About this file

This is a Request for Quotation (RFQ) for a research study on unfair labor practices employed by foreign entities of concern (FEOCs) in Colombia's strategic sectors.

The U.S. Department of Labor (DOL) at the U.S. Embassy in Bogotá seeks a contractor to conduct a utilization-focused research study documenting unfair labor practices by FEOCs in mining, infrastructure, and energy sectors. The one-year contract, valued as firm fixed price, requires delivery of a comprehensive research report, case files for formal referral to Colombia's Ministry of Labor, and public awareness materials. Key deliverables include a draft and final evaluation report in both English and Spanish (Section 508-compliant), three to five case files with supporting evidence, a minimum of five data graphics highlighting labor violations, and a communication and dissemination plan. The contractor must also conduct up to three interactive sense-making sessions presenting findings to DOL and stakeholders. The solicitation mandates a Security and Safety Plan addressing territorial security risks, Institutional Review Board (IRB) approval, and comprehensive fieldwork protocols. Two key personnel positions—Project (Contract) Manager and Lead Researcher—require prior approval, with the Project Manager needing at least three years of contract management experience in Colombia and the Lead Researcher requiring a master's degree and at least five years of labor-related research experience in Colombia. The offer due date is December 10, 2026, at 16:00 local time, with a site visit scheduled for November 30, 2026. Evaluation criteria emphasize technical approach (60%), proposed key personnel (30%), and price (10%), with the government awarding to the lowest priced, technically acceptable offeror. A monthly status report requirement and payment schedule tied to deliverable milestones structure contract performance across twelve months, with final payment contingent upon completion of all deliverables and COR approval. The contract is unrestricted with no set-aside designated.

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

Statement of Work: Countering Unfair Labor Practices in Colombia’s Strategic Sectors Foreign entities of concern (FEOC) have expanded operations across Colombia’s strategic sectors, leveraging unfair labor practices, including, but not limited to, abusive subcontracting, misuse of temporary contracts, suppressing unionization, fragmented oversight structures, and occupational safety and health hazards to gain unfair trade advantage. These practices contribute to labor precarity, depressed wages, health and safety risks, and cost advantages that distort markets and undermine fair competition.

The U.S. Department of Labor (DOL) at the U.S. Embassy in Bogotá seeks to build evidence through a utilization-focused research study that strengthens DOL's knowledge base on FEOC labor practices to inform Colombian government enforcement action and raise Colombian public awareness of associated risks.

PURPOSE

The contractor will design and implement a research study that documents unfair labor practices employed by FEOCs in strategic sectors, especially those essential to U.S. national security and economic priorities, such as mining, infrastructure, and energy. The research shall generate practical, actionable insights for DOL to inform Colombia’s Ministry of Labor (MOL) and other institutional actors to support increased inspection, enforcement, transparency, and public awareness of FEOCs. The contractor will recommend strategic sectors based on three major criteria – relevance to U.S. national security and/or economic priorities, evidence of problematic labor practices by FEOCs, and vendor expertise in the sector - and finalize them with DOL post award. The goal of the research study is to produce a replicable model for addressing labor related unfair trade practices committed by FEOCs across Colombia and, ultimately, the broader region.

MAJOR TASKS

The contractor shall develop a work plan for all tasks included in this procurement. The work plan shall include a breakdown of all key activities under each task with a corresponding timeline. The work plan shall be revised monthly and submitted to the COR as part of the status report which includes progress of work and planned activities by task, any changes to planned work, and any anticipated risks/mitigation measures. The contractor shall render the services below to accomplish the main purpose and implement the following activities:

Task 1. Research study that maintains methodological rigor while retaining flexibility to adapt to sector specific conditions and emerging findings.

Activities under Task 1 include:

• Convening a launch call with DOL to confirm objectives, timeline, and logistics;

• Preparing a Terms of Reference (TOR) in collaboration with the COR using the provided template that defines research questions, methodologies, and deliverables, including what should be included in the final research findings;

• Creating data collection instruments;

• Developing the Security and Safety Plan (see Security Conditions section below);

• Obtaining Institutional Review Board (IRB) or other necessary ethical clearance or research approval through local ethics committees prior to engaging with human subjects ;

• Conducting desk research and site visits (where feasible);

• Using diverse data collection methods such as surveys, key informant interviews, and focus-group discussions to engage workers, unions, the private sector, MOL officials, and other key stakeholders identified through document review and in consultation with DOL;

• Performing data analysis to feed into the research study;

• Conducting one to two validation exercises to verify key findings, identify gaps, and refine conclusions;

Banjade, Shreeya N - ILAB Please add as appropriate:

Please provide full details on security levels, government expectations, and DOL review criteria so the vendor can develop protocols for researchers. Specifically, please clarify:

Whether DOL will provide security guidance Whether any regions are off limits Whether safety protocols must follow U.S. Embassy standards

• Delivering a draft report in English or Spanish, followed by a final, copy-edited report in Section 508-compliant electronic format, including a PII and a non-PII version in both languages. Report should include an Executive Summary not to exceed five pages; and

• Presenting final research findings to DOL and relevant stakeholders through up to three interactive sense-making sessions (in English and in Spanish).

Task 2. Translating research findings into actionable results for policy makers, inspectors, and enforcement personnel Activities under Task 2 include:

• Preparing three to five case files in Spanish for documented instances of unfair labor practices identified through the research (i.e. document review and primary data collection under Task 1), including a factual summary, supporting evidence, relevant legal/regulatory citations, and clear identification of the entities involved, for formal referral to MOL. Cases will be selected by DOL;

• Consulting with key end-users at MOL on case file format and referral process to ensure submissions meet MOL's intake and evidentiary needs;

• Submitting the draft case files to DOL for review and written approval prior to finalization; and

• Presenting the case files to MOL officials through an in-person or virtual convening, to be determined by

DOL.

Task 3. Raise public awareness to strengthen transparency and public understanding.

Activities under Task 3 include:

• Producing a minimum of five small data graphics in Spanish, each focusing on one key issue, data point, or other discrete information that accurately and responsibly highlight egregious labor-rights violations identified through the research. DOL will provide feedback on draft graphics before finalization. Final graphics will be in 508-compliant electronic format, consistent with DOL provided branding guidelines.

• Ensuring communication products are accessible, evidence-based, and responsive to the needs of DOL;

and

• Providing a communication and dissemination plan (template provided) that summarizes how findings can be communicated to workers, civil society, the private sector, government, and the general public to promote informed dialogue on labor standards and foreign investment.

SECURITY CONDITIONS

Security conditions in Colombia, including territorial control by armed groups, may change during the period of performance. The Contractor shall assume full responsibility for the safety and security of its employees, subcontractors, and research participants. The Contractor shall:

• Develop a Security and Safety Plan that includes:

o a security risk assessment and mitigation measures for each proposed research location;

o safety protocols for researchers and participants, including procedures for high-risk or remote sites;

o procedures for monitoring conditions and informing personnel of threats, incidents, and changing conditions;

o incident response, medical emergency, and evacuation procedures;

o criteria for postponing, relocating, or switching to remote data collection when conditions worsen;

and o measures to protect participants' identities and prevent retaliation against workers who take part in the research.

• Monitor security conditions throughout performance and update the plan as conditions change.

• Review and approve all travel for its personnel. The Contractor retains sole responsibility for this.

Banjade, Shreeya N - ILAB Updated to be more specific

• Notify the COR within 24 hours of any security incident affecting personnel, participants, or project activities.

The Contractor shall submit the Security and Safety Plan with the draft work plan. DOL's review will confirm only that the plan addresses the required elements. That review does not make DOL or the U.S. government responsible for whether the Contractor's security measures are adequate. U.S. Embassy security policies do not apply to Contractor personnel. The Contractor shall follow industry best practices and applicable Colombian law.
