Justification for Other than Full and Open Competition
“Source Selection Information – see FAR 2.101 and 3.104”
1. Identification of the agency and contracting activity.
a. Federal agency and contracting activity. HHS. Indian Health Service

2. Nature and/or description of the action being approved.
a. Acquisition purpose and objectives. This bridge order is to purchase 3 months of services for the COTS WebEHRS system, for Division of Environmental Health Services (DEHS).
b. Project background. The current task order COTS WebEHRS service was awarded to Custom Data Processing (CDP), Inc. in FY2010. The total value of the task order is $875,231.25 with the performance period of 9/10/2010 thru 03/9/2016.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value).
a. Project title. Bridge Task Order to cover the period from 03/10/2016 to 06/9/2016.
b. Project description. The purpose of this contract is for the contractor to provide the COTS system for the IHS DEHS data service (WebEHRS). The Contractor shall perform data system management; provide enhancements, error resolution, and routine maintenance for the data system.
c. Provide the following information:

4. Identification of the statutory authority permitting other than full and open competition.
This acquisition is conducted under the authority of 41 United States Code (U.S.C.) 253(c)(1) as set forth in Federal Acquisition Regulation (FAR) 6.302-(a)(2).
This acquisition is conducted under the authority of section 4202 of the Clinger-Cohen Act of 1996.
This acquisition is conducted under the authority of the Services Acquisition Reform Act of 2003 (41 U.S.C. 428a).
5. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.
a. Name and address of the proposed contractor(s). Custom Data Processing, INC, 1408 Juliet RD, Romeoville, IL 60446
b. Nature of the acquisition and proposed unique qualifications of the contractor(s). IHS is finalizing a re-solicitation to the current contract with an anticipated award timeline of May 2016. The current award HHSI236201000002I with CDP, Inc. will expire on March 9, 2016. The incumbent contractor is the developer of the current modified-COTS used by DEHS. This acquisition will allow uninterrupted access and support of the DEHS Data System (WebEHRS) until a new contract is in place.
6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.
The current contract award for the requirement, HHSI236201000002I was solicited via a full and open competition environment. RFP for the requirement was publicized on www.fbo.gov and the award was made to incumbent on a best value basis.
7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.
A competition was promoted for the award of the incumbent contract. The best value award decision included a consideration of price reasonableness of the awardee’s proposal. The upcoming award will consider the current unit price of each specific tasks in the scope and a price negotiation session will be conducted prior to the award.
8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted. The upcoming requirement will be publicized then competed in near future.
9. Any other facts supporting the use of other than full and open competition. Due to delays outside of the control of either the vendor or government, the bridge contact is necessary to maintain continued support of the DEHS Data System (WebEHRS) which is used to collect, maintain, track, and evaluate environmental health factors that impact public health. The system is also a key component in the development of the DEHS annual budget. Loss of this system without an acceptable transition period to any other type of system would result in a loss of data, analysis capabilities, resource management, and staff time.
A SOW has been developed, but because of the current delays and required transition period to any other type of system, this bridge contract is necessary to avoid the issues listed above.
10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition.
There have been interests from the vendors for the requirement. The CO believes an adequate competition will be promoted for the upcoming award.
11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services.
The upcoming requirement will be competed in near future.
