About this file

This document is a Construction Bid Addendum No. 1 issued by the Michigan Department of Technology, Management and Budget (DTMB), State Facilities Administration, Design and Construction Division for the Snedicor's Cleaners project located at 220 South Michigan Avenue in Howell, Michigan. The addendum, dated June 9, 2025, is for a project with bid opening scheduled on June 25, 2025 at 2:00 P.M., and was prepared by Weston Solutions of Michigan, Inc. The addendum includes three key attachments: a pre-bid meeting sign-in sheet, DTMB FAQs for Asbestos Abatement Law Changes, and DTMB FAQs for Prevailing Wage Law Changes.

The addendum highlights two significant legislative changes affecting state construction projects. First, Public Act 59 of 2024 requires owners to conduct background investigations on asbestos abatement contractors, including reviewing state and federal records for violation notices, with contractors having 5 or more violations being ineligible for state work. Second, Public Act 10 of 2023 (amended by PA110 of 2024) mandates that all contractors and subcontractors performing state construction work must register with Labor and Economic Opportunity (LEO) Wage and Hour, obtain a State Project Registration (SPR), and pay an annual fee of $500 to submit bids and certified payroll. These changes become effective April 2, 2025, and apply to all projects with bids due on or after that date.

Q: How will the background investigation results be used?

A: Contractors or subcontractors with 5 or more notices of violation of environmental regulations or subject to an administrative consent order or a consent judgment involving environmental regulations cannot contract for work with the State of Michigan DTMB Design and Construction for asbestos abatement.

Q: When will the investigation be conducted?

A: The owner will conduct the investigation as a part of the bid review period.

Q: Where is the newly added Asbestos Abatement Attestation form found?

DTMB FAQs for Prevailing Wage Law Changes

DTMB-SFA- DESIGN AND CONSTRUCTION

Frequently Asked Questions for Recent Law Changes April 8, 2025

Prevailing Wage Law Q: What has changed in the prevailing wage laws?

A: Per Public Act 10 of 2023, amended per PA110 of 2024, all contractors and subcontractors performing work for the State of Michigan as a construction mechanic must register with Labor and Economic Opportunity (LEO) Wage and Hour and receive a State Project Registration (SPR) and pay the associated annual fee to be able to submit bids for state work and submit certified payroll during the project.

Q: When did the change become effective?

A: April 2, 2025.

Q: Does this change apply to projects bid and/or already under a contract before April 2, 2025?

A: No, the change applies to all projects with bids due on or after April 2, 2025.

Q: How do I get a State Project Registration (SPR) register with LEO Wage and Hour?

A: Instructions can be found on the LEO Wage and Hour Prevailing Wage website for attaining the required State Project Registration (SPR) for all contractors and subcontractors.

Q: How much does it cost and how do I pay the annual fee?

A: The fee will be determined by LEO Wage and Hour and is currently $500. The fee is paid directly to LEO Wage and Hour through their website. Please contact LEO Wage and Hour for any assistance or questions relating to issues for registration or payment.

Q: What happens if I submit a bid without the required SPR?

A: As the law requires, the bid will be determined not responsive and cannot be awarded a contract.

Q: Do I have to provide a SPR for every subcontractor that I provide with post bid submittals when I am being considered for award of a contract?

A: No, but the SPR’s must be available if requested. If it is not able to be provided, the contract may be terminated.

Q: What happens if I need to change a subcontractor after the work begins?

A: The General Contractor must immediately notify the Owner of any change in registration status for themselves and any subcontractor and is required to ensure that all subcontractors maintain a SPR with LEO Wage and Hour.

Q: How do I submit the required certified payroll?

A: Certified payroll for both the contract and subcontractors is required to be submitted directly to LEO Wage and Hour with the access provided at the time of paying for your SPR. Certified payroll for projects with State of Michigan Prevailing Wages are not to be submitted to DTMB at any time.

Q: Who do I ask for assistance with determining the appropriate wage rate?

A: LEO Wage and Hour.
