About this file

This is a Request for Quotations (RFQ) issued by the U.S. Embassy Rangoon for preventive maintenance services for potable and wastewater treatment systems. The solicitation number is 19BM8027Q0006, with quotations due by noon on December 29, 2026. The contract is a firm fixed price award to be performed at the NEC Compound in Yangon, Myanmar, consisting of a one-year base period plus four optional one-year extension periods, with expected commencement no later than March 2027. The Government intends to award based on initial quotations using a comparative evaluation methodology that considers technical capability, past performance, and price as discriminators to determine best value. Offerors must be registered in the System for Award Management (SAM) at time of proposal submission and award and must provide proof of registration.

The scope of work encompasses professional preventive maintenance services for two water treatment systems: a domestic potable water treatment system serving 42,000 liters (11,000 gallons) and a wastewater collection and treatment system. Services include materials, labor, tools, equipment, and all associated logistics. The contractor must visit the Embassy annually, provide 16 hours of annual operator familiarization training in English, respond to weekly water quality test results within 24 hours, and submit detailed maintenance reports within 14 business days of each visit. Specific maintenance procedures are detailed in two exhibits covering HVAC water treatment systems, filtration, softening, chemical treatment, pumps, wells, tanks, controls, and wastewater collection and treatment operations. The contractor must provide three customer references of similar scope and U.S. Dollar value, demonstrate financial and personnel capability, obtain all required local licenses and permits, and comply with comprehensive safety requirements including personal protective equipment, confined space procedures, electrical safety, and hazard mitigation. Pricing must include all costs for materials, labor, insurance, overhead, and profit with no additional escalation allowed. Emergency services and repairs are excluded from the base contract but hourly rates must be provided for potential separate purchase orders.

652.239-801 DISCLOSURE OF AI USE CLAUSE (DEVIATION SEP 2025)

(a) Definitions. As used in this clause- Artificial Intelligence (AI): The term "artificial intelligence" has the meaning provided in Section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019.

i. This definition of AI encompasses, but is not limited to, the AI technical subfields of machine learning (including deep learning as well as supervised, unsupervised, and semi-supervised approaches), reinforcement learning, transfer learning, and generative AI.

ii. This definition of AI does not include robotic process automation or other systems whose behavior is defined only by human-defined rules or that learn solely by repeating an observed practice exactly as it was conducted.

iii. For this definition, no system should be considered too simple to qualify as covered AI due to a lack of technical complexity (e.g., the smaller number of parameters in a model, the type of model, or the amount of data used for training purposes).

52.214-34 SUBMISSION OF OFFERS IN THE ENGLISH LANGUAGE (APR 1991)

SECTION 4 - EVALUATION FACTORS

FAR 52.212-2 – Evaluation – Commercial Products and Commercial Services (Deviation JAN 2026)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Government intends to establish a single contract award(s) that includes a one-year base year plus four (4), 12-month options and potentially extending services for up to 6 months under FAR 52.217-8, resulting from this solicitation to the responsible contractor whose quote conforms to the solicitation’s instructions and requirements and represents the best value to the Government, price and other factors considered as shown in the solicitation. Quotes that do not conform to the instructions and requirements of the solicitation shall be deemed unacceptable and no further consideration shall be given unless the Contracting Officer determines that requesting revised quotes is deemed advantageous to the Government.

The Government intends to award a contract/purchase order resulting from this solicitation based on the comparative evaluation process under FAR Part 12. The evaluation process shall include the following:

The preliminary evaluation process:

STEP #1: COMPLIANCE REVIEW.

a. Compliance Review. The Government will perform an initial review of quotes received to determine compliance with the instructions, terms and requirements of the solicitation. This review does not restrict the Government from requesting revised quotations as provided under FAR Part 12. The Government shall reject quotes which do not conform to the instruction and requirements of the solicitation.

If the quote is deemed unacceptable, no further consideration shall be given.

b. Technical Acceptability. Technical acceptability will include a review of past performance and experience as defined in Section 3, along with all other technical information provided by the offeror with its quote and as required under Section 3.

c. Price Evaluation. Total price will be determined by multiplying the offered prices times the estimated quantities in “Prices – Continuation of SF-1449, Block 23”, and arriving at a grand total, including all options. This includes pricing information for potentially exercising the 6-month option to extend services (FAR Clause 52.217-8). The Government reserves the right to reject quotes that are unrealistically low or unreasonably high.

d. Responsibility Determination. The Government will determine a prospective contractor’s responsibility by analyzing whether the apparent successful offeror complies with the requirements of FAR Subpart 9.104- 1, general standards, including:

(i.) Have adequate financial resources to perform the contract, or the ability to obtain them;

(ii.) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;

(iii.) Have a satisfactory performance record;

(iv.) Have a satisfactory record of integrity and business ethics;

(v.) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (vi.) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them and (vii.) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

(viii.) Provide evidence of an active SAM account at time of proposal/quote submission and at the time of award.

c. If the quote is deemed compliant, it shall advance to Step #2 below.

STEP #2: Comparative Evaluation

A comparative evaluation will be performed in accordance with FAR 12.203 (c)(2). A comparative evaluation is defined as the act of comparing two or more offers in response to the RFQ. The item-by-item comparison is performed by comparing each offer directly to one another to determine which provides the best value to the Department utilizing technical and past performance criteria and price as described below. Award will not be made on the lowest price, technically acceptable or formal trade-off process as detailed under FAR Part 15. Quotes will be compared against each other to determine the best value to the Government.

Evaluation Criteria

Technical: Technical requirements will be evaluated based on a direct comparison to other offers to discern if there is any kind of technical quality superiority that would support an award to a higher priced offer. Below are the technical discriminators deemed to be a priority for this requirement.

Past Performance: Past performance may be evaluated on the basis of a direct comparison to other offers to discern if there is any significant past performance superiority that would support an award to a higher priced offer. Past performance used as a discriminator may be appropriate where, based on the offeror’s performance record and all other factors being equal, the Government has a higher expectation that the offeror will successfully perform the required effort.
