractor shall locate and stake out seven (7) caisson locations as indicated on the engineered drawings approved for the project at U.S. Embassy Brazzaville, then excavate for each caisson to achieve a finished concrete size of 2 feet by 2 feet by 4 feet in depth, or as otherwise shown on the engineered drawings. The Contractor shall ensure that the sides of the excavation remain stable and safe, and that the bottom of each excavation is level and suitable for placement of the gravel sub-base.
1.3.3. At the bottom of each caisson excavation, the Contractor shall place a compacted gravel sub-base. The gravel layer must be at least 15 centimeters (approximately 6 inches) thick. The Contractor shall compact the gravel to a firm, stable condition that provides uniform support for the concrete caisson and is acceptable to the COR or designated Engineer. The Contractor shall verify and document the thickness and compaction of the gravel sub-base for each caisson as part of the quality control process. Where required by site conditions or the drawings, the Contractor shall provide and install forms
1.3.4. Work out concrete form tube to achieve the specified 2 foot by 2 foot by 4 foot caisson dimensions. The formwork shall be set true to line and grade and shall be capable of maintaining alignment and shape during concrete placement and curing in the Embassy’s environmental conditions.
1.3.5. The Contractor shall furnish and install all reinforcing steel as indicated on the engineered drawings. The reinforcing shall consist of 3/8 inch (No. 3) rebar for each caisson, placed and tied in accordance with the engineered drawings. The Contractor shall maintain the required concrete cover and spacing of bars using appropriate chairs, spacers, and ties. Rebar placement shall be made available for inspection by the COR or designated Engineer prior to concrete placement. Any discrepancies noted by the COR shall be corrected at the Contractor’s expense before concrete is poured.
1.3.6. The Contractor shall supply concrete of appropriate strength to support the structure. A minimum M30 grade concrete with a compressive strength of 30MPa and 4350 psi must be used. Where local materials or production standards differ, the Contractor shall propose an equivalent mix design for COR approval prior to use.
The Contractor shall place concrete in each caisson in a continuous operation to avoid cold joints and shall consolidate the concrete by vibration (use commercial concrete vibrator) or other approved means to eliminate voids and ensure full encapsulation of the reinforcing steel. The top of each caisson shall be struck off and finished in accordance with the engineered drawings, including required top elevation, surface finish, and installation of any anchor bolts, embedded plates, or hardware that must be set at the time of the pour. The Contractor shall protect the fresh concrete from rain, direct sun, rapid drying, and mechanical damage during the curing period. The Contractor shall ensure that construction activities within the Embassy compound do not damage the caissons during curing, using barricades, signage, or other protective measures as required by the COR.
1.3.7. Upon completion of the concrete work, the Contractor shall remove all excess materials, debris, and formwork from the site and shall leave the work area clean and in an orderly condition, suitable for subsequent construction of the cantilevered covered area. Disposal of waste and surplus materials shall comply with Embassy guidance and local environmental regulations, as directed by the COR. After the concrete is poured the garden area and sidewalk shall look as before the contractor began work. Before and after photos will be added to the record to verify any shortcomings or any extra-needed cleaning required of the contractor.
1.3.8. All work shall conform to the latest approved engineered structural drawings for the cantilevered covered area, applicable U.S. Government design and safety requirements, and local building codes and concrete and reinforcing standards as required by the local authority having jurisdiction. In the event of a conflict between U.S. Government requirements and local codes, the Contractor shall notify the CO/COR and await written direction before proceeding. Any field condition or issue that prevents compliance with the drawings or these requirements shall be promptly reported to the CO/COR for written direction before the Contractor proceeds.
Concrete testing, if required, shall be performed by an independent testing agency approved by the CO/COR, and results shall be provided to the COR for review.
1.3.9. The deliverable under this Statement of Work consists of seven (7) completed concrete caissons, each nominally 2 feet by 2 feet by 4 feet, installed within the U.S.
Embassy Brazzaville compound on a compacted gravel sub-base at least 15 centimeters thick and reinforced with 3/8 inch rebar set in accordance with the engineered drawings. Upon acceptance by the COR, these caissons shall be ready to receive and support the cantilevered covered area structure serving the U.S. Mission to the Republic of Congo.
1.3.10. Finish works as required, including base coat mortar plaster on both sides of the wall and finish paint work. Miscellaneous concrete repairs.
1.3.11. General clean-up of the jobsite.

The Contractor shall be responsible for any countermeasures or corrective action, within the scope of this contract, which may be required by the Contracting Officer as a result of such inspection.
D.1 SUBSTANTIAL COMPLETION
(a) "Substantial Completion" means the stage in the progress of the work as determined and certified by the Contracting Officer in writing to the Contractor, on which the work (or a portion designated by the Government) is sufficiently complete and satisfactory. Substantial completion means that the property may be occupied or used for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which:
(1) do not interfere with the intended occupancy or utilization of the work, and
(2) can be completed or corrected within the time period required for final completion.
(b) The "date of substantial completion" means the date determined by the Contracting Officer or authorized Government representative as of which substantial completion of the work has been achieved.
Use and Possession upon Substantial Completion - The Government shall have the right to take possession of and use the work upon substantial completion. Upon notice by the Contractor that the work is substantially complete (a Request for Substantial Completion) and an inspection by the Contracting Officer or an authorized Government representative (including any required tests), the Contracting Officer shall furnish the Contractor a Certificate of Substantial Completion. The certificate will be accompanied by a Schedule of Defects listing items of work remaining to be performed, completed, or corrected before final completion and acceptance.
Failure of the Contracting Officer to list any item of work shall not relieve the Contractor of responsibility for complying with the terms of the contract. The Government's possession or use upon substantial completion shall not be deemed an acceptance of any work under the contract.
D.2 FINAL COMPLETION AND ACCEPTANCE
D.2.1 "Final completion and acceptance" means the stage in the progress of the work as determined by the Contracting Officer and confirmed in writing to the Contractor, at which all work required under the contract has been completed in a satisfactory manner, subject to the discovery of defects after final completion, and except for items specifically excluded in the notice of final acceptance.
D.2.2 The "date of final completion and acceptance" means the date determined by the Contracting Officer when final completion of the work has been achieved, as indicated by written notice to the Contractor.
D.2.3 FINAL INSPECTION AND TESTS. The Contractor shall give the Contracting Officer at least five (5) days advance written notice of the date when the work will be fully completed and ready for final inspection and tests. Final inspection and tests will be started not later than the date specified in the notice unless the Contracting Officer determines that the work is not ready for final inspection and so informs the Contractor.
D.2.4 FINAL ACCEPTANCE. If the Contracting Officer is satisfied that the work under the contract is complete (with the exception of continuing obligations), the Contracting Officer shall issue to the Contractor a notice of final acceptance and make final payment upon:
• Satisfactory completion of all required tests,
• A final inspection that all items by the Contracting Officer listed in the Schedule of Defects have been completed or corrected and that the work is finally complete (subject to the discovery of defects after final completion), and
• Submittal by the Contractor of all documents and other items required upon completion of the work, including a final request for payment (Request for Final Acceptance).

(b) If the Government terminates the Contractor’s right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Default clause.
CONTRACTOR'S SUBMISSION OF CONSTRUCTION SCHEDULES
(a) The time for submission of the schedules referenced in FAR 52.236-15, "Schedules for Construction Contracts", paragraph (a), is hereby modified to reflect the due date for submission as 10 calendar days after receipt of an executed contract".
(b) These schedules shall include the time by which shop drawings, product data, samples and other submittals required by the contract will be submitted for approval.
(c) The Contractor shall revise such schedules (1) to account for the actual progress of the work, (2) to reflect approved adjustments in the performance schedule, and (3) as required by the Contracting Officer to achieve coordination with work by the Government and any separate contractors used by the Government. The Contractor shall submit a schedule, which sequences work so as to minimize disruption at the job site.
(d) All deliverables shall be in the English language and any system of dimensions (English or metric) shown shall be consistent with that used in the contract. No extension of time shall be allowed due to delay by the Government in approving such deliverables if the Contractor has failed to act promptly and responsively in submitting its deliverables. The
Contractor shall identify each deliverable as required by the contract.
(e) Acceptance of Schedule: When the Government has accepted any time schedule, it shall be binding upon the Contractor. The completion date is fixed and may be extended only by a written contract modification signed by the Contracting Officer. Acceptance or approval of any schedule or revision thereof by the Government shall not:
(1) Extend the completion date or obligate the Government to do so,
(2) Constitute acceptance or approval of any delay, or
(3) Excuse the Contractor from or relieve the Contractor of its obligation to maintain the progress of the work and achieve final completion by the established completion date.
NOTICE OF DELAY
If the Contractor receives a notice of any change in the work, or if any other conditions arise which are likely to cause or are actually causing delays which the Contractor believes may result in late completion of the project, the Contractor shall notify the Contracting Officer. The Contractor’s notice shall state the effect, if any, of such change or other conditions upon the approved schedule, and shall state in what respects, if any, the relevant schedule, or the completion date should be revised. The Contractor shall give such notice promptly, not more than ten (10) days after the first event giving rise to the delay or prospective delay. Only the Contracting Officer may revise the approved time schedule.
NOTICE TO PROCEED
(a) After receiving and accepting any bonds or evidence of insurance, the Contracting Officer will provide the Contractor a Notice to Proceed. The Contractor must then prosecute the work, commencing and completing performance not later than the time period established in the contract.
(b) It is possible that the Contracting Officer may elect to issue the Notice to Proceed before receipt and acceptance of any bonds or evidence of insurance. Issuance of a Notice to Proceed by the Government before receipt of the required bonds or insurance certificates or policies shall not be a waiver of the requirement to furnish these documents.
WORKING HOURS
All work shall be performed during work hours from 7:30 AM to 5:00 PM Monday through Saturday. Other hours, if requested by the Contractor, may be approved by the Contracting Officer's Representative (COR). The Contractor shall give 24 hours in advance to COR who will consider any deviation from the hours identified above. Changes in work hours, initiated by the Contractor, will not be a cause for a price increase.
