____X: Individual Basis _____: Class Basis
This justification authorizes and approves a two (2) month extension until a new award takes place. The current extension ends on 12/31/2018 and we would like to extend the task order to 2/28/2019. As the current transition period ends 3/31/2019, this justification also authorizes and approves shifting the transition period from 1/1/19 to 3/31/19 to 3/1/19 to 5/31/19. By our estimates we should award by 2/1/2019.
2. Description of Supplies or Services:
The estimated value of the proposed action, including all options, is:
MIDAS is a computer system acting as a central data warehouse for capturing, aggregating, and analyzing data from Affordable Care Act (ACA) related systems and processes. MIDAS has implemented communication networks and technology infrastructures that both facilitate and regulate the delivery of healthcare insurance for select population groups. MIDAS is a data repository and analytics solution that supports improved decision making, improved business practices and improved services to states and federal agencies.
Currently, these services end on December 31, 2018 and the Transition Out period runs from January 1, 2019 to March 31, 2019. The requested extension will allow for continued development, operation and maintenance support beyond December 31, 2018.
The need for this task order extension is due to the award date of the MIDAS re-compete moving from August 2018 to February 1, 2019. CMS requested revised proposals from the acceptable offerors, which were received on November 19, 2018. The anticipated award date is February 1, 2019.
3. Authority and Rationale:
The Contracting Officer shall give every awardee a fair opportunity to be considered for a delivery/task order exceeding $3,000 unless one of the following statutory exceptions applies. FAR 16.505(b)(2).
Mark the applicable exception:
___ The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays [FAR 16.505(b)(2)(i)(A)];
_X_ Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized [FAR16.505(b)(2)(i)(B)];
As the Center for Consumer Information and Insurance Oversight’s (CCIIO’s) central repository for capturing, organizing, aggregating, and analyzing information related to CCIIO’s mission, MIDAS is a critical information system for CMS.
Access to data must be allowed for concurrent users from various locations. MIDAS must be operational 24 hours a day, seven (7) days a week. CACI, the current contractor, is the only responsible source that can provide the required services during the extension period of performance, as they are the only contractor that is familiar with operating and maintaining MIDAS and are the only contractor with all of the required personnel to successfully perform the work. This puts CACI in the unique position of being able to continue operating MIDAS on short notice. It would be impossible to on-board a new contractor for the 1-month period due to the amount of time required to ramp up staff, transition in and successfully take over operations.
____ The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order [FAR 16.505(b)(2)(i)(C)];
or
____ It is necessary to place the order to satisfy a minimum guarantee [FAR 16.505(b)(2)(i)(D)].
____ A statute expressly authorizes or requires that the purchase be made from a specified source.
4. Any Other Facts Supporting the Justification
The task order extension will greatly benefit CMS by allowing continuation of the MIDAS services until a new contractor is on-boarded and by avoiding major disruptions to CMS business and technical staff to focus on transition activities. The task order extension will also mitigate the risk for premature loss of essential CACI technical staff resources and expertise during this period.
Additionally, the task order extension will enable CMS to conduct a competition and increase opportunities for small business.
5. Efforts to Remove Barriers from Fair Opportunity
To remove barriers from fair opportunity, CMS will conduct a competitive procurement for the required MIDAS services and make a task order award in February 2019.
6. Fair and Reasonable Determination
By my signature below, after review of the relevant documents, I have determined that the order subject to this Justification represents the best value for the Government as set forth in FAR 16.505(b)(2)(ii)(B)(5),and constitutes a fair and reasonable price. The basis for my determination is as follows:
The total estimated cost-plus-fixed-fee amount of for the 2-month task order extension was determined by using the actual prices paid against recent monthly invoices submitted by CACI under the current MIDAS task order. The total estimated cost for the task order extension falls in line with historical costs incurred for the same effort and therefore, has been determined to be fair and reasonable. In accordance with FAR 15.403-4, a certificate of current cost or pricing data will be obtained from the contractor. In addition, pursuant to FAR 15.404-1, the Contracting Officer will perform cost analysis and cost realism analysis on the contractor’s proposed costs to determine that the negotiated price will be fair and reasonable.
