VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP Attachment 2: Request for Sole Source Justification Format >SAT
DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A)
For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID:36C249-19-AP-2816
1. Contracting Activity: Department of Veterans Affairs, VISN 09, Nashville VA Medical Center
626-19-4-2101-0088.
2. Nature and/or Description of the Action Being Processed:
This procurement is for a new firm fixed price contract to continue the use of the current mobile sterile processing trailer that is in use at the Nashville VA Medical Center. This acquisition is in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR
13.501 Special Documentation Requirements, where acquisitions conducted under Simplified
Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.
3. Description of Supplies/Services Required to Meet the Agency's Needs:
This requirement is for the lease of one mobile sterile processing trailer for a period of six months, September 22, 2019- March 21, 2020. The total estimated contract value is $960,774.90.
4. Statutory Authority Permitting Other than Full and Open Competition:
The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C.
1901 and is implemented by for restricting competition on this procurement via FAR 13.106-l(b)(2).
5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The requirement for a mobile sterile processing trailer was originally awarded under VA249-17-P-
2253. The contract was awarded for a 7-month period with the option to extend the period of performance for up to 6 months. The trailer is used to reprocess surgical supplies in a sterile environment on site at the Nashville campus while the Sterile Processing Department undergoes renovations within the facility. In 2018, an additional award was made to Odulair, under 36C24918P4794 to continue the use of the sterile processing trailer. The construction project had encountered unexpected delays that required the continued used of the trailer. The current contract is now set to expire on September 21, 2019. Due to additional unforeseen circumstances with the construction project, the renovation is not complete within the facility. Additional time will be needed for the construction project, and the continued use of the trailer is needed for reprocessing of reusable medical equipment during the project's completion. The new anticipated completion date of the construction project is set for March of 2020. It is imperative that the current trailer stay in place through the completion of the construction renovation to prevent a disruption in patient care. The trailer is a highly specialized unit that allows facility staff to reprocess

VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP Attachment 2: Request for Sole Source Justification Format >SAT under solicitation VA249-17-Q-0262. Oduliar, a woman owned small business, was found to be the only vendor that could provide the best value to the government. Additionally, a search was conducted on VIP using NAICS 336120 and the key words "sterile processing", zero vendors were returned on the search. As a result of market research, there are no capable SDVOSBs/VOSBs to provide this requirement.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
The unique nature of this requirement does not allow for full and open competition. The additional time needed for decommission of the existing trailer and the solicitation, award, and installation of a new mobile unit would completely shut down the facility for all patient procedures requiring reusable medical equipment.
Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Odulair
109 East 17th Street
Suite 63
Cheyenne, WY 82001
10. A Statement of the Actions, if any. the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required:
This is a unique situation in which the contract for this trailer rental is dependent upon the timeline of a construction renovation project. The trailer is only required during the renovation and will no longer be required once construction and decommissioning are complete.
11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona
Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
