C - Description/Specifications
Performance Work Statement (PWS) For
Office of Workers’ Compensation Programs (OWCP) Pharmacy Benefits Management Services
PART 1
GENERAL INFORMATION
1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to perform Pharmacy Benefits Management (PBM) Services as defined in this Performance Work Statement, except as specified in Part 3 as government furnished property, equipment, and services. The Contractor shall provide all of the services included herein with the only costs to the Government being the “Net Proposed Price/Discount” (CLINS 0001- 4001) for PBM basic services. The Contractor shall pay the provider directly and invoice OWCP. All invoices for medical services and medical support services provided to claimants under the resulting contract shall be sent to and approved by OWCP. The contractor shall factor all of these requirements, as well as the cost of obtaining the necessary medical support services, into the total discount that it can provide to the government for those services. The Contractor shall be required to adhere to all applicable laws / regulations irrespective of the Price / Discount structure utilized.
The PBM Services requirement as defined in this Performance Work Statement (PWS) represents new services.
As a result, there is no Incumbent Contractor currently providing PBM Services.
1.2 Background:
The Office of Workers’ Compensation Programs (OWCP) Division of Federal Employees’ Compensation (DFEC) is composed of a National Office responsible for policy setting, performance metrics and other program-wide functions, and twelve district offices located throughout the United States, which process compensation claims and authorize wage replacement and medical benefits.
The Federal Government employs a workforce of approximately 2.7 million Federal civilian employees.
These employees are covered by the Federal Employees’ Compensation Act (FECA) for employment-related injuries and occupational diseases. FECA benefits include medical support services (such as diagnostic testing, treatment, pharmaceuticals, and durable medical equipment (DME) and supplies for conditions that are accepted by DFEC as being related to the employment injury for as long as DFEC determines such medical support services are necessary for the employment injury or illness. The statute, regulations and program policy provide guidance for the administration of FECA claims. There were 220,707 Federal workers’ compensation (WC) cases under management between 30 November 2016 and 30 November 2017. These cases generated 911,131 prescriptions for drugs costing $235,685,753.
In September 2003, industry standard and program specific medical bill processing services were implemented centrally. The program provides medical benefits only to the extent that the medical care is related to the medical condition(s) accepted as employment-related during the period(s) of eligibility.
While bill-processing activities have been decoupled from the claims examination and adjudication functions, the DFEC claims examiner (CE) function for determining the accepted condition and authorizing certain medical treatments has been preserved. Data from the bill processing system keep the CE informed of the nature and quantity of treatment for a given accepted condition and requests for treatment that require prior authorization by the CE.
Industry standard requirements include but are not limited to eligibility edits, validity edits, required field checks, consistency edits, medical appropriateness, correct coding, duplicate checking, service limitations, application of OWCP fee schedules and financial accounting, auditing, and reporting.
Under the current medical bill processing contract, medical bill input, bill processing, and resolution occur at contractor sites. The bill processing contractor is also responsible for provider enrollment, generating and mailing remittance advice with explanation of benefits (EOB) information, handling provider inquiries (call center), and preparing a payment tape for transmission to the Department of the Treasury.
In addition, the bill processing contractor authorizes certain specified medical support services in accordance with DFEC criteria and refers the requests for authorization of more complex services to the DFEC district office staff managing the case. A contractor-run facility also provides the real-time processing of pharmacy bills.
There are two groups of federal civilian employees eligible for coverage under this program.
1. Group 1 is comprised of those who have an existing FECA claim. These employees have fully adjudicated WC claims, and have coverage for all prescriptions that meet the OWCP DFEC requirements for their accepted injury.
2. Group 2 is comprised of new FECA claimants. These employees are newly injured on the job and have filed FECA claims pending adjudication by OWCP DFEC.
1.3 Objectives:
Provide a system for first-fill prescription coverage for employees who sustain a traumatic injury at work.
Provide full prescription coverage for work-related injuries to all injured employees upon filing a FECA claim for traumatic injury.
Provide a pharmacy card system to employees who experience traumatic injuries, or occupational illnesses, once claim eligibility is determined by DFEC.
1.4 Scope: The contractor shall implement and operate a PBM in the United States and its territories for the Division of Federal Employees’ Compensation Programs (DFEC) that injured federal employees will generally be required to use in order to access pharmacy benefits. The PBM includes a program that services Federal employees with work-related injuries or illness, that have an accepted workers’ compensation case with DFEC, and require prescription medications, diagnostic services (e.g., magnetic resonance imaging (MRI), computerized tomography, (CT), radiography, electromyography (EMG)), and durable medical equipment (DME). The contractor shall provide a system for first-fill prescription coverage for employees who sustain a traumatic injury at work. The contractor shall establish a formulary1 for approval by OWCP to better manage costs, improve safety, and implement drug utilization review processes.
1.5 Period of Performance: The period of performance shall be for one (1) base period of 12 months with four
(4) 12-month options. The Period of Performance are as follows:
Base Period: September 05, 2018 – September 04, 2019 Option Period I: September 05, 2019 – September 04, 2020 Option Period II: September 05, 2020 – September 04, 2021 Option Period III: September 05, 2021 – September 04, 2022 Option Period IV: September 05, 2022 – September 04, 2023
Milestone dates within the period of performance include:
Contract Start: September 05, 2018 (based on estimated contract award of September 04, 2018) Phase 1 “90 MED” Implementation2: no later than October 4, 2018 Phase 1 Full Implementation: no later than November 3, 2018
1 It is noted that this will be the first formulary established for DFEC, as one does not currently exist.
2 This milestone is specific to the Phase 1 functionality required for approximately 3,000 individuals receiving 90 MED or higher of prescribed opioids.
Phase 2 Implementation: no later than December 3, 2018 Phase 3 Implementation: no later than March 3, 2019

DEFINITIONS & ACRONYMS
2.1 Definitions:
2.1.1 Abuse - Practices that are inconsistent with professional standards of care; medical necessity; or sound fiscal, business, or medical practices. Examples include but are not limited to billing for services that were not medically necessary, charging excessively for services or supplies, and billing which is not in accordance with industry standards. Importantly, intent is the key distinction between fraud and abuse. An allegation of waste and abuse can escalate into a fraud investigation.
2.1.2 Contracting Officer’s Representative (COR) - A representative from the requiring activity assigned by the Contracting Officer to perform surveillance and to act as liaison to the contractor.
2.1.3 Defective Service - A service output that does not meet the standard of performance associated with it in the Performance Work Statement.
2.1.4 eQIP – Electronic Questionnaires for Investigations Processing. The OPM system to facilitate processing of standard investigation forms used when conducting background investigations for Federal security, suitability, fitness, and credentialing purposes. eQIP allows the user to electronically enter, update and transmit their personal investigative data over a secure internet connection to a requesting agency.
2.1.5 Fraud - An intentional deception or misrepresentation made by a person with the knowledge that the deception could result in some unauthorized benefit to him or some other person. It includes any act that constitutes fraud under applicable federal or state law. Examples include, but are not limited to: billing for drugs or DME that were not rendered, altering claim forms to receive a higher payment rate, providing drugs or DME to someone other than the claimant using a claimant’s enrollment card, prescribing and billing for medications for claimant conditions other than those that have been accepted by OWCP, and charging for administrative services not rendered or items not provided. Importantly, intent is the key distinction between fraud and abuse. An allegation of waste and abuse can escalate into a fraud investigation.
2.1.6 Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.7 Quality Control. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the PWS.

Waste results in taxpayers not receiving reasonable value for their money in connection with any government-funded activities due to an inappropriate act or omission by payers with control over or access to government resources.
Importantly, waste relates primarily to mismanagement, inappropriate actions, or inadequate oversight.
Examples include, but are not limited to: use of higher-priced drugs and DME that have negligible or no health benefits over less-expensive alternatives, writing high-cost prescriptions over less expensive but equivalent generic prescriptions, and overtreatment.
2.1.11 Medical support services – Services and supplies provided by or under the supervision of a physician.
Examples include, but are not limited to, diagnostic testing, medical treatment, pharmaceuticals, and durable medical equipment (DME) and supplies.
2.1.12 Average Wholesale Price - Defined as the average value at which wholesalers sell drugs to physicians, pharmacies, and other customers. For OWCP purposes, AWP is based on First Databank before 10/01/2011 and MediSpan thereafter – or as otherwise specified by OWCP in the event of a subsequent change - determined by the fill date.
2.1.13 Maximum Allowable Cost – Defined as a list of drugs, usually multisource generics, in which the PBM establishes the maximum price it will reimburse for each of the drugs on the list. Instead of using only AWP to price these medications, the PBM uses a proprietary formulary, taking into account wholesale acquisition cost and other pricing benchmarks in order to establish a maximum price more in line with the actual cost of the drug.
