JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION FOR

ACQUISITIONS NOT EXCEEDING $650K

1. Agency/Contracting Activity: Mission & Installation Contracting Command – Dugway Proving Ground

2. Description of Action:

Nature: New Requirement Follow-on Requirement

Mod to Purchase Order/Contract Number:

Pricing: Firm-Fixed Price Time & Materials Cost Type

Funds: Operation & Maintenance RDT&E Other Funds:

Name of Contractor / Vendor: TSI Inc Street Address: 500 Cardigan Road City, State, Zip Code: Shoreview Phone: (800) 831-7750

3. Description of Services or Supplies: The total estimated value of the proposed action is that includes scanning mobility particle sizer, advanced aerosol neutralizer, and special materials that includes the fixtures for dual APS/OPS calibration bench top system.

4. Authority: (Identify the statutory authority, FAR title and FAR citation permitting other than full and open competition. It may be one of the following, but other exceptions may be used.)

Action using simplified acquisition procedures (select one):

FAR 13.501(a)(1)(ii): For actions for commercial supplies or services greater than the SAT but not exceeding $6.5M, the correct citation is: Test Program for Commercial Items, Section 4202 of the Clinger-Cohen Act of 1996 as codified at 10 USC Sec. 2304(g)(1)(B), and amended by Section 807 of the Ronald Reagan National Defense Authorization Act of 2005.

Actions other than simplified acquisition procedures (select one):

5. Reasons for Authority Cited:

(a) [ii), FAR 6.302-1 Explain why the intended contractor is the only reasonable source who can provide the requir d supplies or services. Explain factors/unique qualifications such as proprietary data or exclusive licensing rights, if applicable. If appropriate, discuss how the sole source action will avoid duplication of costs that is not expected to be recovered through competition, or the unacceptable delays to the government. If unusual and compelling urgency is the basis for the justification, explain the chronological events leading up to the requirement and explain why time constraints cannot permit even a limited competition.

Sources sought was posted on fbo.gov and no responces have been received as of Nov. 14,2017.

Calibration capabilities for trace level real-time aerosol detection referee system are required for

-2-particle size characterization and particle counting of toxic chemical materials such as CWA and NTA. DPG has the long history of operating aerosol detection systems but was limited to non-toxic materials because we have been rely on the vendor provided calibration systems. Detectors have proven to meet the preliminary NGCD TEMP T&E requirements for both liquid and solid particles using simulants. In order to referee CWA/NTA aerosols, DPG requires an accredited calibration capability to ensure precision and accuracy of measurements. Capabilities must include (1) procurement of an Aerosol Calibration System that is accredited and have factory traceability and certification and (2) acquire on-site training of the new calibration system by the original manufacturer and receive certification for Aerosol Particle Calibration at DPG and by DPG personnel. This enables DPG to perform calibration as required and perform quality control and validation to support T&E on demand.

6. Actions to Increase Competition: This requirement will be synopsized as a combined commercial solicitation/synopsis on the Federal Business Opportunities website for a minimum of ten calendar days. Sources sought was posted on fbo.gov and no responces have been received as of Nov.

14,2017. Any competitive offers that are received in response to the RFQ will be reviewed by the requiring agency for technical compliance and whatever any potential cost savings incurred would offset the additional training and life cycle maintenance costs.

7. Market Research: Describe the extent of the market research conducted to identify all qualified sources and the results thereof. "Market Research" is defined as those attempts you made to ascertain whether other qualified sources exist. Research of the marketplace may consist of written, telephonic, or world wide web inquiries.

Market Research was conducted through experts with ECBC Aerosol Testing Branch located in DPG, project scientists, and TMDE calibration engineers based on the capabilities required to be acceptable to the new ISO standard procedures and testing capabilities. WDTC/CTD urgently need to acquire means of calibrating aerosol detection systems so that the aerosol detectors at CTD can be certified for calibration using the standardized calibration system and accredited the calibration procedures.

We added the cost as an estimation because the cost was based on only ONE MODEL of APS whereas CTD requires equivalent calibration capabilities for another model that is Optical Particle Sizer. There for the additional cost is estimation accounted for a newly modified calibration system that can calibrate two different models :APS and OPS. Aerosol science branch personnel who received certificate of training in 2014 for aerodynamic particle sizer and other aerosol SMEs who are familiar with procurement of aerosol detection system calibration as well as a phone conversation with TSI incorporation scientist as the system is not marketed COTs item.

Subject experts from DPG, Project Scientist Branch members, and relevant Chemical Test Division Management have discussed and explored all possible detection referee options to support upcoming Next Generation Chemical Detection system testing. The major contributing factor in down selecting the system was comparing COTS technologies for particle size characterization and enumeration with the special focus on size range measured and the associated accuracy of measurement. Furthermore external dimensions deemed important for inclusion into glove box

-3-systems for operator safety. DPG already have the established standing operating procedures and have long history of operating and calibrating this particular Model 3321 in house using the vendor provided calibration system. This system has a long standing of supporting numerous test programs since 2011 by Life Science Division Recent market research conducted identified TSI Incorporated is the only vendor provides the equipment compared to GRIMM-aerosol detection equipment, Thermos-scientific aerosol monitoring equipment, and AeroTrak® line of Airborne Particle Counters. All these detectors did not meet the performance and sensitivity requirements for particle size determination and particle distribution with precision and accuracy.
