PART 1 – GENERAL INFORMATION

INTRODUCTION

The Salt Lake Technical Center (SLTC) analyzes workplace exposure samples submitted by Federal Compliance Safety and Health Officers (CSHOs) from all over the United States and the following territories: Puerto Rico, Virgin Islands, and Guam. Analytical results provided by SLTC to CSHO's are often used as the basis for citations and these results must be accurate, precise, and defendable in court proceedings. This work requires a continual supply of specific and high quality gases to operate analytical instruments such as Gas Chromatographs (GC), Atomic Absorption Spectrometers (AA), and Inductively Coupled Plasma (ICP).

GENERAL INFORMATION

Type of Contract: The government anticipates to award an Indefinite Delivery Indefinite Quantity (IDIQ) vehicle with Firm Fixed Price (FFP) task orders to be placed against it.

Quality Control The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. OSHA will develop and provide a QCP that will be delivered to the contractor within 30 days after contract award. Three copies of the QCP shall be submitted to the KPO and COR within 5 working days with any changes requested by the contractor. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.

Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

SPECIFIC TASKS

Commodities listed below and high quality liquid nitrogen, liquid argon (4.8 purity or higher), helium, hydrogen, nitrogen, argon, acetylene, nitrous oxide and compressed breathing air are constantly used and consumed by:

Sample Preparation Specific Analytical Instruments (e.g., AA, ICP, GC, etc.)

Different Laboratory Operations (e.g., eluent sparging), etc.

A contractor must be able to deliver analytical grade and purity of gases in sufficient quantities within 3 days of request.

Hydrogen Helium, high purity greater than 5.0 (UHP) Helium Standard Grade Acetylene Nitrous Oxide Nitrogen Liquid Nitrogen Air (compressed) Argon Liquid Argon (this is stored in large storage tanks monitored by vendor; vendor delivers in SCF (standard cubic feet and invoices per CCF (hundred standard cubic feet) Liquid Nitrogen (this is stored in large storage tanks monitored by vendor; vendor delivers in SCF (standard cubic feet and invoices per CCF (hundred standard cubic feet) Rental Charges for K-Cylinders Rental Charges for Dewar’s Special Blends, H25 and CO2

Contractor will supply and deliver the SLTC with (bulk) quantities of high quality liquid nitrogen, liquid argon (4.8 purity or higher), helium, hydrogen, nitrogen, argon, acetylene, nitrous oxide and compressed breathing air to be used to run various types of quantitative analyses. Therefore, all supplied gases must meet established and required purity levels.

The vendor will monitor the tanks and when needed fill the tanks located at the Salt Lake Technical Center. The tanks located at the Salt Lake Technical Center will have a monitoring system, or other alarm system, that will notify vendor by way of an alarm line when the tank is at a certain point that is lower than required to run the equipment.

The bulk storage located at SLTC is larger than the standard size K high-pressure gas cylinder (9.25 diameter x 60 inches high, internal volume is 1.76 cu ft.). Delivery of these types of gases will be in accordance with state transportation laws that govern such transportation to and from the location in a legal and safe manor.

All gases will be provided within 3 days of submitting an order, or on unusual occasions the vendor will acknowledge to request and notify the center POC of the expected date of delivery. List of commodities listed below represents an incomplete sampling of the possible gases to be required for us by SLTC laboratory.

One invoice billed at the end of each month for all charges no later than the fifth of the following month. A monthly usage report to be emailed at the end of each month to the COR that is descriptive (no acronyms), is clearly understood and outlines what products were orders, what products were delivered, when they were delivered, the cost associated with each to include amount and units delivered that can be reader friendly to verify against monthly invoice. If improper billing occurs vendor will notify SLTC of when and how monies will be credited back to the contract via written documentation on invoice and monthly usage report.

Upon notice of any cross contamination SLTC will not be billed for any of the product, time, or transportation cost associated with the error.

If required, the contractor will provide on a rental basis to SLTC appropriate storage cylinders and tanks for the period of time that the gas is needed. Bulk gases (Liquid Argon and Liquid Nitrogen) will be supplied by the vendor as needed by monitoring an alarm system provided and installed by the vendor such as a telemetry alarm and keeping the volumes at the required levels. The required levels are managed through the alarm system that will notify the vendor when it is time to fill the tanks. By use of the alarm system the vendor will know what levels the tanks are at all times.

Telemetry or alarm equipment will be provided by the vendor as part of the contract and all repairs to the equipment will be the responsibility of the vendor.

Rental Charges for K-Cylinders and Dewars are invoiced per container type, per month, therefore, actual extended totals are TBD or to be determined based on actual number of container types rented for actual number of months rented.

Commodities listed above represent an incomplete sampling of the possible gases to be required for us by SLTC Laboratory. The laboratory has no way of knowing what accidents will occur during the year and therefore cannot know what type of analysis will be required. The list that is furnished shows all gases that are used on a regular basis and will be used for certainty at the SLTC Laboratory.

TASK ORDER PROCEDURES

IDIQ TASK ORDERS

This contract will be administered by issuing Firm Fixed Price (FFP) Task Orders to the Contractor for the supplies/services identified in this PWS. The following ordering procedures shall apply to all task orders issued under this IDIQ. Any supplies and/or services to be furnished under this contract will be ordered by issuance of a Task Order. The Contracting officer will issue a written Request for Proposal (RFP), and evaluate the contractor’s response prior to issuing the Task Order. Task Orders shall be issued as described below.

Only an authorized Government Contracting Officer can issue a Task Order under this contract. No work will be performed and no payment will be made except as authorized by a signed Task Order. All Task Orders are subject to the terms and conditions of the contract. In the event of conflict between a Task Order and the contract, the contract will take precedence.

TASK ORDER PLACEMENT AND ORDERING PROCEDURES

The Contracting Officer will authorize, sign, and issue individually priced task orders for supplies/ services at the fixed unit prices in accordance with the resultant contract. The Task Order process described below represents the Government’s approach to issuing a Call Order.

1. A standardized Request for Proposal (RFP) shall be issued to facilitate the Task Order process.

2. The Contracting Officer will provide a Request for Proposal to the Contractor. Each RFP will generally include:

The type of Task Order (Firm Fixed Price);

A Statement of Work indicated what is needed;

The desired delivery schedule and/or required completion date(s), milestones, reporting requirement and list of deliverables as applicable;

Proposed terms and conditions;

The date and time by which the response is due;

Any special instructions, conditions, notices, deliverables, performance measures, etc.

applicable to the Task Order

3. The Contractor shall prepare a response within three business days of the request unless otherwise stated in the individual Task Order. Request for Proposals will generally be made via email using an email address furnished by the Contractor.

4. In addition to the technical and/or management approach proposed, the Contractor shall for cost/price purposes, use:

All Task Orders shall be issued based on the pre-established CLIN prices contained in Section B of the contract. Except where the contract is modified after award, these prices/costs represent the highest rates that the Government will consider and accept during the life of the contract. This does not preclude the Contractor at their discretion from proposing lower rates for individual Task Orders. For Firm Fixed Price Task Orders, the quantity of each proposed CLIN shall be multiplied against the rate listed as the Unit Price. The cumulative amount will define the fixed price for the Task Order.

5. The Government will evaluate the Contractor’s quote and determine whether or not to award a Task Order in accordance with the RFP. The basis for award of any Task Order will be determined by the specific programmatic needs of the requesting agency. If deemed necessary by the Government, the Contracting Officer will enter into oral and/or written communications with the Contractor in order to resolve any clarifications and/or deficiencies.

Individual Task Orders will not be awarded that exceed a single item in excess of the estimated maximum quantities identified in the schedule; or any order for a combination of items in excess of estimated maximum quantities identified in the schedule; or extend for a period longer than 12 months unless such limits are waived by the contracting officer. The period of performance may not contain option years.

Individual Task Orders may be awarded on a firm fixed price basis only.

The IDIQ will be reviewed annually to make certain the IDIQ still represents the best value to the Government.

The contractor shall submit separate invoices for each Task Order and include the IDIQ contract number as well as the Task Order number.

INVOICE SUBMISSION

Invoices should be submitted on a monthly basis per the instructions in the section titled, “Invoicing Procedures”. The invoices must contain the usage of all gases on a monthly basis as well as delivery frequency. The specific setup of the invoice must be determined with the Contracting Officer’s Representative upon initiation of award.

Rental Charges for K-Cylinders and Dewars are invoiced per container type, per month, therefore, actual extended totals are TBD or to be determined based on actual number of container types rented for actual number of months rented.
