Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Products and Commercial Services,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued.
This solicitation is a request for proposals (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular.
The associated North American Industrial Classification System (NAICS) code for this procurement is 541110, with a small business size standard of $15.5M.
The PBGC Procurement Department is seeking to obtain assistance in the following areas:
• large and protracted bankruptcy or other court proceedings;
• bankruptcy and reorganization litigation, including issues of the allowance and priority of PBGC claims in bankruptcy;
• complex business transactions and financial transactional matters;
• security arrangements;
• Uniform Commercial Code matters;
• matters, including arbitration or litigation matters, related to Federal employment law including claims of harassment or discrimination;

• matters related to labor-management relations;
• matters related to ERISA, the American Rescue Plan Act of 2021, and defined benefit pension single-employer and multiemployer plans covered under title IV of ERISA
• matters related to Federal procurement or contracting;
• complex trial and appellate litigation;
• legal and factual research and analysis, including reviewing and analyzing relevant facts and documents;
• conducting and defending against e-discovery;
• engaging and preparing experts;
• conducting legal research and drafting memoranda, pleadings, briefs, and other legal documents;
• filing documents with courts and other administrative bodies;
• assisting with negotiations and settlements;
• providing advice on settlement implementation; and
• any other related or ancillary tasks in furtherance of the interest of PBGC, including subcontracting for services when appropriate.
All interested companies must provide a proposal for as stated in Sections C, L, and M.
The government will evaluate information based on the evaluation criteria stated in Section L and M.
Technical Factors and Past Performance, when combined, are more important when compared to price.

Offerors must complete annual representations and certifications online in the System for Award Management in accordance with FAR 52.212-3, “Offeror Representations and Certifications–Commercial Products and Commercial Services.” If paragraph (b)(2) of the provision is applicable, a written submission is required.

This is an open-market combined synopsis/solicitation for services as defined herein. The government intends to award an Indefinite Delivery/ Indefinite Quantity contract as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein. To facilitate the award process, all offers must include a statement regarding the terms and conditions herein as follows:
