10 I believe you may have inadvertently posted the wrong wage determination. Is the attached for Harris Co area correct?

It has been corrected and posted as an amendment on FBO.

11 Would the government consider adding an EPA clause to allow adjustment for fuel costs; or in the alternative, direct billing of fuel costs? Either option would represent a savings to the government as risk must otherwise be built into pricing.

12 Other than capacity to accept the projected number of boxes, does the government have a position as to type of transport vehicle or specify any requirements?

14 What was the cost of the final full option year of the previous contract?

15 How many drivers/vehicles are currently used to service the current contract?

16 What are the vehicle sizes required? Van

17 Regarding personnel and vehicles to perform and their documentation: It is common practice for small businesses that the drivers, cars and other equipment used for a contract are not sourced until after an award has been made, for cost effectiveness and to reduce loss. Will you be accepting this documentation after the award?

18 Will this contract be SCA enforced? After reviewing the solicitation on FBO, it contains language and dollar values regarding the Service Contract Act. This solicitation stipulates $14.03 minimum wage for courier drivers, $4.18 minimum H&W, Sick Time/Vacation. Do you verify now that those are the minimum required rates to be performed on this contract upon award?

19 Besides the 10-page Technical Proposal, will you be accepting supporting documentation such as Insurance Certificates, Past performance References, SCA Cost Break-down, etc.?

Not at the time of quote submission.

20 SBA Final Rule regarding FAR Clause 52.219-14 Limitations on Subcontracting, dated June 30, 2016, reclassifies Independent Contractor drivers as Subcontractors — 13 CFR 125.6 “Work performed by an independent contractor shall be considered a subcontract.” Please inform us how ICE/OPLA would like us to proceed upon award regarding this rule change given that it will affect our offer regarding pricing and performance.

This clause is only applicable to orders exceeding the SAP Threshold.

21 Note: Per either of the rules, current or previous, our employees, as appropriate, will perform a minimum of 51% of the contract cost (almost always 100% excepting emergency backup). We would like to note that Independent Contractor driver usage is widespread across the industry, and it is likely that many companies will wrongfully use IC drivers for the entirety of contract performance.
