J-4 The updated J-4 form does not include a NTC column. Should NTCs be listed under subcontractor? No. The NTCs should not be listed. The J-4 should be used with the format provided Per the RFP
J-4 Should NTC staff be assigned a position number on the J-4 and J-28? No. NTC staff should not assigned a position number on the J-4 and J-28?
J-4 The J-4 instructions indicate “Where offeror’s position titles differ, actual titles should be entered in the “Remarks” column.” J-4 instructions also indicate “Remarks. The center title, if different from the title shown in the left-hand column, and any comments you wish to make.” Please confirm Contractor’s Title column should be used instead to reference position titles different from those listed in column B. The Contractor shall use the title referrenced in that column as provided.
J-4 The Size of the J-28 becomes unreadable when the page size is 8 ½ x 11” with 1” margins. Does the government just want the Excel file and if desired, will the page size be expanded to legal/landscape to display the J-28. Please clarify. Potential Offerors shall use the attached J-28 Excel document as provided. The page size can be increased for readability.
J-4 J-4 instructions indicate “The Contracting Officer will compare information submitted in this attachment with information submitted in J.28 to ensure that the same positions are reported on both.” Should NTC staffing be reported on the J-28 even though specific compensation information is not available to the offeror? Only the information specified on the J-4 and J-28 should be provided
L.6 Instructions for Proposal Submission, D. Site Visit Will the government reconsider an in-person site visit for interested offerors? Not at this time. Please visit https://virtualtours.jcmarketplace.com/
SF33, Block 9 Will the government delay the submission of proposals until DOL has issued responses to SCA questions submitted by contractors? The government has extended the proposal due date to 10/12/2022 via amendment 2.
Department of Defense Guidance Memorandum (dated 5/25/22) EPA clauses In DOD’s guidance memorandum dated May 25th, 2022, the agency confirmed a willingness to include EPA clauses in new contracts to combat inflation risk in firm fixed price contracts stating “an EPA clause may be an appropriate tool to equitably balance the risk of inflation between the Government and contractor”. Will DOL consider including FAR 16.3203-2 and consider the following 4 factors:
1. considerations for selecting an index to measure inflation that is linked to cost components that are most unstable;
2. limitations on the scope of the EPA to exclude costs that are unlikely to be affected by inflation;
3. allowance for both upward and downward adjustments in price; and
4. establishing formulas for calculating the new pricing instead of merely reopening price negotiations. The government is not including FAR 52.216-4
Reg 29 CFR 4.173 Hire date for vacation accrual For vacation accrual purposes, contractors are required to recognize previous hire dates for work performed on the contract regardless of which contractor operated the center. In addition, the WD states 2 weeks paid vacation after 1 year of service with a contractor or successor. Is this regulation applicable to this implementation and should the hire/vacation accrual date be when the employee originally was hired on the contract (regardless of which contractor operated the center) or should the hire/vacation accrual date be when the employee was hired with the current contractor? If this does apply, for contractors who did not recognize time with the contract during the transition, how should this date be obtained? We want to obtain the proper date to avoid our employees missing out on a higher vacation amount, were applicable. For proposal purposes, with no historical data available, will the government provide a list of anniversary dates for use in proposing proper vacation hours or will the government permit an REA after award once these anniversary dates are made available should the costs be greater than proposed DOL will not modify new contracts to provide funding to absorb vacation balances. See FAR 52.222-41(n) regarding the successor contractor receiving data pertinent to incumbent personnel.

The SCA applies to all persons who actually perform the service work called for by a covered contract, “regardless of any contractual relationship that may be alleged to exist between a contractor or subcontractor and such person,” except those persons expressly exempted from the definition of “service employee.” If a person is engaged in performing any service work called for under a covered contract, such person must be paid the wage and FBs provided under the Act, irrespective of any alleged “independent contractor” or non-employment relationship.
Pg 65 J16 https://wdolhome.sam.gov Wage Determination – supervisory positions If a position maps to the wage determination but also supervises other staff, such as student workers, would the position be required by Wage & Hour to be paid more than the position it is mapped to on the wage determination? Please reffer to the most current wage determination.
RFP Page 36 H.6 SCA wages – senior positions Are senior positions and lead worker positions required by SCA to by paid more than the lower position? Wage determinations Wage determinations do not list all job titles typically utilized on a JC contract. Will DOL create non-standard wage determinations by locale or a nationwide industry specific wage determination? This question is not specific to this procurement. If a prospective offeror seeks a conformance, please refer to the process identified at: https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/Tab15.pdf.
SCA occupation Is the contractor required to determine the SCA occupation or will the government provide the information for cost purposes? No, it is the operator’s responsibility to determine the SCA occupation
COVID – 19 Due to COVID – 19 impact on a number of contract operations over the past two years, will the government consider a five-year period for past performance evaluation? The government will not consider a five year past performance period.
prime contract and extensions and a follow-on bridge contract Will the government consider a prime contract and extensions and a follow-on bridge contract to continue services as one contract evaluation or are they deemed separate for the purpose of evaluation? This solicitation is for a separate contract regardless of the awardee. If there were to be a bridge contract, that would be a separate contract than the current contract. Any extensions to the current contract are part of the same contract.

positions that should be subject to SCA Please clarify how Offerors should present positions that should be subject to SCA, need to be conformed, but not included on the Wage Determination? Since these will not have a matching labor grade on the Wage Determination, should they be noted on the J-28, Column E, as “CONFORM”? Also, please confirm that the wage to be proposed for such position should be at the Median of the salary provided through the Bureau of Labor Statistics. Column E asks for Wage Determination. Column J may be used. The wage that shall be proposed from Bureau of Labor Statistics will be determined by the offeror.
PAGE 14-15 PRH Appendix 507 (page 3), which is not excluded on the RFP indicates “Substitute positions are not included in the count of Authorized Staff.” Are substitute positions required to be reported on the J-27? Please advise. No. Substitute positions are not required to be reported on the J-27
PAGE 40 Clarify the reporting requirements of the Wage Comparability Tool/2110S (Attachment J-27) by the 10th of July, October, January, and April every calendar year or monthly as noted on the J-27. The Salary Tab of the J-27 shall be submitted quarterly and the vacancy report tab shall be submitted monthly.
PAGE 80 The size of the J-28 becomes unreadable when the page size is 8 ½ x 11” with 1” margins. Does the government just want the Excel file and if desired, will the page size be expanded to legal/landscape to display the J-28. Please clarify. The J-28 shall be submitted as an excel file.
PAGE 81 Does the government desire the J-1 and J-28 to be paperclipped to the PDF file as part of the Business Management Proposal or submitted as separate files. Please clarify. Both can be paper clipped. The government requires the J-1 and J-28 be submitted with the proposal individually
Pg 9 Section C The government states, “The contractor’s entire proposal may be incorporated into the contract. As a result, the offeror’s proposed technical and staffing approaches, including specific staffing resources, processes, and tasks, which are described in the proposal and which go beyond minimum requirements stated in the SOW and PRH, shall become requirements. Does the incorporation include the Business Management Proposal (BMP)? Please clarify. Yes the incorporation may include the Business Management Proposal.
Pg 24 G.3. C.1 The RFP indicated the contractors’ invoices shall be submitted through the Department of Treasury’s Invoice Process Platform (IPP). Currently, invoices are submitted to the COR and designated responsible Regional staff via via email for processing. Will the current process continue as is or is this submission to IPP now required? The submission to IPP is now required per G.3 INVOICE REQUIREMENTS of the RFP
Pg 37 H.6 Please clarify if operators are required to pay student workers on center SCA rates and H&W benefits? The SCA applies to all persons who actually perform the service work called for by a covered contract, “regardless of any contractual relationship that may be alleged to exist between a contractor or subcontractor and such person,” except those persons expressly exempted from the definition of “service employee.” If a person is engaged in performing any service work called for under a covered contract, such person must be paid the wage and FBs provided under the Act, irrespective of any alleged “independent contractor” or non-employment relationship.
| Pg 37, 65 H.6 and J-16 | |
| Which wage determination should be used for satellite locations such as OA/CTS offices or remote workers? Please clarify and provide those wage determinations as appropriate. | The government does not know where contractors will choose to locate OA/CTS offices. Please refer to 52.222-49 for information concerning the process of incorporating WDs when the location is not known by the government. |
| Pg 37, 65 H.6 and J-16 | |
| How should operators categorize positions that perform work in more than one position on the wage determination? | If an employee during a workweek works in different capacities in the performance of the contract, the employee must be paid the highest of the wage rates for all hours worked in the workweek unless the employer segregates the hours worked in each capacity and pays accordingly. However, working in different capacities applies only to work in different job classifications, not levels within the same job classification. |
| Pg 37, 65 H.6 and J-16 | |
| Some positions, like Residential Advisor, are not included in the wage determination (WD). How should operators conform positions that are not in the WD to ensure consistent and equitable pricing? | If an offeror determines that a position is not included in the WD but is not an exempt position, then the offeror may request a conformance. |
| Pg 37, 65 H.6 and J-16 | |
| Are operators allowed to use the lowest level position in job families (e.g., those having levels I, II and III) such as Secretary, General Clerk, and Accounting Clerk? | Offeror shall use their best business judgement and shall select the level that most closely aligns with the work to be performed in the position. |
Pg 65 J-12 Will the government please provide costs for utilities (sewage, water, electricity, and gas) pre COVID-19 Pandemic? This is provided in the RFP clip J-12
Pg 65 J-28 For positions that are split between multiple departments does the government expect the Estimated Proposed Salary (Annual Salary) to be calculated based on the FTE or as if the position is a full 1.0 FTE. Example a 1.0 FTE position is split between Academics and CTT with an annual salary of $50,000. Would contractors enter a 0.5 FTE on Academics and CTT respectively with an annual salary on each line $50,000 or $25,000 (0.5 of the $50,000 annual salary) The offeror should reflect a position where the work will be performed in more than one position on the applicable wage determination. For example, if there is a secretary that will also perform as a file clerk in a 50/50 capacity, the offeror would reflect secretary .5 and clerk .5 to show that the FTE is performing in both positions of the wage determination.
M.2 Basis for Award / Selection Criteria page 93 Will Technical Approach (Factor 1), Past Performance (Factor 2), and Staff Resources (Factor 3) be adjectively rated (e.g., Marginal, Acceptable/Satisfactory, Very Good) and, if so, what is the criteria for each of the ratings? Yes there will be adjectival ratings which definitions are defined in our internal acquisition process.
C.2H Page 14 Failure to Meet Staffing Levels. If the staffing levels upon contract award are well above 4% will there be additional time provided to recruit quality candidates to fill those positions? Can the government share the current staffing vacancy rate? Will the operator be required to submit the Vacancy and Staffing Tool per JCAS? Does the center currently have significant staffing vacancies? Is there a timeframe for new awardees to fill vacant positions? No, the government will not consider any grace period or run-up time on the vacancy of 4%. The contract already allows for a 30 day phase-in (transition). 2)The government will not share center's current vacancy rate with potential Offerors. 3) The successful Offeror will be required to submit the Vacancy and Staffing Tool; and 4) The current vacancies of the incumbent contractor will not be shared w/ potential Offerors.

| Center Operations | Will the successor contractor be entitled to this information in the list of incumbent service employees required to be provided by the CO/incumbent contractor at the time of transition (along with names, date of hire and position)? | ||
| Will DOL modify new contracts that are awarded to the non-incumbent with funding to absorb the unknown vacation balances to be assumed and paid out under the new contract? | No to both questions. |
Currently, when a contract is awarded to a non-incumbent, the incumbent contractor pays the employee vacation time earned but unused as part of the final paycheck received. Title 29, Part 4 of the Code of Federal Regulations, Section 4.173 indicates that the vacation time continues, as long as there is no break in service. The contractor by whom a worker is employed at the time the vacation right vests (i.e. on the employee's anniversary date of employment) must provide the full benefit required by the wage determination which is applicable on that date, whether or not it is the predecessor or the successor contractor.
