About this file
This is a Sole-Source Determination document from the Oregon Department of Fish and Wildlife (ODFW) involving a federal grant from the U.S. Fish and Wildlife Service (USFWS) to the Western Association of Fish and Wildlife Agencies (WAFWA). The document justifies a sole-source contract with the Klamath Bird Observatory (KBO) for the Oregon Purple Martin Movement Study, which will deploy archival GPS tags and Motus tags on up to 20 adult Western Purple Martins over two years at Fern Ridge Reservoir in Lane County and North Bank Habitat Management Area in Douglas County. The project aims to determine key migration corridors, stopover sites, wintering sites, migration timing, habitat associations, and breeding site fidelity for western purple martins across the Pacific United States and into Central and South America.
The sole-source procurement is justified by KBO's unique qualifications, including being the only entity with the necessary state and federal permits (USGS Federal Bird Banding Permit #22834) to capture, band, and deploy tracking transmitters on purple martins in the Pacific Northwest. KBO has previously deployed 40 archival GPS datalogger tags and 35 Motus radio transmitter tags on Purple Martins since 2020, and has the required partnerships and landowner access agreements. The project is funded through a federal grant, and ODFW will pay the contractor as deliverables are completed throughout the contract period in 2025 and 2026.

SOLE-SOURCE DETERMINATION AND JUSTIFICATION FOR
SUPPLIES AND SERVICES
Date: 30 July, 2025 To: April Brenden-Locke, Designated Procurement Officer, Contract Services, Administrative Services Division
From: Jade Keehn, Regional Conservation Biologist Claire Duvall, Procurement and Contract Specialist
RE: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and
Oregon Administrative Rule (OAR) 125-247-0275
CSR: CSR 190-25: Oregon Purple Martin Movement Study: Capture, Tagging, and Tracking
Project
Part A
1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)
2. Estimated Total Value of the Procurement:
3. Single or Multiple Purchases: Multiple Purchases. ODFW will pay the contractor as deliverables are completed throughout the period of performance of the contract.
4. Proposed Contractor: Klamath Bird Observatory (Home Page - Klamath Bird Observatory)
5. Brief Description of Goods or Services to be procured: Contractor will deploy archival GPS tags and Motus tags on adult Western Purple Martins over two years, at Fern Ridge Reservoir in Lane County, and North Bank Habitat Management Area in Douglas County. Contractor will also resight and recapture returning GPS-tagged birds in 2026 or 2027, and download location data.
6. Background: ODFW is the subawardee of a federal grant (F25AP00307) from the USFWS to the
Western Association of Fish and Wildlife Agencies (WAFWA) for the purpose of “Expanding the Motus Network in the Pacific and Intermountain Western United States to Facilitate Management of Species of Greatest Conservation.” Objectives of this grant include work to determine key migration corridors, stopover sites, and wintering sites, as well as migration timing, habitat associations, and breeding site fidelity for western purple martins across the Pacific United States and into Central and South America. To meet this objective, the Agency intends to contract with Klamath Bird Observatory (KBO) to tag up to 20 purple martins at 1 to 2 major colony sites in Oregon in the spring and summer of 2025 and 2026.
A sole source procurement is necessary to achieve grant objectives. KBO is a science partner specializing in the biology of species native to northern California and southern Oregon. They https://klamathbird.org/
Sole-Source Determination_rev01-31-24 (ODFW 7/24/2025) Page 2 of 3 are staff partner on projects that provide long-term monitoring to understand changes in bird populations; provide theoretical research that advances understanding of distribution and movements; and use applied ecology principles to address natural resource management challenges. KBO is the only entity currently in possession of the necessary state and federal permits and training needed to capture, band, and deploy tracking transmitters on purple martin. They are the only organization currently using this technology with the subspecies of purple martins that occurs in the Pacific Northwest, and KBO has the necessary partnerships and landowner access agreements needed to access locations where this species occurs.
4. Findings:
A. Market Research Overall Finding.
Federal award terms require that subrecipients or contractors must “comply with all terms and conditions as specified in the USGS Federal Bird Banding Permit #22834,” which is a permit held by Klamath Bird Observatory. No other entities are authorized to band under this permit.
And
B. Findings of Fact pursuant to OAR 125-247-0275(2) must include, at a minimum, one of the following:
1. Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
N/A
2. Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data. Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
N/A
3. Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project. Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.
N/A
4. Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of:
unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.

To receive authorization to work with a species or a specific method of research, the researcher must demonstrate to the federal permitting entity that they have experience with both the species and the technology to be used. There are no other business entities working in who have the qualifications necessary to implement the scope of work for this contract.
There are no other Bird Observatory organizations with coverage that includes the focal area for this project.
While there are other business and/or non-profit entities that provide education, engagement, and science services associated with birds, none of these entities have necessary permits and experience to conduct the activities proposed in the grant narrative.
Federal award terms require that the recipient, and any subrecipients or contractors must “comply with all terms and conditions as specified in the USGS Federal Bird Banding Permit #22834,” which is a permit held by Klamath Bird Observatory.
Part B - Conditions of Approval will be inserted by ODFW-DPO.

To whom it may concern:
Klamath Bird Observatory (KBO) is in possession of the necessary state and federal permits, and training and experience needed to capture, band, and deploy auxiliary tags on western Purple Martins (Progne subis arboricola). We have deployed 40 archival GPS datalogger tags using leg-loop harnesses on Purple Martins since 2020, and have attached 35 Motus radio transmitter tags as well as 46 GPS dataloggers on Oregon Vesper Sparrows since 2020 using the same harness technique.
Matt Rogosky (Biologist, Permit Section, USGS Bird Banding Laboratory) has confirmed that KBO is currently the only entity in Oregon with this specific permission – attaching datalogger or transmitter tags to Purple Martins – on our banding permit (Federal Bird Banding Permit #22834).
Sincerely, Ryan S. Terrill
