Contractor Questions and PBGC Responses

Amendment 3
1. Question: We understand there may be a period of negotiation post contract award, will this extend to negotiation of key contractual terms e.g. liability and intellectual property ownership? (Relating to section 2, subsection 5, p5 and section 4, subsection 4.3, p10)
Response: If PBGC elects to hold negotiations, it will select the topics to be negotiated. Contractors should indicate any topics they seek to negotiate or better understand within their cover letter (e.g., as an assumption). Nevertheless, with respect to data rights, this topic will be governed by clause 52.227-14, which has been incorporated into this solicitation under Amendment No. 3.
2. Question: In order to provide the Deliverables, we expect historical mortality experience data will need to be provided to the successful bidder, what are the PBGC’s data protection and data privacy requirements? (Relating to section 2, subsection 3, p3-4)
Response: A complete answer to this question isn’t possible until the project begins, and the available data is examined within the framework of the desired approach by the contractor. Sharing of historical mortality experience data will necessarily be limited (some data may not be available to be shared) and/or controlled (data will shared with limitations on the timing and extent of access).
PBGC will continue to research this question, and, if more specific information is obtained prior to solicitation closing, will share such information via solicitation amendment.
