About this file
This document is a Justification and Approval for Other Than Full and Open Competition (JOFOC) for the US Embassy in Brunei Darussalam. The procurement involves purchasing a UNOX ChefTop Mind.Maps Countertop ONE electric combi oven and associated accessories, with a total estimated cost of BND$12,683.70 (approximately USD$9,558.17). The oven is being acquired for the CMR (Commissary) and offers multiple cooking capabilities, including sous vide, steaming, roasting, baking, and dehydrating, with advanced features like tracking cooking times and temperatures, storing up to 200 recipes, and consuming up to 30% less energy compared to traditional professional ovens.
The sole source justification is based on Catertrade Restaurant Equipment Supplies (B) Sdn Bhd being the exclusive distributor of UNOX brand in Brunei Darussalam. The procurement falls under the simplified acquisition threshold and is exempt from full and open competition. The document was prepared on July 27, 2023, and signed by Lys Boon (Procurement Agent) and Inna Moody (Contracting Officer), with the solicitation number 19BX6023P0236. The contract was awarded on August 9, 2023, to an unspecified vendor for an undisclosed amount.

2. Nature and/or description of the action being approved.
Purchase, delivery, and installation of 1 electric combi oven, and 1 hot fridge for the CMR.
3. A description of the supplies or services required to meet the agency’s needs.
For professional food preparations, a combi oven is an indispensable tool. It has been proven to save time, money and space compared to a conventional oven.
With the UNOX ChefTop Mind.Maps Countertop ONE (XEVC-0511-E1RM), upon activation, it’s proprietary high performance heating element is able to heat up the oven from 20C (68F) to
260C (500F) in 300 seconds. A mere 5 minutes compared to 20 minutes to reach 176C/350F or even 45 minutes to an hour to reach 260C/500F. Even so, on average, UNOX ovens have shown to consume up to 30% less energy compared to traditional professional ovens. Both a time, and cost saving measure.
This oven is also able to cook in the presence (sous vide, steam, roast, braise, overnight cook, par-bake, pre-cook, pasteurize) or absence (grill, roast, sear, fry, smoke) of humidity. This removes the need to acquire several smaller appliances (sous vide, steamer, braiser/slow cooker, deep fryer, smoker) that can do each job individually, and instead opt for a machine that is multi-functional.
It is also able to function as a deck oven, for pastries, breads and baked goods, and a dehydrator.
Further removing the need to acquire specific tools for a singular kitchen task. Furthermore, it has
3 times the internal capacity of a conventional oven (which is currently in use at the CMR), coupled with its ability to cut down on preheating and cooking times, will allow us to save on labour cost as well.
The technology contained within the oven can allow us to keep track of cooking time and temperatures to ensure it stays within HACCP temperature guidelines for food safety. It can also program and store over 200 unique recipes and creations, allowing for ensured consistency and repeatability time and time again.
4. An identification of the statutory authority permitting other than full and open competition.
Only One Responsible Source (FAR 6.302-1). Sole source (where only one responsible source and no other supplies or services will satisfy agency requirements) under 41 USC 253(c)(1). The acquisition does not exceed the simplified acquisition threshold ($150,000).
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).
Catertrade Restaurant Equipment Supplies (B) Sdn Bhd is the sole distributor in Brunei
Darussalam of the UNOX brand. The company regularly brings in brand ambassadors to demonstrate optimised usage of their line of UNOX ovens and is trusted with carrying out repairs under warranty.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).
See above. A FedBizOpps notice was or will not be publicized, as required by EAR 5.2 under exception FAR 5.202(13) - The proposed contract action — (i) is for an amount not expected to exceed the simplified acquisition threshold.
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
As per item 5.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
As per item 5.
9. Any other facts supporting the use of other than full and open competition.
N/A
10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
