Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C261-20-AP-0017
1. Contracting Activity: Department of Veterans Affairs, VISN 21, VA Palo Alto Health Care System, 3801 Miranda Avenue, Palo Alto, CA 94304, purchase request number 640-20-1-5281-0009.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Network
Contracting Office (NCO) 21 anticipates the award of a firm fixed price contract to install approximately 8,000 square feet of thermoplastic polyolefin (TPO) roofing system on building 7 wing E. The proposed action will be a logical follow-on to an originally competed contract. The original contract was 36C26119C0084. The estimated value of the proposed action is $213,936.00.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The original contract was for Joseph Murphy Construction to install TPO roofing systems of approximately 6,100 square feet on building 7 wing A, 9,000 square feet on building 7 wing B and 128 square feet on building T-6B. This contract was competed under solicitation 36C26119B0018 as 100% Service-Disabled Veteran Owned Small Business set aside.
There were 3 offers received. 36C26119C0084 was awarded to Joseph Murphy Construction on May 20, 2019. Joseph Murphy Construction is currently performing this work, the contract completion date is November 28, 2019.
This new contract will be awarded to Joseph Murphy Construction to install approximately 8,000 square feet of thermoplastic polyolefin (TPO) roofing system on building 7 wing E.
This logical follow-on will capitalize on the time spent in submittal processing and financial investment already made into the mobilization and demobilization costs already incurred/schedule to be incurred by Joseph Murphy Construction. If this work were given to another contractor, the materials submittal processing and mobilization and demobilization that was provided under 36C26119C0084 would be again incurred. This is a cost savings of $50,000 which was derived from the independent cost estimate completed by the contracting officer’s representative and engineering technical expert and a time savings of approximately 30 days.

4. Description of market research conducted and results or statement why it was not conducted:
Market research was not conducted because a new competition would be impracticable. This requirement is suited to a logical follow-on as awarding to another contractor would be a duplication of submittal processing, and mobilization and demobilization efforts.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
