However, in no event will the total exceed the maximum number of 21 hours without the approval of the Contracting Officer. The quotation must also include a fully completed Exhibit A (Court Reporter Pricing Schedule), which is attached hereto and incorporated herein by reference.
Quotations should include your GSA Schedule Number, and your DUNS Number.
D. Performance Dates and Locations
Deposition testimony of up to 21 hours will be taken between September 10, 2018, through November 23, 2018. Specific dates and locations are to be determined and will be communicated when scheduled. F. Pricing
1. Prices: All prices provided to the Chicago SOL Regional Office for services furnished hereunder shall be as low as or lower than those charged to the Contractor’s most favored customer for comparable quantities under similar terms and conditions, in addition to any discounts for prompt payment, for the area of performance. At no point should the Contractor charge for any requested service more than the prevailing rate for such services in the locale where the service is provided.
2. Per-Page Rate for Only Transcripts: The Contractor will be paid a per-page rate for transcripts, only if ordered, which shall be no more than the average rate for the area of performance.
3. Attendance Fee: The Contractor will be paid an Attendance Fee. 3. Court reporters shall have knowledge of proper grammar and punctuation sufficient to recognize and correct errors in final transcripts.
4. H. Recording Requirements
1. The recording shall be taken by reporters qualified in the operation of methods generally recognized in the industry and approved by the Chicago SOL Regional Office. Regardless of the type of equipment used, it is mandatory that there be an accurate read-back capability and that a functional and reliable back-up system is utilized.
2. The Court Reporter must use equipment which has the functionality and reliability to provide prompt and timely read-back service when requested, which is understood in most circumstances to be less than 30 seconds.
3. Reporters are required to comply with Rules 28 and 30 of the Federal Rules of Civil Procedure, and specifically Rule 30(e), which provides in pertinent part as follows:
"On request by the deponent or a party before the deposition is completed, the deponent must be allowed 30 days after being notified by the officer that the transcript or recording is available in which: (A) to review the transcript or recording; and (B) if there are changes in form or substance, to sign a statement listing the changes and the reasons for making them. The officer must note in the certificate prescribed by Rule 30(f)(1) whether a review was requested and, if so, must attach any changes the deponent makes during the 30-day period," e.g. “The deponent was given the opportunity to review the transcript or recording and (accepted) or (declined) such review and was given no more than 30 days from the date the deponent was notified that the transcript was available for review pursuant to FRCP 30(e).”
5. Everything spoken pertaining to the subject matter of the deposition shall be recorded, unless the Chicago SOL Regional Office attorney in charge of the deposition otherwise directs. No part of any deposition which has been recorded as required shall be omitted from the record, unless the Chicago SOL Regional Office attorney in charge so directs.
6. All notes, records, documentary exhibits, and other material which is a part of, or relates to, any action recorded by the Contractor shall be the property of the Chicago RSOL Regional Office and shall be delivered to such office, together with the furnished transcript, unless otherwise instructed.
I. Procedures for Scheduling Depositions
1. Scheduling of Depositions. The Chicago SOL Regional Office will normally notify the Contractor of the requirements for attendance at the depositions no later than two (2) business days before the scheduled session. The Contractor shall reply stating its intention to take the deposition by returning a response by email or facsimile and communicating the name and all contact information of the reporter who will be in attendance to the Chicago Contact or the Contracting Officer. The Chicago SOL Regional Office reserves the right to request a copy of the court reporter’s resume prior to the deposition. Any change of personnel shall be communicated by the Contractor to the Chicago SOL Regional Office prior to the session.
In the event a deposition is continued for more than one day, the Contractor agrees that it will assign the same court reporter for each continued segment of that given deposition whenever possible. Should the Contractor not be able to provide the same court reporter, it will notify the Chicago SOL Regional Office before the scheduled session that an additional court reporter will be providing the court reporting services and transmit that person’s name and resume upon request.
2. Cancellation. The Chicago SOL Regional Office will notify the Contractor of any cancellations no later than 5:00 pm (C.S.T.) the day before the scheduled deposition. If the Chicago SOL Regional Office does not notify the Contractor within the designated time, the Contractor may request a cancellation fee. The cancellation fee will not exceed $100.00.
J. Transcript Requirements
