About this file
This document is an Amendment of Solicitation/Modification of Contract for Special Situation Investment Management Services (SSIMS) issued by the Pension Benefit Guaranty Corporation (PBGC), with solicitation number 16PBGC25R0061. The amendment, dated 11/18/2025 with an effective date of 11/26/2025, provides the government's responses to three industry questions related to the Phase 1 procurement.
The questions addressed include clarifications on submitting documentation such as Form ADV, SEC exemption proof, financial statements, and key personnel experience descriptions. Specifically, the government clarified that offerors may submit SEC exemption documentation via attachments or hyperlinks, audited financial statements are not releasable under FOIA, and key personnel experience can be initially presented as a broad statement listing when individuals began providing SSIM services. Offerors will be expected to provide more detailed personnel experience information if confirmed to proceed to Phase 2 of the procurement.

Question No. Page No. Section Question Government Response
1 82 A
The supporting documentation requests a link to an Offeror’s Form ADV, if applicable; for an SEC exemption, does PBGC also prefer a link to the proof of any SEC exemption, or would PBGC prefer that the proof of exemption be included as an attachment (or both)? Also, may the proof of the exemption itself contain hyperlinks to additional supporting materials, or should any such supporting materials be provided as attachments (or both)?
With respect to an SEC exemption, Offerors may provide an attachment, a hyperlink, or both. Offerors may also provide supporting materials via attachments and/or hyperlinks, however, in both cases, Offerors should ensure that hyperlinks are not broken if only hyperlinks are provided.
2 82 C
If an Offeror submits its most recently audited financial statements, is PBGC able to provide an assurance of confidentiality under FOIA? If not, does PBGC have a position on whether FOIA
Exemption 4 would apply, because the requested information is confidential commercial or financial information that should not be available for public disclosure? Would PBGC have concerns if an
Offeror submitted this requested information with a clearly marked designation of the Offeror’s belief that the information is exempt from FOIA disclosure under Exemption 4?
The audited financial statements are not releasable under FOIA. Offerors may submit this requested information with the marked designation that the information is exempt from FOIA disclosure.
3 83 D
If an Offeror intends to submit an affirmative statement citing the year the contracting firm’s key personnel, through experience garnered at previous firms, began providing SSIM services, is it
PBGC's intent that such Offeror would provide details as to the identities of each of that firm’s relevant personnel and their respective specific experience from previous firms, or simply to provide a broad statement that various team members began providing SSIM services in certain relevant years? This question is asked in the context of wanting to provide a sufficiently detailed response to this Phase 1 Factor 1 requirement without necessarily pre-answering Volume 2, 4.8.2., [Factor 3], b.2’s detailed staffing question (page 75), if PBGC is seeking materially less information at this
Volume 1 – Factor 1 stage.
Offerors may provide a broad statement listing the key personnel and when each individual begain providing
SSIM services to fulfill the Volume 1 requirement. Upon confirmation that an Offeror may proceed to Phase
2, Offerors would be expected to provide a more detailed response concerning key personnel experience.
