About this file
This is a Sole-Source Determination Memo issued by the Oregon Department of Human Services (ODHS) Office of Contracts & Procurement on behalf of the Oregon Health Authority (OHA) for the procurement of a Bit.ly Enterprise Subscription. The Agency, represented by Designated Procurement Officer Kirk N. Rhoades and requestor Daniel Hoke from the Office of Information Services, seeks to procure a proprietary cloud-based link management and digital connection platform to support the Agency's Patient Facing Survey Tool and comply with Oregon House Bill 3159, the Data Justice Act. The Bit.ly Enterprise Subscription will provide link shortening, QR code generation, survey referral management, security response capabilities, and dashboard metric oversight. The contract term is five years with an estimated total value of $93,204.92, with OHA reserving the right to continue the subscription for additional compensation and time up to $200,000 or ten years total, whichever comes first. The sole prospective contractor is Bitly, Inc., located at 250 W. 34th Street, Suite 310, New York. Protests to the sole-source determination are due within seven calendar days after the first date the notice is posted on OregonBuys and must be submitted to Katrina Augustus at the ODHS Office of Contracts and Procurement.
The justification for sole-source procurement is based on ORS 279B.075(2)(a), which permits sole-source acquisition when efficient utilization of existing goods requires compatible goods or services from only one source. The Agency determined that Bit.ly is necessary for efficient operation of its existing systems and survey infrastructure, as no alternative product has been identified that is compatible with the current configuration or capable of providing equivalent functionality without significant operational disruption or redevelopment of existing systems. Bitly, Inc. is the sole source for this proprietary software. The procurement authority derives from DHS OAR 125-247-0275, OAR 125-246-0170(2), DAS Delegation 649-11 as amended, OHA OAR 137-047-0275, and ORS 413.033. The Agency reserves the right to purchase additional goods and services, including on-call maintenance, preventative maintenance, repair, or training.
