The contractor shall complete and submit the vacancy information section in the attached Wage Comparability tool on 10th day of every month.
Section H.8, Wage Comparability is deleted in its entirety and is replaced with the following:
The contractor agrees: (1) to pay at least the applicable Federal minimum wage (refer to Section 6(a) (1) of the Fair Labor Standards Act of 1938, as amended).
The Contractor understands and agrees that maintaining a stable and qualified workforce is critical to achieving success in performance of this Contract. A high vacancy rate and high turnover in staff can endanger the performance of the contract and may constitute a breach of material provisions of this contract. Accordingly, the contractor understands and agrees to carefully consider the wages and other benefits offered to staff and candidates for employment and ensure those wages and benefits are adequate to attract and maintain a qualified and stable workforce. It is the contractor’s responsibility to be familiar with the local area labor market and the wages and benefits that prevail in that market when recruiting for occupations that are critical to the performance and operation of the contract. In the event of high vacancy rates, high turnover of staff or other performance failures which constitute a material breach of this contract, such payroll records information and documentation of local area wages and benefits may be used by the government to identify the causes for those performance failures and to assess the viability and effectiveness of the contractor’s actions and proposed actions to correct those performance failures.
The contractor shall complete and submit the salaries information section in the attached Wage Comparability tool by the 10th of July, October, January and April every calendar year. In addition, the government may request at any time payroll records from the contractor in order to verify wages and benefits being reported in the Wage Comparability tool, along with documentation to substantiate that the wages and benefits are comparable to those paid in the local area market for like occupations.

Denison Q&A
Soliciation Section (when cited by contractor) Question(s) Answer(s)
B.1 The government notes that the offeror’s proposed technical and staffing approaches will be incorporated into the contract and shall become requirements.
Does the incorporation include the BMP?
The contractor's entire proposal may be incorporated into the contract. Any terms or conditions included in the BMP or elsewhere that contradict terms/conditions in the contract, or are counter to the interets of the Government would not be incorporated.
C.1.B As you are aware Change Notice No. 20-05, “Policy and Requirements Handbook (PRH) Changes to Health and Wellness Staffing (Exhibits 5-3 and 5-6)” was issued on April 16, 2021. The notice states the effective date of the PRH change of the notice as of June 15, 2021. With respect to the Paul Simon Chicago JCC RFP does the government expect contractors to include the change notice in the procurement? The PRH dated June 15, 2021 is incorporated into the RFP in Amendment 0001.
C.1.B The contractor is requested to provide basic health care, counseling, and other support services as required by the ePRH.
Are all these same services expected given the current Covid-19 pandemic & remote learning environment?
Or are these services going to be tweaked given the remote learning status of JCC students?
If there are changes, will the government provide further details of what those expectations will be?
Yes, the Government expects all basic health care, counseling, and other support services to continue as required by the PRH. If there are changes the Government will post a program information notice or PIN.
C.2.D Please verify the CTT trades and slots allocations shown on page 17 of the RFP. CTT trades and slots listed are accurate.
C.2.D PRH Change Notice 20-05 went into effective June 15, 2021. Please confirm that the new PRH staffing requirements should be incorporated into this RFP response. The PRH dated June 15, 2021 is incorporated into the RFP in Amendment 0001.
C.2.D The Security and Protective Services trade is not listed on the May 2021 CTT-10 report. Please confirm that the Security and Protective Services trade will be a new trade for the Paul Simon Center. The Security and Protective Services Career Technical Training program is a new offering at the center.
F.5 The Annual Arrival goal for the center is set at 760, but the center’s OBS is only 338. This represents what would normally be considered an unacceptable WTR is this accurate or will the goal remain at 760? The Government has set the annual arrival goal at 760 for the Paul Simon center.
F.5 Will DOL provide an updated annual arrival chart outlining breakdown by center as part of section F.5 Deliverables. Currently only the center totals are listed. The current soliciation provides annual goals on page 24 of 96. This data will not be further disaggregated by center.
F.5 Please clarify the RFP arrival goals given the annual historical Home State Analysis and the Enroll by County data prior to March 2020. The annual arrival goal of 350 for Earle C. Clements, appears to be high based on the population enrollment from Illinois of 3.53% and only 0.73% from recruiting zone ILRZ02, prior to March 2020. The Government has set the annual arrival goal for Earle C. Clements at 350. Offerors should propose a plan to meet this goal.
H.8 Section H.8 Wage Comparability includes the contractor’s responsibility to be familiar with the local are labor market. However, in the prior procurement and current contract the government determined the local labor market wages and set the minimum annual wages for the following positions: academic supervisor ($88,788.00), academic teacher ($73,990.00), career technical education teacher ($70,240.00), counseling supervisor ($67,056.00), senior counselor ($61,468.00), counselor ($55,880.00), senior security officer ($46,351.00), security officer ($41,1192.00), residential counselor ($55,8880.00) and senior residential counselor ($61,468.00). Is the government still considering these wages as the minimum local area labor market wages for these positions? If not, will the government accept a pay reduction for a majority of these positions? It is the Contractor's responsilbity to be familiar with the local area labor market, therefore the Government no longer lists minimum wages as was done in previous solicitations. As for the acceptance of any "pay reductions", the Offeror must ensure that the wages proposed are in accordance with the guidance provided in Section H.8.
H.18 Closeout process is to start at 90 days but government is only giving 10 days notice of its intent for each option period? Per FAR clauses 52.217-8 and -9 the government is only giving 10 days notice of its intent. Does the government intend to require closeout each period 90 days in advance not knowing if options will be exercised or will these clauses be realigned with same dates? For the purposes of the closeout process only, the Contractor should plan on closeout beginning 90 days prior to the end of Option Year 3.
H.25 Section H.25 Adherence to Lease Agreements, If Applicable. The Contractor must adhere to any lease agreements between the Government and the Lessor. Request the Contracting Officer identify any lease agreements if applicable. There is no leasing agreement for the Paul Simon JCC.
Section I Duplicate clauses listed in by reference and then stated again in full-text e.g. 52.222-35, 52.222-36. Request KO to remove duplicate clauses. The duplicate listing of the clause has no effect on the enforcement or applicability of the clause. This will be corrected at contract award and in future RFPs.
FAR 52.217-9 Request these clauses be changed to provide contract at least 30 day notice of intent. 10 days is too restrictive and has an effect on worker retention. The 10-day notice period will remain in effect for this requirement.
FAR 52.219-9 Request the Contracting Officer delete this Clause since this is being solicited as a total small business set-aside. Small businesses do not require to prepare a small business plan. While Section L states this plan is not required from small businesses, Section L is removed from the resultant award document while Section I remains in effect. This clause has been removed in Amendment 0001.
FAR 52.222-55 Since the minimum wage Executive Order goes into effect in January 2022, should we propose wages at not less than $15.00 per hour? The Offeror shall propose wages that will be in compliance with applicable minimum wage rates effective April 1, 2022, Section H.8, and with the Wage Determinations listed in the solicitation.
J-1 Should the NTE amounts reflected on the CLIN sheets pages 9-11 be included on the J-1 Award form. Yes, include the NTE amounts in the J-1. This, however, will not effect the evaluation of the Offeror's Total Evaluated Price.
J-9 Please verify which wings are open in the dormitories as there appears to be a discrepancy in the Facility Planning Report Volume 2 dated April 2019. The existing site plan indicates that part of Building 5, South Dormitory is vacant, however the report on page 115 indicates that wings in Building 4, North Dormitory are vacant. Any vacancies that were listed in the report or that are currently listed are due to OBS and not any other facility issues
J-9 The Facilities Survey reflects the presence of a child development center while the RFP indicates that an On- Center Child Development program is not required. Will these facilities be available for other uses or was this an error in the RFP? The Child Development center was officially closed August 30, 2019 and is scheduled to be demolished.
J-9 The executive Summary notes there are several buildings in poor condition and the preventive maintenance needs improvement. Can the contractor assume that these are to be fixed through CRA funding, Equipment, and/or CTST funding rather than through Operational funding? If some of the above issues are to be fixed through Operational dollars, can the Govt. identify which items those will be and provide further insight for contractors? Yes. The resulting contract includes cost-reimbursable contract line items (CLINs) for CRA.Per the PRH, center operators must implement a center maintenance program to maintain all buildings, grounds, roads, and sidewalks. Simple maintenance such as snow removal or lawn maintenance would be funded from operations funding.
J-9 The facility survey states the center is fenced, also noted that there is deteriorating earth and fencing issues. Have these arears been corrected to stop the gaps where people can enter/exit the Center? The fencing and gaps have been corrected.
J-9 Fire Protection – Have the leaks in the sprinkler loop systems been corrected so the main fire pump is on and effective? Yes, the leaks have been corrected and the main pump is on.
J-9 There is a child care center included on the facility survey, but the RFP states there is no On-Center Child Care Program. Is the Child Care Program active on the Center? Should it be included in the RFP? The Child Development center was officially closed August 30, 2019 and is scheduled to be demolished.
J-10 The EPMS run shows in excess of $100,000 of property on SF 120s, has this or will this property be disposed of prior to transition? The excess property will be disposed of prior to transition.
J-10 There are no washer and dryers or a dishwasher listed in the EPMS run – are they leased? The washers and dryers are leased. The dishwasher is permanently affixed to the building and is not leased.
J-16 The Wage Determination No. 2015-5017 Rev 13 is dated July 16, 2019 and has been superseded by Wage Determination 2015-5017 Rev 17 dated May 12, 2021 on sam.gov. Please clarify which wage determination applies to this solicitation. The Wage Determinations have been updated in Amendment 0001.
J-18 Will the Government provide the correct website for the State of Georgia Workforce Development goals? The link for the State of Illinois Workforce Development goals has been updated in Amendment 0001.
L.6.H Please validate if the limitation of the page count (6) of the staff resources proposal excludes Subfactor 3B – Staff Schedules, in which offerors are tasked with describing the our approach in compliance with the PRH, and does the page limit only include Subfactor 3A and 3C. As explained on Page 83 of the soliciation: "Please note that the page limitation for the staff resources section excludes the organizational chart, schedules and the submission of attachment J.4."
L.7 Job Corps Program Instruction Notice No. 20-17 adjusted the student weekly distance learning participation requirements. Will the operators need to address JCIN 20-17 in the Technical Approach section? The following Program Instruction Notices (PINs) are related to the COVID-19 pandemic and will not be considered in the evaluation of proposals: 19-14, 19-15, 19-16, 19-17, 19-18, 19-19, 20-01, 20-02, 20-03, 20-04, 20-05, 20-06, 20-07, 20-08, 20-11, 20-12, 20-17, 20-18, 20-19, 20-20, and 20-21.
L.7 Job Corps Program Instruction Notice No. 20-20 set the procedures for virtually enrolling eligible applicants. Will the operators need to address JCIN 20-20 in the Technical Approach section? The following Program Instruction Notices (PINs) are related to the COVID-19 pandemic and will not be considered in the evaluation of proposals: 19-14, 19-15, 19-16, 19-17, 19-18, 19-19, 20-01, 20-02, 20-03, 20-04, 20-05, 20-06, 20-07, 20-08, 20-11, 20-12, 20-17, 20-18, 20-19, 20-20, and 20-21.
M.1.Factor 4 Incumbent contractor cannot propose Phase-In pricing per L.7. Factor 4.c., CLIN 0001 is not listed as being evaluated. Is CLIN 0001 being evaluated? CLIN 0001 will not be considered as part of the Offeror's Total Evaluated Price. However, the price proposed for CLIN 0001 must not exceed $100,000.00. Offerors that include prices for CLIN 0001 in excess of $100,000.00 will not be considered for award. The incumbent Contractor shall propose a price of $0.00 for CLIN 0001.
Does the center have any CRA or CTST projects “in progress” and will they be completed prior to the transition period? Or what is the projected completion date? Currently, the center has three projects and they will be completed prior to transition.
What are the current national projects of the center? Will these be completed prior to transition, or do you have an estimated completion date? There are currently no national projects on center.
