JUSTIFICATION AND APPROVAL
USTRANSCOM JUSTIFICATION FOR
OTHER THAN FULL AND OPEN COMPETITION
STEVEDORING & RELATED TERMINAL SERVICES (S&RTS), OMAN
W51P1J-13-D-0121
1. CONTRACTING ACTIVITY
United States Transportation Command (USTRANSCOM), Directorate of Acquisition, Specialized Transportation and Support Division, 508 Scott Drive, Building 1900W, Scott AFB
IL 62225-5357.
2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED
This action will result in the award of a six month extension of the Firm Fixed Price, Indefinite Delivery Indefinite Quantity (IDIQ) contract with the incumbent contractor, KGL International for Ports, Warehousing (KGL). Period of Performance at contract award was 01 December 2013 through 30 November 2016, including option periods. In accordance with FAR 52.217-8, Option to Extend Services, a six month extension was exercised with a performance period of 01 December 2016 through 31 May 2017. The Period of Performance for this extension is 01 June 2017 through 30 November 2017, consisting of a three month base period with three one-month option periods.
3. DESCRIPTION OF THE SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
This extension will provide the 595th Transportation Brigade (595th Trans BDE) services needed to maintain and sustain current and future operations while the source selection, RFP HTC711- 16-R-R005, for the follow-on contract continues to be evaluated. S&RTS includes vessel loading, vessel discharge, receipt of cargo, disposition of cargo, stuffing/unstuffing of cargo, intra-terminal transfer of cargo, inland transportation of cargo, customs clearance, yard management and management expertise. S&RTS are required to move and track Department of Defense (DoD) sponsored cargo through Oman in support of national and strategic military interests of the United States of America. The estimated value for this action is total.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 U.S.C. 2304(c)(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION REQUIRES USE
OF THE AUTHORITY CITED
Army Contracting Command Rock Island (ACC-RI) awarded the current contract 01 November 2013 with a base period and two one-year option periods. S&RTS contracts were transferred from ACC-RI to USTRANSCOM Acquisition (TCAQ), 1 November 2013. Since the transfer, market research has been accomplished with the posting of a Request for Information (RFI) HTC711-16-ZR12 on 03 August 2016 to obtain industry feedback on the procurement of S&RTS services in Oman. interested vendors responded.
A Request for Services Contract Approval (SCR) package containing the Performance Work Statement (PWS) was submitted to TCAQ by SDDC/G3 on 31 October 2016. Release of the solicitation for the follow-on acquisition, HTC711-17-R-R005, was released on 25 January 2017 and closed 02 March 2017. offers were received and evaluation continues. Technical evaluations began on 12 March 2017 following a delay in all technical evaluators certifying their source selection briefing. Technical evaluations are generally completed remotely in Bahrain, location of the 831st Transportation Battalion (requiring activity). Given the time differential of +9 hours local Scott AFB time and that CENTCOM’s work week is Sunday - Thursday, individual technical evaluations tend to last at least a week to account for reviewing the 25-page proposals, drafting the evaluations, reviewing the evaluation for consistency with the technical factors and finalizing the evaluation with all technical team member signatures. The technical evaluations related to this source selection have taken seven weeks thus far, primarily due to operations in the region requiring all of the technical team members to prioritize their Contracting Officer Representative and Ordering Officer responsibilities over technical evaluation. Additionally there was an extended illness of one of the members during the third evaluation that caused more than a week delay.
KGL is the sole qualified contractor capable of performing required S&RTS services in support of DoD cargo transiting through the Ports of Salalah, Duqm and Qaboos for the 595th Trans BDE/831st Transportation Battalion. Any other contractor assuming performance of this requirement would require at least thirty days to transition the necessary personnel and equipment. KGL is already in place and is the only contractor that is capable of ensuring continued operation with no break in service. Support for current and ongoing missions and exercises is a necessity and there must not be an interruption in service. An unacceptable delay or interruption of service jeopardizes support and secure deployment of military personnel and cargo during missions and any unforeseen emergency. The six month extension provides the required services and support to ensure mission success, positions the 595th Trans BDE for a safer, gradual transition into the new contract and mitigates the possibility of negative impact to the nation’s strategic combat effectiveness which the S&RTS at the Ports of Salalah, Duqm and Qaboos supports.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE
Competitive offers were not sought specifically for this proposed six month extension of services since the solicitation for the follow-on contract has been released and closed. TCAQ released the competitive follow-on RFP on 25 January 2017. offers were received.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED
COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
During solicitation of the current contract, offerors submitted proposals. KGL was evaluated as the lowest priced, technically acceptable offeror and awarded the contract. Price analysis determined that the evaluated price for the base period and two (2) option years was fair and reasonable based on comparison of competitive prices. The unit prices under the current contract will remain the same during this extension and therefore continue to be considered fair and reasonable based upon the initial price analysis. No other market conditions exist that alter the determination that the price is fair and reasonable.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS
On-going efforts are underway to complete the source selection for the follow-on acquisition.
TCAQ-R conducted the extensive market research for the follow-on requirement. Request for Information (RFI) HTC711-16-ZR12, was posted on Federal Business Opportunity (FBO) on 03 August 2016. TCAQ received responses. No additional market research efforts were conducted specifically for this six month extension.
