About this file
This Request for Proposals (RFP) solicits offers for the operation of the Northlands Job Corps Center located in Minnesota, including Outreach/Admissions and Career Transition Services. Offerors must propose to provide academic instruction, career technical training, residential living programs, student support services, and medical services to an average of 300 students. Proposals are due by October 15, 2021 at 2:00 PM ET. The base period of performance is 24 months with three 12-month option periods. Section L.7 Proposal Content
FACTOR 4. BUSINESS MANAGEMENT PROPOSAL
PLEASE BE ADVISED: Executive Order (EO) 14026, “Increasing the Minimum Wage for Federal Contractors,” was signed by the President on April 27, 2021. EO 14026 provides for increasing the minimum wage for Federal contractors to $15.00 per hour, effective January 30, 2022. EO 14026 can be accessed at: https://www.whitehouse.gov/briefing-room/presidential-actions/2021/04/27/executive-order-on-increasing-the-minimum-wage-for-federal-contractors/. As the performance of this requirement is anticipated to begin on/after the January 30, 2022 effective date, offerors shall include the increased minimum wage in their price proposals.
Pricing information shall be mentioned only in the Business Management Proposal and in no other sections of your proposal. Offerors shall not propose pricing for the following CLINS:
Construction, Rehabilitation and Acquisition (CRA), Equipment, Career Technical Skills Training (CTST), and Travel. The “Not to Exceed” amount for these categories shall be determined by the Government. In addition to the written pricing proposal, offerors shall provide the following using Microsoft Excel:
Pricing By Year (Attachment J-1)
The Offeror’s Business Management Proposal shall consist of the following and in the order stated: (Sample forms and attachments are shown in Section J)
a. Business Management Data
1) A completed Standard Form 33, Solicitation, Offer and Award
2) Statement of Financial Capability (ETA 8554) https://www.whitehouse.gov/briefing-room/presidential-actions/2021/04/27/executive-order-on-increasing-the-minimum-wage-for-federal-contractors/ https://www.whitehouse.gov/briefing-room/presidential-actions/2021/04/27/executive-order-on-increasing-the-minimum-wage-for-federal-contractors/ https://www.whitehouse.gov/briefing-room/presidential-actions/2021/04/27/executive-order-on-increasing-the-minimum-wage-for-federal-contractors/
Northlands Job Corps Center/OA/CTS
3) Applicable Certifications and Cost Accounting Standards Notices and Certification as required in Section K of this RFP.
4) Staff Compensation Plan. Offerors shall submit a staff compensation plan (Attachment J-28) that includes proposed salaries and fringe benefits for employees working on the contract. Offerors shall also submit supporting information/data, such as recognized national and regional compensation surveys and studies of professional, public and private organizations, used in establishing the total compensation structure.
5) A statement from a lending institution, on the official letterhead of the institution which demonstrates that the Offeror has a sufficient line of credit to cover one month’s costs under this contract. The letter must not only stipulate the amount of the line of credit but it must also attest to the amount that is presently available under the line of credit. In the event that the Offeror does not currently have a line of credit but will be able to obtain the line of credit upon award of this contract, the Offeror shall provide a letter on the official letterhead of the lending institution that it will be granted the line of credit upon contract award.
6) Offeror shall describe the fiscal controls the entity has in place to ensure proper accounting of Federal funds, and a description of how the entity will meet the requirements of WIOA section 159(a).
7) Offeror shall describe the steps that it will take to control costs associated with reimbursement line items, in accordance with WIOA section 159(a)(3).
8) Offeror shall describe any non-Federal resources that will be utilized in the operation of this Job Corps center.
9) Offeror shall provide proof that it is able to obtain a license to operate in the State in which the center is located within 30 days of contract award.
10) Offeror shall provide an assurance that it will comply with basic health and safety codes, which shall include the disciplinary measures described in section 152(b) of the Workforce Innovation and Opportunity Act of 2014.
11) Offeror shall provide a full copy of every report issued within the last three years (including audits or other reports) of the Office of Inspector General of the Department of Labor that mentions the offeror, an affiliate or predecessor of the offeror, or any contract that the offeror or an affiliate or predecessor of the offeror performed.
b. Pricing Detail
Offeror shall include completed Attachment J-1. Please note that the amounts in the Not to Exceed (NTE) Line Items in Schedule B will be provided by the Government and will not be
Northlands Job Corps Center/OA/CTS considered as part of the offeror’s total evaluated price. However, the total amount of the Not to Exceed Line Items will be included in the total amount of the awardee’s contract.
Attachment J-1 will allow the offeror to fill in its yearly (base period will be 24 months) price for each CLIN. The spreadsheet will then automatically calculate the monthly unit price for each CLIN based on the yearly price proposed by the offeror.
c. Phase-In/Phase-Out Prices
This section of the Business Management Proposal encompasses two elements:
1) For offerors who are not the incumbent contractor at the subject Job Corps center, the Offerors shall include a phase-in price. This price will appear in CLIN 0001 on the pricing schedule. Offerors shall propose a phase-in price. Phase-In price shall not exceed $100,000.
2) Both incumbent and non-incumbent offerors shall include a proposed phase-out price for activities above and beyond center operations that the contractor will perform at the end of the contract that will result from this solicitation. Offerors shall propose a phase-out price. Phase-Out price shall not exceed $100,000.
Please note that the offeror who is the incumbent contractor at the subject Job Corps center shall not include any phase-out costs under this solicitation that would be associated with phasing out of center operations under the current incumbent contract.
Any such expenses would be allocable to the incumbent contract and will be processed as part of the administration of the incumbent contract and in accordance with the terms of the incumbent contract.
d. Limitations on Subcontracting and the SBA’s Ostensible Subcontractor Rule
If a subcontractor arrangement is proposed or intended, the Offeror shall describe how they intend to comply with FAR Clause 52.219-14 (Limitations on Subcontracting) while also ensuring no Ostensible Subcontractor relationship exists. The offeror shall provide the following:
The proposed organizational structure along with clear internal and external lines of authority (diagram the structural connections or associations of the entities responsible for all subcontracted work)
Each subcontractor’s relationship to the overall effort and the percentage of work to be completed by each entity
Certification statement that as the prime contractor, the Offeror will be performing the “primary and vital requirements” of the contract (at least 50% of the total contract value)
Small Businesses should note that while a subcontracting plan is not required, Offerors should provide a listing of any major subcontracts that are anticipated. The subcontract list should include at a minimum a list of the functions, tasks, and positions that are proposed with their anticipated dollar value.
Introduction
Instructions for Completing the Staff Compensation Chart
The following staff compensation chart shall be completed. The number of staff in each function shall be shown on this chart. The estimated average salary of each staff position shall be shown. Each contractor has its own manner of organizing its staff; however, for the purposes of this proposal, follow the outline of this Staff compensation chart.
Different contractors have different position titles for similar functions. However, for purposes of evaluation, offerors may not change position titles in column 1. Where offeror’s position titles differ, actual titles should be entered in the “Remarks” column. The Staffing Chart describes functions. In the event that a position is so unique that it does not fit any title on the chart, place the position in the appropriate place on the chart.
Subcontractor staff must be reported. Therefore, if a subcontractor has deemed their salary information proprietary, they may submit this information directly to the Contracting Officer at the email address identified for receipt of proposals. The subcontractor must clearly identify which prime contractor's proposal their submission is associated with.
DOL recognizes that at the time of proposal submission, offerors would not have made firm offers of employment to individuals that therefore, the salary information provided in this tool may be an estimate of the competitive salary that the offeror anticiaptes for a position(s).
Definitions.
1. Standard Position Title
2. The number of staff at each position title. If none are proposed, leave the line blank. If one person performs more than one function or one person performs the same function in two or more different functional areas, show the allocation of that person's time as a decimal (e.g., .5) allocation to the proper line.
3. If a position is subcontracted, show the number in the appropriate column.
4. Remarks. The center title, if different from the title shown in the left-hand column, and any comments you wish to make.
5. Proposed Salary should be the annual salary estimated for this position title.
6. Fringe benefit percentage should be listed for each position title and the offeror can use it's average fring benefit percentage, rather than the actual percentage for each position.
7. Proposed Salary Source/Justification should be the source used to support the annual salary estimate.

Soliciation Section (when cited by contractor) Question(s) Answer(s)
Section C Intro The government notes that the offeror’s proposed technical and staffing approaches will be incorporated into the contract and shall become requirements. Does the incorproation include the BMP?
Yes, the offeror's entire proposal, to incude the BMP, may be incorporated into the contract.
C.1.B Shall the contractor’s proposed staffing reflect the revised wellness staffing requirements outlined in PRH Change Notice No. 20-25, issued April 16, 2021?
Revised wellness staffing requirements were outlined in PRH Change Notice No. 20-05.
The offeror's proposal should include the PRH Change Notice No. 20-05, issued April 16, 2021.
C.1.C.2
The contractor is requested to provide basic health care, counseling, and other support services as required by the ePRH. Are all these same services expected given the current Covid-19 pandemic & remote learning environment? Or are these services going to be adjusted given the remote learning status of JCC students? If there are changes, will the government provide further details of what those expectations will be?
The operator is required to comply with all contract and PRH requirements in its operation of a Job Corps center. Performance of the contract is expected to start on May 1, 2022. Given the current state of the pandemic, the Government cannot predict what the state of the pandemic may be in the future. Any changes to work to be performed will either be addressed in an Amendment to the RFP or in a modification to the contract post-award, in response to which the contractor may submit a request for equitable adjustment.
G.9
With the current Covid-19 pandemic atmosphere and remote learning, is 100% OBS still the expectation after 3 months grace period? And if not, how does the government expect to adjust monthly price given the current situation?
In accordance with Section G.9, after the 3 month grace period (does not apply to an incumbent), the contractor is expected to undertake every effort necessary to attain and/or maintain 100% average monthly
OBS.
H.8 Should the Executive Order raising minimum wage to $15.00, effective 1/1/22 be taken into account when preparing contract pricing?
Yes, offerors should include the increased minimum wage, as required by Executive Order 14026 signed 4/27/2021, in their price proposals.
Section L.7 Proposal Content, Factor 4 Business Management Proposal has been been revised. See Amendment 0001.
H.8
Executive Order 14026 (Increasing the Minimum Wage for Federal Contractors):
• requires federal contractors to pay a $15 minimum wage;
• is currently under proposed rulemaking for public commentary;
• will be implemented by U.S. Department of Labor’s Wage and Hour Division through issuance of regulations by November 24, 2021;
• is not required to be in solicitations until January 30, 2022; and
• is to be implemented into new contracts and into existing contracts by all agencies on March 30, 2022, when the option year is exercised on those existing contracts.
Given the facts above and the period of performance of the resultant contract, should wages be proposed that will increase the price and factor in this $15 per hour minimum wage? Or should Executive Order 14026 not be factored in and not be included in wages and price proposed? If Executive Order 14026 is not included in the wages/price proposed, can the successful offeror expect to receive, through a contract modification, additional contract value and funding for an equitable adjustment request submitted after contract award that brings wages up to this new $15 minimum wage (including wage compression resulting therefrom)?
Yes, offerors should include the increased minimum wage, as required by Executive Order 14026 signed 4/27/2021, in their price proposals.
Section L.7 Proposal Content, Factor 4 Business Management Proposal has been been revised. See Amendment 0001.
J-1 Price Detail Template
Please clarify how the government would like the formula in the J-1 Price Detail Template to work as it relates to 52.217-8 Option to Extend Services. The formula currently includes Phase Out as a part of the pricing for Option Year Three, which is not consistent with the Section B Pricing Schedule.
This is done for the purposes of calculation and evaluation. In the J-1 Price Detail, CLIN 3009 Phase-Out pricing should be included in the total calculated price for Option Year Three, as stated.
J-6 The RFP specifies that a Subcontracting Plan is not required for total small business solicitations. However, the J-6 was included. Please specify whether or not the J-6 is required for submission.
FAR 52.219-9 specifies that Small Business Subcontracting Plans are not required from small business contractors; therefore, submission of the J- 6 attachment is not required from small business contractors.
J-23 Attachment J-23 provides center utilities from PY14-PY18. Could the government please update the tables to include PY19 and PY20?
Data for 2019 and 2020 utilities at the Northlands Job Corps Center is available in RFP Attachment J-12. The utility and fuel usage specific to the Northlands Job Corps Center is as follows:
2019 -- $470,055 2020 -- $390,714
Factor 4. a.4.
J-28
As the Attachment J-28 requirement is relatively new, we have the following clarifying questions:
• For positions that are split between multiple departments does the government expect the Estimated Proposed Salary (Annual Salary) to be calculated based on the FTE or as if the position is a full 1.0 FTE.
o Example a 1.0 FTE position is split between Academics and CTT with an annual salary of $50,000. Would contractors enter a 0.5 FTE on Academics and CTT respectively with an annual salary on each line $50,000 or $25,000 (0.5 of the $50,000 annual salary)
• Where subcontracted medical services are provided by a subcontracted vendor do contractor’s still need to list an annual salary and fringe benefits?
• OA/CTS positions are listed at the bottom of the Staffing Calculator Center Tab which ties to the link in the Staffing Summary Tab. The OA/CTS positions are also listed on the Staffing Calculator OACTS. Can the Staffing Calculator OACTS tab be eliminated, or does DOL want the positions listed in both places?
• It does not appear that there is a formula to sum subcontracted OA/CTS positions (Cell C335 on the Staffing Calculator Center tab and Call C27 on the Staffing Calculator OACTS tab), Please advise.
• Typically, contractors submit the J-1 in Factor 4. BMP as well as Excel.
Would DOL prefer the J-28 be treated the same way, or would DOL prefer it only be submitted in Excel?
** Salaries should be shown on a full 1.0 FTE basis; using this example, a position that is split 0.5 FTE Academics and 0.5 FTE CTT, would be shown with an annual salary of $50,000 on each line. The attachment has a field for remarks the offerors may use to clarify that this is a split position and that the annual salary is shown for the position.
** Yes, annual salaries and fringe benefits should be listed for subcontracted medical services. FAR 52.222-46 requires this information for all professional employees working under the contract.
** OA and CTS positions should be listed in both places.
** These formulas were inadvertently omitted from the attachment. A revised Attachment J-28 to include the formulas in the referenced cells is attached to Amendment 0001.
** The J-28 must be submitted in Excel format; however, Offerors may also choose to submit attachment J-28 in the BMP.
