DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID:___36C263-20-AP-0377____
1. Contracting Activity: Department of Veterans Affairs, VISN 23, Minneapolis VA Medical Center
2. Nature and/or Description of the Action Being Processed: Approval to obtain 33 parking spaces plus validation for the Minneapolis VA Community Resource and Referral Center (CRRC) without competition. This is a new contract. The proposed lease space is at 17 11th S St, Minneapolis, MN 55403. Proposed award date is March 1, 2020.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: This requirement is to lease 33 parking spaces plus validation for the Minneapolis, MN CRRC for the purpose of government fleet, employee and validation parking located at 17 11th S St Minnapolis, MN 55403. The Minneapolis CRRC services the Metro area in Minneapolis, MN. The 5-year term will include a 1-year firm term and four 1-year options. The anticipated value for a base plus four option year contract is $493,327.39. These are fully-serviced rates.
4. Statutory Authority Permitting Other than Full and Open Competition: 41
U.S.C. § 3304(a)(5), as implemented by FAR 6.302-5 "Authorized or required by statute". 38
U.S.C § 8109(f) expressly authorizes that the acquisition may be made from a specified source. “The Secretary may contract (by lease or otherwise) for the operation of parking facilities at medical facilities under such terms and conditions as the Secretary prescribes and may do so without regard to laws requiring full and open competition.”
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition
Requires the Use of the Authority Cited Above (applicability of authority): 11th and Harmon Municipal Ramp is the only lessor with adequate parking space that is located within the required 1 ½ blocks from the Minneapolis CRRC. There were no other available properties found that could meet the Government’s need.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The CRRC is a community walk-in center with a multidisciplinary team serving Veterans who are homeless or at risk of homelessness. Revision 08 Date: 04/18/2018 parking spaces attached to the lease. Due to not having additional parking via the lessor, the VA CRRC is in need to continue a second contract with a parking ramp within a 1 ½ block radius. This radius is set forth by a union agreement, as staff are required to provide case management services in the community the majority of their work time. VA vehicles must be in close proximity due to the safety of patients, quick access to vehicles and operational productivity. In addition, the location of the CRRC is in an urban area without any other parking ramps available to meet the requirements of the statement of work.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Parking rates were researched for the required 1 ½ block radius area from the Minneapolis CRRC and none were available within that radius. The location of the CRRC is in an urban area without any other parking ramps available to meet the requirements of the statement of work.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Parking rates were researched for the required 1 ½ block radius area from the Minneapolis CRRC and none were available within that radius. The location of the CRRC is in an urban area without any other parking ramps available to meet the requirements of the statement of work.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: 11th and
Harmon Municipal Ramp at 11th St. S, Minneapolis, MN 55403.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Expanding the area of consideration beyond 1 ½ block radius was considered but found to be unsuitable, due to lack of the requirement for VA vehicles to be in close proximity for the safety of patients, quick access to vehicles and operational productivity.
12. This radius is set forth by a union agreement, as staff are required to provide case management services in the community the majority of their work time.
13. Requirements Certification: I certify that the requirement outlined in this justification is a
Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
