RFP Section Question(s) Answer(s)

H.5

H.5: Please confirm that travel mentioned may be associated with the Special Projects/Initiatives CLINs XXX8. Currently the only XXX9 CLIN is Phase-Out.

No, there is no Travel CLIN for Fixed-Price contracts as any anticipated travel should be included in your fixed price proposal.

Utilization of the XX08 CLINs would only be associated with Special Projects and Initiatves, as directed by the Government.

J-1

J-1: Evaluated Price Tab: CLIN 1003 states a quantity of 1. Please confirm that the quantity should be 12.

An updated J-1 is provided with Amendment 0003.

J-1 J-1: Evaluated Price Tab: Cell G37 (Total amount for CLIN 3003) does not contain a formula. Are offerors permitted to update the cell to the necessary formula?

An updated J-1 is provided with Amendment 0003.

J-1

J-1: Contract Award Tab: The NTE CLINs do not contain the amounts that are listed in the B.2 Pricing Schedule. Are offerors permitted to update those lines, or are they to remain blank?

An updated J-1 is provided with Amendment 0003.

J-1 J-1: Contract Award Tab: Cell G12 (Total amount for CLIN 0001) does not contain a formula. Are offerors permitted to update the cell to the necessary formula?

An updated J-1 is provided with Amendment 0003.

J-28 J-28: Are offerors permitted to remove unused position rows, like that is stated in the J-4 Staffing Chart instructions?

No.

For SCA covered positions should the offeror keep the option period amounts the same as the first year amount or what amount of increase should be proposed to cover future Wage Determinations?

Please see Amendment 0003 and the updated 3% minimum escalation in Section L.7, Factor 4.

H.5 Page 42 Please confirm if that the CLIN reference in this paragraph should be to CLIN xx08?

Yes, Amendment 0003 updates H.5 to CLIN

XX08.

G.9

The Executive Order and SCA requirement has significantly increased wages. The OBS payback calculation assumes 15% of the contract value is a group of select non-personnel lines. There has been no consideration for increases in personnel expenses and the dilution of non-personnel expenses. Will the Government consider a CLIN structure that breaks out personnel, non-personnel and non-personnel expenses subject to the 15% OBS price adjustment?

The solicitation is not being changed at this time. However, offerors shall submit a proposal that assumes that up to 15% of the price will be subject to the OBS reduction. And, that contractors with a vacancy rate greater than 4% shall be subject to the vacancy takeback.

J-15 page 71

Please clarify the DBA WDs are the correct ones for this solicitation. On Sam.gov there are more recent WDs issued in 2023 for the respective DBA WDs.

An updated wage determination will be attached to Amendment 0003.

J-16 Page 72

Will DOL please provide Wage Determination for all counties in the NEAP zone?

There is no NEAP Zone for Earle C. Clements.

The center does not have an Outreach and Admissions component.

Will DOL please confirm that SCA wages and H&W rate should increase by a minimum of 3% every year of the proposal?

Please see Amendment 0003 and the updated 3% minimum escalation in Section L.7, Factor 4.

There is uncertainty about future costs to FFP contracts, especially in the current environment where inflation or CPI is 8.5%. Contractors try to include risk premiums in their bids to ensure viability through these unprecedented circumstances, causing overall higher bid prices. In accordance with FAR 16.203-1, will the government consider adding an Economic Price Adjustment (EPA) or Price Adjustment Clause to the contract? By minimizing long term unknown inflationary risks factors from the contractor, the need for inflationary risk contingency costs is eliminated, resulting in a more realistic and competitive overall bid price.

Please see Amendment 0003 and the updated 3% minimum escalation in Section L.7, Factor

4. The Government cannot modify the fixed price solicitation and an Economic Price Adjustment Clause would be applicable to this requirement.

H.6 Page 43

From reading, Reg. 29 CFR 4.173., for vacation accrual purposes, contractors are required to recognize previous hire dates for work performed on the contract regardless of which contractor operated the center. In addition, the WD states 2 weeks paid vacation after 1 year of service with a contractor or successor. Is this regulation applicable to this implementation and should the hire/vacation accrual date be when the employee originally was hired on the contract (regardless of which contractor operated the center) or should the hire/vacation accrual date be when the employee was hired with the current contractor?

As a general rule, a service employee’s eligibility for vacation benefits is based on the total length of time the employee has been in the employer’s service (commercial work and federal contract) and, where applicable, the total length of time the employee has been employed in any capacity in the continuous service of any predecessor contractor who carried out similar contract functions at the same facility. Please see 29 CFR 4.173.

Will the Government provide a required wage escalation rate for the outyears for all proposals submitted?

Please see Amendment 0003 and the updated 3% minimum escalation in Section L.7 Factor 4.

There have been significant, unprecedented shifts in inflation over the past two years. To equitably balance the risk of inflation between the Government and contractor, and in accordance with FAR 16.203-3 and 4, will the government consider including FAR 52.216-4, Economic Price Adjustment- Labor and Material Clause in the clauses incorporated by reference?

No, 52.216-4 will not apply to this requirement.

Currently, when a contract is awarded to a non- incumbent, the incumbent contractor pays the employee vacation time earned but unused as part of the final paycheck received. Title 29, Part 4 of the Code of Federal Regulations, Section

4.173 indicates that the vacation time continues if there is no break in service. The contractor by whom a worker is employed at the time the vacation right vests (i.e., on the employee's anniversary date of employment) must provide the full benefit required by the wage determination which is applicable on that date, whether or not it is the predecessor or the successor contractor.

Yes, that is correct. The vacation rights vest.

C.2.I

Failure to maintain staffing levels states damages will begin on the first month ofoperations. Will the Government consider revising this language to state “Beginning the fourth month of operations” which is similar to other FFP contracts awarded?

No, the contract must be fully staffed when operations begin.

Will the successor contractor be entitled to this information in the list of incumbent service employees required to be provided by the CO/incumbent contractor at the time of transition (along with names, date of hire and position)?

Yes, this will be handled during the phase-in/phase-out period.

G.9: The Executive Order and SCA requirement has significantly increased wages.

No.

If contractors are not responsible for conducting outreach and admissions activities, would the government consider revising the instructions for Factor 1, Outreach and Admissions section of the technical approach to reflect this?

Yes, Factor 1 will be updated in Amendment 0003.

Can the government confirm that this contract does not include Outreach and Admissions.

Yes. Earle C. Clements does not have an Outreach and

J-28

The J-28 provided appears to be an older version. Will a newer version of J-28 be provided that includes SCA positions for column E?

Yes, an updated J-28 has been provided with Amendment 0003.

To assure receipt of email submissions, please confirm any file size limitations. If file size limitations exist, please confirm respondents may submit multiple emails with the required components. (e.g. 1 of 3, 2 of 3, 3 of 3). If file size limitations exist, please confirm a Factor may be separated into multiple PDFs to bring down the size of the file. If file size limitations exist, please advise if a Zip file is permissible.

There are no file size limitations that the Government is aware of at this time. Yes, you may submit via ZIP file.

J-8

Please clarify if the J-8 (Standard Form 1413) is required to be included in the BMP submission or submitted within 14 days of contract award.

That is correct. Those are the instriction given for the SF1413 in 52.222-11.

If Outreach and Admissions is not part of the scope, how does this affect the narrative response in the technical? Specifically, Solicitation page 100, Factor 1, Question 5:

“Outreach and Admissions (OA): the effectiveness of the offeror’s strategies and relationships that the entity has or will develop in promoting a positive image of the program as well as the likelihood that the strategies and relationships will lead to enrollment of a sufficient number of enrollees for the Job Corps center to operate at full design capacity.”

Factor 1 has been updated in Amendment 0003.

The Solicitation shows arrivals coming from other centers, and on page 25, under the list of other center arrivals, it states “The Contractor is required to deliver enrollees at a higher number than specified here if that is necessary to attain and/or maintain full capacity (100% OBS) at the Center they are operating.” Please clarify the Contractor’s enrollment responsibilities. If there will be arrival goals, please identify these by month.

If there will be arrival goals, please identify the assigned NEAP zone.

There are no arrival goals for Earle C.

Clements. The center does not have an Outreach and Admissions component.

If a company is not encumbered by the need for a line of credit to cover one month’s costs (reference Solicitation page 94 a. 5), will a statement regarding our ability to cover the requirement suffice?

Please follow the instructions in the Solicitation Section L.7 Factor 4.

Since the contractor will not provide any enrollments to the Earl C. Clements Job Corps Center, please provide the actual Neap Zone Areas for each of the below centers (reference Solicitation page 25, F.5 Deliverables) specific to providing admissions to the Earl C. Clements Job Corps Center.

There is no NEAP Zone for Earle C. Clements.

The center does not have an Outreach and

Advanced Heavy Truck Driving is a center- operated trade. It is considered Advanced Training.

J-22: The 10 semi-trucks and 3 electric cars listed as center owned property state they have federal license tags assigned to each. Is the operator responsible for insuring these vehicles or is the insurance paid by the federal government similar to a GSA vehicle?

No, these are non-GSA vehicles. They should be insured by the operator and are maintained by the operator.

Is it the operator’s responsibility to maintain these tagged vehicles or is it handled by the federal government similar to GSA vehicles?

It is the operator's responsibility to maintain the non- GSA vehicles.

Please provide the Building Number(s) of any dormitory that is currently unoccupied.

Dorms currently unoccupied include: 301, 302, 303, 304, 305, 901, 902, 903. This is subject to change as OBS increases occur.

Please provide the status of the repair of the Swimming Pool Building (#1512-A) to include an anticipated date for re-opening.

Repairs are still needed for the swimming pool. Per the ESC and National Office, repairs are temporarily on hold. It is not known at this time when repair work will begin. Until repairs occur, the pool cannot be utilized.

Please provide the status of the repair of the Career Transition Services Building (#801) to include an anticipated date in which it can be re- occupied.

The National Office ESC group is currently reviewing utilization of the buidling so any extensive work/repairs are not occuring. There is no timeframe noted when it can be re-occupied until the utilization is finalized. CTS staff are located in Bldg 604 at this time.

C.2 Page18

Earle C. Clements has had both reductions and additions of CTT programs since the last RFP in 2018. 168 Basic Training slots have been reallocated to Advanced Training, reducing the center’s CTT to OBS utilization from 92.9% to 84.6%, which is the approximate OBS equivalent of 84 students. Does the government plan to add training programs or will this be the correct utilization percentage moving forward?

The CTT slot confirguration identified in Section C is correct as stated. However, CTT programs are always subject to changes. Any change will have to follow the stated CTT Change process that requires approval at the Regional and National levels. At this time, there are no CTT changes pending.

J-5
