The chart shows 211 CTT slots which would equate to 79 percent. Would DOL consider increasing the ACT slots to align with the PRH? Yes, the Government would consider this request.

Contracts

RFP No. 1605JE-23-R-00006 Glenmont Job Corps Center

RFP Section Question(s) Answer(s)

The 2023 New York state minimum exempt salary threshold is $55,341. Please confirm offerors are required to bid the New York 2023 exempt status salary threshold minimum for all exempt employees. Contractors are required to comply with state minimum salary laws.

There is uncertainty about future costs to FFP contracts, especially in the current environment where inflation or CPI is 8.5%. Contractors try to include risk premiums in their bids to ensure viability through these unprecedented circumstances, causing overall higher bid prices. In accordance with FAR 16.203-1, will the government consider adding an Economic Price Adjustment (EPA) or Price Adjustment Clause to the contract? By minimizing long term unknown inflationary risks factors from the contractor, the need for inflationary risk contingency costs is eliminated, resulting in a more realistic and competitive overall bid price. The Government is not including 52.216-4 at this time. However, the Government has mandated a minimum 3% escalation rate and contractors should use their own business judgement in determining proper escalation beyond 3%.

Will DOL please confirm that SCA wages and H&W rate should increase by a minimum of 3% every year of the proposal? Yes, all staff salaries, to include SCA wages and H&W shall include a minimum 3% escalation each year of the proposal.

In our experience, some states do not fully recognize the sales tax exemption that should be available to DOL contractors. Should bidders include sales taxes in their pricing or will DOL allow an REA in the event the State of New York requires the winning bidder to pay sales tax on purchases made in the course of contract performance? DOL will not entertain a REA related to sales tax on purchases made during the performance of the contract.

From reading, Reg. 29 CFR 4.173., for vacation accrual purposes, contractors are required to recognize previous hire dates for work performed on the contract regardless of which contractor operated the center. In addition, the WD states 2 weeks paid vacation after 1 year of service with a contractor or successor. Is this regulation applicable to this implementation and should the hire/vacation accrual date be when the employee originally was hired on the contract (regardless of which contractor operated the center) or should the hire/vacation accrual date be when the employee was hired with the current contractor? Vacation pay is determined based on the total length of time an employee has been in the employer’s service (commercial work and federal contract)AND the total length of time the employee has been employed in any capacity in the continuous service of any predecessor contractor who carried out similar contract functions at the same facility. The sum of these two conditions = total service time which is what should be used to determine the number of paid vacation weeks an employee is entitled to. 29 CFR 4.173(a)

The J-11 Inventory has grown by nearly 100% since the contract inception. Please advise if the inventory will be turned over to the successful offer from a Cost-Plus Contract to the FFP or whether the successful offeror would be required to negotiate for the purchase. During any transition period, inventory transfer will be executed from the incumbent to the new operator. Contractor will not have to negotiate for the purchase.

The RFP indicates offerors should send proposals to JC-Procurement-Philly@dol.gov. Please clarify this email is correct since this center is in the Boston Region. Yes, the offerors should send proposals to JC-Procurement-Philly@dol.gov as stated in the RFP.

To be consistent with Attachment J-4 staffing chart can unused positions be deleted from Attachment J-28? Yes, unused positions can be deleted in attachment J-28.

On page 36 of the 2018’s RFP for Glenmont (solicitation #1630J2-18-R-00005), a table of the Prevailing Wage/Minimum Required to be offered was included. The positions and minimum annual wage amounts required to be proposed were blank but, on one of the amendments to this RFP, reference was made to be in compliance with this clause, and stated the following:

Page 36, H.6.C Please confirm that the prevailing wage table in H.6.c is intentionally left blank.

a. Is the government’s expectation that the offeror proposes wages for these positions that equals or exceed the undefined 2018’s minimum prevailing wage referenced in this solicitation? 4. If it is not the government’s expectation that the offer for this solicitation include pricing for these positions that equals or exceeds 2018’s undefined minimum wage on page 36 of solicitation # 1630J2-18-R-00005, then this will likely result in staff turnover for these positions since the Prevailing Wage/Minimum Required wages in 2018 may exceed the current prevailing wage for some of these positions in 2023. Given this reality, will the successful offeror have a 90-day period to achieve the 4% vacancy rate? The successful offeror will not have a 90-day period to achieve the 4% vacancy rate. For the new Glenmont JCC w/ OA CTS solicited and in accordance with the statement of work Section C.2 I., "Beginning the first month of center operations, if the contractor’s vacancy rate exceeds 4% (as reported in the monthly Wage Comparability Tool submitted during the following month), the contractor shall reduce its invoiced price by an amount equal to the sum of the monthly salary(ies) for all vacant positions over the permitted 4%."

During 2017-2018 Job Corps’ procurement cycle, required minimum wages for certain positions were referenced within the respective RFP. Subsequent to this, Job Corps rescinded its policy and requirement to employ "Residential Counselors" and allowed operators to propose prevailing wages for Residential Advisors. This policy revision can be found on ePRH Change Notice # 18-06 dated 12/17/18. If it is not the government’s expectation that the offer for this solicitation includes pricing for these positions that equals or exceeds 2018’s required (but undefined) minimum wage referenced on page 36 of solicitation # 1630J2-18-R-00005, then this will likely result in staff turnover for these positions since the undefined Minimum Required wages within 2018’s RFP may exceed the current prevailing wage for some of these positions in 2023. Given this reality, will the successful offeror have a 90-day period to achieve the 4% vacancy rate for the positions specifically impacted by this Job Corps policy that was subsequently rescinded? The successful offeror will not have a 90-day period to achieve the 4% vacancy rate. For the new Glenmont JCC w/ OA CTS solicited and in accordance with the statement of work Section C.2 I., "Beginning the first month of center operations, if the contractor’s vacancy rate exceeds 4% (as reported in the monthly Wage Comparability Tool submitted during the following month), the contractor shall reduce its invoiced price by an amount equal to the sum of the monthly salary(ies) for all vacant positions over the permitted 4%."

If it is the government’s expectation that the offer for this solicitation include pricing for these positions that equals or exceeds 2018’s undefined required minimum wage, then will the government share the wages currently being offered for these positions to level the playing field and avoid staff turnover for these positions? Contractors are required to comply with state minimum salary laws, and the required minimum wage for federal contractors.
