*Overtime for the period is calculated by multiplying the labor price by 9%.
** Contract period of performance is contingent upon options being exercised.
*** Amount specified is determined through historical data.
B.7. CEILING PRICE
The hours and total price per labor category are for budgeting purposes only. The number of hours actually used for each category may exceed or be less than the estimate by category as long as the ceiling price for the contract period is not exceeded. The ceiling for each contract period is identified in each CLIN. The government shall not be obligated to pay any amount in excess of this ceiling price nor is the Contractor obligated to continue performance if to do so would exceed this ceiling price. In the event that the government chooses to exercise optional CLIN’s, unused funds from a previous contract period may not be used to fund any services taking place in a subsequent contract period. The ceiling price may be modified by the government if it is determined that the estimated hours are insufficient for the work required.
B.8. NUMBER OF HOURS INCURRED
Contractor shall include a time sheet with each invoice showing the number of hours worked.
This time sheet shall show the number of hours worked per person and by labor category during the time period invoiced.
B.9. LABOR CATEGORIES, UNIT PRICES PER HOUR, AND PAYMENT
The Contractor shall provide the types of labor in section B at the corresponding unit price per hour in accordance with the terms of this contract. The unit price per hour is inclusive of the unloaded rate plus any applicable Fringe Benefits, Health and Welfare, labor overhead, General and Administrative (G&A) expenses, profit, discounts, pay shift differentials, etc. Payment shall be made to the contractor upon delivery to, and acceptance by, the government office requesting services. The total amounts billed shall be derived by multiplying the actual number of hours supplied per category by the corresponding price per hour.
B.10. TEMPORARY PERFORMANCE SURGE
LEAD may experience surges in workload requirements. LEAD receives on a regular basis unscheduled, non-forecasted workload. Surges may hinge around new innovations, equipment enhancement, update, quality improvements and /or safety related modifications. Expectations are that as contingency operations continue and the need to replace or “reset” worn-out equipment could be required. This need is driving support for the Warfighter and operational contingency. This is an anticipated forecast planning fence in the short and long term horizon to be executed as needed. LEAD supports the Warfighter and Army mission essential programs in which cannot accurately identify at this time. All surge CLINs are optional CLINs that will be exercised when needed.
B.11. TRAVEL AND OTHER COSTS
All reimbursable expenditures will be approved by the COR prior to the occurrences. The Contractor will be reimbursed for all domestic travel as described below, incurred directly and specifically in the performance of this contract, claimed by the Contractor and accepted by the Contracting Officer.
Domestic travel expenses incurred by the Contractor in direct performance of the contract shall be reimbursed provided such travel is necessary for the performance of this contract and the cost does not exceed:
a. The lowest customary standard, coach, or equivalent airfare offered during normal business hours for air travel except when such accommodations: 1) require circuitous routing, 2) require travel during unreasonable hours, 3) excessively prolong travel, 4) result in increased costs that would offset transportation savings, 5) are not reasonably adequate for the physical or medical needs of the traveler, or 6) are not reasonably available to meet mission requirements. In order for costs in excess of customary standard or coach airfare to be considered allowable, the applicable exception must be documented and justified.
b. Costs of rail travel by most direct route, coach-class accommodations.
c. The prevailing mileage rate set forth in the Federal Travel Regulation (FTR) or reasonable actual expenses for travel by motor vehicle. Travel by motor vehicle, including rented automobile, shall be reimbursed on a reasonable actual expense basis, or at the Contractor's option, on a mileage basis at the prevailing FTR rate, plus any toll or ferry charges.
d. The prevailing rates set forth in the FTR for lodging, meals and incidental expenses.
e. Allowable training and medical expenses are listed within the PWS.

H.2 LEAD-CONTROLLED FACILITIES AND INFORMATION SYSTEMS
SECURITY
(a) To perform the work specified herein, Contractor personnel are expected to have routine (1) physical access to an LEAD-controlled facility; (2) logical access to an LEAD-controlled information system; (3) access to sensitive LEAD data or information, whether in an LEAD-controlled information system or in hard copy; or (4) any combination of circumstances (1) through (3).
(b) To gain routine physical access to an LEAD facility, logical access to an LEAD-controlled information system, and/or access to sensitive data or information, the Contractor and its employees shall comply with Homeland Security Presidential Directive (HSPD)-12, Policy for a Common Identification Standard for Federal Employees and Contractors; Office of Management and Budget memorandum (M-05-24); and Federal Information Processing Standards Publication (FIPS PUB) Number 201; and with the personal identity verification and investigation procedures contained in the following links. More restricted positions--i.e., those above non-sensitive, require more extensive documentation and investigation. The Contractor shall notify the Contracting Officer in advance when any new personnel, who are subject to a background check/investigation, will work under the contract and if they have previously been the subject of national agency checks or background investigations.
(e) Investigations are expensive and may delay performance, regardless of the outcome of the investigation. Delays associated with rejections and consequent re-investigations may not be excusable in accordance with the FAR clause, Excusable Delays--see FAR 52.249-14.
Accordingly, the Contractor shall ensure that any additional employees whose names it submits for work under this contract have a reasonable chance for approval.
(f) Typically, the Government investigates personnel at no cost to the Contractor. However, multiple investigations for the same position may, at the Contracting Officer's discretion, justify reduction(s) in the contract price of no more than the cost of the additional investigation(s).

Pursuant to FAR 7.5, the Contractor shall not perform any inherently governmental actions under this contract. No Contractor employee shall hold him or herself out to be a Government employee, agent, or representative. In all communications with third parties in connection with this contract, Contractor employees shall identify themselves as Contractor employees and specify the name of the company for which they work. In all communications with other Government Contractors in connection with this contract, the Contractor employee shall state that they have no authority to in any way change this contract and that if the other Contractor believes this communication to be a direction to change their contract, they shall notify the Contracting Officer for that contract and not carry out the direction until a clarification has been issued by the Contracting Officer.
The Contractor shall insure that all of its employees working on this contract are informed of the substance of this article. Nothing in this article shall limit the Government’s rights in any way under the other provisions of this contract, including those related to the Government’s right to inspect and accept the services to be performed under this contract. The substance of this article shall be included in all subcontracts at any tier.

Each contractor or employee of the contractor to whom information may be made available or disclosed shall be notified in writing by the contractor that such information may be disclosed only for a purpose and to the extent authorized herein.
The contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort. Nothing herein shall preclude the use of any data independently acquired by the contractor without such limitations or prohibit an agreement at no cost to the Government between the contractor and the data owner which provides for greater rights to the contractor.
The Contractor agrees not to release or disclose, verbally or in writing, information pertaining to the results or findings of work (including data collection, analyses, draft or final papers and reports) for the period of this contract without first notifying the COR in writing at least 21 days prior to the release or disclosure.
