Addendum to 52.212-4, Contract Terms and Conditions – Commercial Items
1. Wide Area Workflow (WAWF):
WAWF PROCEDURES:
If your order WILL BE PAID BY DFAS (not by credit card) and contains DFARS Clause 252.232-7003, Electronic Submission of Payment Requests, you must submit your invoice through Wide Area Workflow (WAWF). This clause requires invoices for supplies and services purchased by the DoD be submitted via electronic means. The WAWF System satisfies this mandatory requirement. WAWF can be accessed on the internet at https://wawf.eb.mil/ Ensure the Electronic Business POCs listed in the System For Award Management (SAM) website are the same individuals that will submit invoices through WAWF before using WAWF. You can make changes to your SAM profile at http://sam.gov by clicking on the “Register/Update Entity.” SAM customer support can be reached at: toll-free in the US (866-606-8220) internationally (334-206-7828) and DSN (866-606-8220); Hours of Operation 8am – 8pm EST.
If your Electronic Business (EB) POCs are correct, contact the WAWF helpdesk at 1-/866-618-5988 or by email at cscassig@ogden.disa.mil and ask them to establish a group for your CAGE Code. The group administrator will also have to call the WAWF helpdesk to request account activation. Once the group is established and the account is activated, you will be able to create a Combination Invoice/ Receiving Report (SUPPLIES / MATERIALS) or a 2 in 1 Invoice (SERVICES / EQUIPMENT) using the codes available from our contract administrator / buyer.
Questions concerning payment should be directed to the responsible Defense Finance and Accounting Service (DFAS). Please have the order / contract number and invoice number ready when calling about payment status.
The accounts payable mailing address can be located in Block 18a of your order. You can easily access payment information using the DAFS web site at http://www.dfas.mil. Your purchase order / contract number or invoice number will be required to inquire status of your payment. Go to DFAS on the web at www.dfas.mil/money/vendor.

52.0000-4000 02 NON-RELEASE OF CONTRACT INFORMATION (MAR 2000)
1. Any proprietary, confidential commercial, trade secret or similar type of information in the contract resulting from this solicitation may not be released to anyone outside the Government.
2. Do not release proprietary, confidential commercial, trade secret or similar type of information from this contract to anyone inside the Government that does not have a legitimate need to know the information.
3. If in doubt about what information in the contract may be released, contact the Contracting Officer.
4. Criminal penalties are provided by 18 U.S.C. for the improper release of proprietary and/or confidential commercial information. (End of notice)
52.0000-4918 AUTHORITY OF GOVERNMENT REPRESENTATIVE (FEB 2001) (AFSC 52.201-4500)
The contractor is advised that contract changes, such as engineering changes, will be authorized only by the Contracting Officer or his authorized representative in accordance with the terms of the contract. No other Government representative, whether in the act of technical supervision or administration, is authorized to make any commitment to the Contractor or to instruct the Contractor to perform or terminate any work, or to incur any obligation. Project Engineers, Technical Supervisors and other groups are not authorized to make or otherwise direct changes which in any way affect the contractual relationship of the Government and the Contractor.

3. Additional Instructions, Services Only:
a. Passes and Badges:
(1). Security requirements at Blue Grass Army Depot, Richmond, Kentucky, include issuance of badges for identification purposes to personnel entering the Depot. Contractors are required to secure employee identification badges from the Security Control Office for all their employees engaged in contract performance who, as part of their employment, must enter the military reservation. No charge is made for badges if badges are returned. Contractors will be charged fifty dollars ($50.00) for each badge issued to replace lost badges or badges damaged through carelessness, negligence or misuse and no contractor employee will be permitted entry into the Depot unless he has in his possession and wears the prescribed identification badge.
b. Hours of Work:
(2). Normal working hours are 6:30 A.M. until 5:00 P.M., EDT, Special Permission may be obtained to work until 30 minutes prior to sunset.
c. Traffic:
(1) The Contractor will be required to conform to Depot regulations as concerns:
(a) Designated routes
(b) Parking regulations
(c) Insurance ‑ See below, INSURANCE REQUIREMENT concerning the type and amount of automobile liability insurance the contractor is required to maintain on all automobiles used by the contractor in connection with the performance of the contract. The contractor will also insure that all private vehicles brought on the Government reservation by either the contractor or any of his employees and not used in connection with the performance of this contract are fully insured for minimum amount of personal injury and property damage liability required by the State of Kentucky.
(2) Insurance Requirements
(a) In accordance with Insurance‑Work on a Government Installation clause, FAR Reference 52.228‑5, incorporated herein, the following amounts of insurance are required:

(3). Highway Barricades and Warning Signs:
(a) The Contractor will be required to comply with Depot Regulations BGAD Reg 56‑1.
d. Department of Defense (DoD), Department of Army (DA), Occupational Safety and Health Administration (OSHA) and local Blue Grass Army Depot (BGAD) rules and regulations shall govern contractors, sub-contractors, suppliers and their employees. A copy of the Blue Grass Army Depot Safety Regulation 385-1, Safety Manual will be provided to contractor upon award, and whenever requested.
(1) Contractors shall comply with Title 29 Code of Federal Regulations-1910 (OSHA General Industry Standards), Title 29 Code of Federal Regulations-1926 (Construction Industry Standards) and National Fire Protection Association Codes as applicable.
(2) All contractor and subcontractor employees on site at BGAD shall comply with any and all safety requirements as stated in the specific statement of work or technical specifications applicable to the contract/order.
(3) OSHA VOLUNTARY PROTECTION PROGRAM – Blue Grass Army Depot is working towards participation in the OSHA Voluntary Protection Program (VPP). Accordingly, BGAD expects and requires full contractor compliance with all applicable safety regulations and standards. The contractor is responsible for maintaining, monitoring and enforcing full compliance with all applicable rules, regulations and codes.
(4) JOB HAZARD ANALYSIS (JHA) – Prior to the start of work, the contractor shall prepare a JHA for each phase of work that will be done under the contract. A phase is defined as operations involving a certain type of work. Some examples would be demolition, excavation, masonry work, concrete pouring, roofing, and electrical wiring. Work done by each subcontractor is also a phase. The JHA will list the activity being performed and identify the sequence of work steps, the hazards associated with each step, and the procedures, safeguards, and or training that will be taken to eliminate the hazards or reduce the risk to an acceptable level. Copies of the JHA will be given to the Contracting Officer’s Representative (COR) prior to the start of work. JOB HAZARD ANALYSIS information may be accessed at: Job Hazard Analysis, OSHA Publication 3071. NOTE: Review of a JHA does not constitute approval of the adequacy of the safety measures identified for the job or compliance with OSHA rules and regulations.
(5) FALL PROTECTION – Particular attention is directed to the OSHA Fall Protection Requirements. Personnel performing any work on elevated surfaces, six (6) feet or more above a lower level, shall comply with 29 CFR 1926.500 through 1926.503.
(6) ELECTRICAL SAFETY – Particular attention is directed to the current edition of NFPA 70E, “Standard for Electrical Safety in the Workplace”. Contractor shall fully comply with all sections of this standard.
(7) EXPLOSIVE SAFETY - A waiver, risk assessment (RA) or other restrictions affecting the performance of a project may be generated by BGAD or Blue Grass Chemical Activity (BGCA). Work restrictions may be imposed on contractors due to hazards associated with explosive quantity distance and/or chemical weapons exposure due to the nature of depot operations. Restrictions may include alternate work schedules (hours/days), depot operational changes or incidents that require evacuation of the site, and other issues that impact the contractor’s ability to perform the job. Anticipated restrictions will be provided prior to start of work so impacts are understood, incorporated into the schedule, and strictly followed. Contractors will be briefed on explosive safety issues and acknowledge receipt of training before operations begin.
(8) SAFETY PLAN- Contractors with ten (10) or more employees will submit a written Contractor Safety Plan to the Contracting Officer within five (5) days after receipt of the notice to proceed. The Safety Plan is the contractor’s safety and health policy and program document. It is not intended to address specific technical safety and health requirements. The following areas are typically addressed in a safety plan, but a plan can be job specific and also address any unusual or unique aspects of the project or activity for which it is written:
(9) Statement of safety and health policy.
(a) Administrative responsibilities for implementing the safety plan; identification and accountability of personnel responsible for safety and accident prevention.
(b) Means for coordinating and controlling work activities of contractors, subcontractors, and suppliers; responsibility of subcontractors to comply with the safety plan.
(c) Plans for initial safety indoctrination and follow up safety training.
(d) Provisions for frequent safety inspections of work sites, material, equipment, and employees to ensure compliance with the Plan; means for recording inspections and deficiencies and the means, timetable, and individual responsible for their correction.
(e) Responsibilities for investigating and reporting accidents, reporting occupational health exposure, maintaining accident and exposure data, reports, and logs.
(f) Emergency response capability to minimize the consequences of accidents.
(g) Contingency plans for severe weather such as windstorms, lightning, tornados, etc.
(h) Plans for maintaining job site cleanup and safe access.
(i) Public safety requirements such as signs and barricades.
(j) Local requirements that must be addressed.
(k) Prevention of alcohol and drug abuse on the job.
(l) Details of hazard communication program.
(m) Provisions for updating the plan.
(10) An updated copy of the Safety Plan will be available on the job site at all times. The Safety Plan will be made available to the Contracting Officer for review should it be requested. Review of the Safety Plan does not connote approval of the adequacy of the safety measures outlined for the job or of compliance with OSHA requirements.
(11) In any conflict between this attachment and other standards, rules or regulations, the stricter of the two shall apply.
(12) The contractor is at all times responsible for job-site safety.
(13) Temporary Structures:
(a) The Contractor will be required to comply with Corps of Engineers Manual EM 385‑1‑1.
(14) Fire Prevention and Protection: The Contractor shall comply with all fire prevention measures prescribed in the installation fire regulations, (BGAD Reg 420‑4 Fire Prevention Control and Evacuation), a copy of which is on file in the office of the Directorate of Public Works, Engineering Division, Bldg S‑14. A written fire permit shall be obtained from the installation fire marshal for use of open flame devices such as blowtorches, portable furnaces, tar kettles, or gas and electric welding and cutting equipment in, on, or within 15 feet of buildings. The Contractor shall be liable for any fire loss to Government property attributable to negligence on the part of the Contractor, including failure to comply with fire prevention measures prescribed by terms of this contract.
(15) Accident Prevention: The provisions of AMCR 385‑100, Safety Manual, and Volume 37, Number 202, Part II, Dept. of Labor, Occupational Safety and Health Standards, dated October 18, 1972 will be strictly adhered to and will be available in the office of the Directorate of Public Works, Facilities Engineering Div., Bldg. S‑14 for reference by Contractors.
e. Environmental:
The Contractor is required to comply with Blue Grass Army Depot Command Policy Letter # 14-1, a copy of which is available at Bldg S14 or fax your request to (859) 779-6465.
(a) The Contractor is required to perform their duties in a manner that prevents pollution, conserves natural resources, and protects the environment.
(b) The Contactor shall comply with BGAD-R 200-1 Environmental Stewardship, local, state and federal environmental laws and regulations.
f. Utilities:
a. It has been determined by the Contracting Officer, that Government‑owned and operated utility systems and supplies are adequate for the needs and use of the Contractor as well as the Government and all reasonably required amounts of water and electricity will be made available to the contractor without charge.
g. Clearing the Depot at Contract Completion:
(a) Contractors shall clean up all work sites, remove all contractor-owned equipment and material, and shall turn in any and all badges issued to contractor personnel before final payment can be made.
h. Required Coordination With Land Management and/or Cultural Resources on Services Requiring The Contractor to Provide Services Off Of Any Asphalt or Concrete Work Area. [Note: This Clause Applies Only To Contracts That Involve The Movement of Soil or Removal of Vegetation.]
i. For issues relating to cultural resources contact the Contract Specialist or Contracting Officer for guidance.
4. Additional Clauses, Services Only:
10. 52.0000-4016 CONTRACTOR MANPOWER REPORTING (CMR) (APR 2005)
The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor is required to completely fill in all the information in the format using the following web address https://cmra.army.mil. The required information includes:
(1) Contracting Office, Contracting Officer, Contracting Officer’s Technical Representative;
(2) Contract Number, including task and delivery order number;
(3) Beginning and ending dates covered by reporting period;
(4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data;
(5) Estimated direct labor hours (including sub-contractors);
(6) Estimated direct labor dollars paid this reporting period (including sub-contractors);
(7) Total payments (including sub-contractors);
(8) Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each sub-contractor if different);
(9) Estimated data collection cost;
(10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purposes of reporting this information);
(11) Locations where contractor and sub-contractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website);
(12) Presence of deployment or contingency contract language; and
(13) Number of contractor, and sub-contractor employees deployed in theater this reporting period (by country). As part of its submission, the contractor will also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending September 30 of each government fiscal year and must be reported by 31 October of each calendar year. Contractors may use a direct XML data transfer to the database server of fill in the fields on the website. The XML direct transfer is a format for transferring files from a contractor’s systems to the secure web site without the need for separate data entries for each required data element at the web site. The specific formats for the XML direct transfer may be downloaded from the web site. (End of Provision)
The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Blue Grass Army Depot/Blue Grass Chemical Activity via a secure data collection site”. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/ Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013.
