C - Description/Specifications
PART 1 GENERAL INFORMATION
1.1 Description of Services/Introduction:
The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to perform office building construction data and price updates as defined in this Performance Work Statement (PWS). The contractor shall perform to the standards in this PWS.
1.2 Background:
In recent years, the New Office Building construction market has experienced changes in both design and function. Offices have become more technologically advanced, more energy efficient, and built with greater focus on safety and wellness design features and productivity.
1.3 Objectives:
The primary objective of this effort is for the contractor to update the current Office cost models which:
Fully specify four regional cost models that will be updated on a quarterly basis, at a minimum. Identify the “average” and/or most common characteristics of a new office building constructed between June 1, 2021, to June 1, 2024, as determined by data collected by the vendor. Identify trends (positive or negative) in office construction. Aid in creating and maintaining four regional (Northeast, South, Midwest, and West) office building cost models and a methodology to update the costs in each of the four models on a quarterly (or more frequent) basis. The methodology shall adjust the costs for each component of the model to reflect market price movements observed within the region for which the model was designed.
1. Obtain from the vendor a reasonably comprehensive list of new office building projects that were bid, under construction, or completed construction in the continental United States during the period of June 1, 2021, to June 1, 2024
2. Identify a specific project (one for each of the four major Census regions) that best reflects the “average” or typical office project within that region relative to size, and any other characteristic deemed relevant by the vendor as demonstrated by data gathered for the specified time frame.
3. Have the vendor develop four detailed regional office building cost models. Each model shall reflect the known characteristics of the project selected as the “average” for the region.
4. Have the vendor develop and implement a methodology to update the material, labor, and installation costs for the four regional models on a quarterly basis.
5. Identify the top 1-5 trends influencing the design features in new office building construction.
1.4 Scope:
The data and services covered by this performance work statement include everything necessary to re-specify the current office building models for the four major Census regions (Northeast, South, Midwest, and West) and maintain continuous calculation of BLS indexes.
1.5 Period of Performance:
Meetings with the vendor will take place within 10 business days (and any additional days that may be deemed necessary by BLS) after each the following:
· The contract has officially been awarded.
· The receipt of the refined “project list”
· The delivery of four regional base models, one per major Census region (one meeting following each model)
· The receipt of the methodology workbook
· The receipt of each quarterly cost update
The dates for execution of the base year period contract and the option year contracts are as follows:
· Base Period: Date of contract award (estimated to be 8/1/2024) - 5/31/2025.
· Option Period 1: 6/1/2025-5/31/2026
· Option Period 2: 6/1/2026-5/31/2027
· Option Period 3: 6/1/2027-5/31/2028
· Option Period 4: 6/1/2028-5/31/2029
1.6 General Information
1.6.1. Quality Control:
The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. As a minimum, the contractor shall develop quality control procedures that address the areas identified in Technical Exhibit 1, “Performance Requirements Summary”. After acceptance of the quality control plan, the contractor shall receive the Contracting Officer’s (CO) acceptance in writing of any proposed change to his QC system. The QC is to be submitted to the Contracting Officer Representative (COR) and/or CO within 30 calendar days of contract award.
1.6.2. Quality Assurance:
The government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government will do to ensure that the contractor has performed in accordance with the performance requirements summary. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.4. Recognized Holidays:
The Federal Government observes the following holidays and Federal buildings will be closed. Federal contractors shall not perform services under this contract on the following holidays:

1.6.5. Hours of Operation/Place of Performance:
The contractor is responsible for conducting services during normal business hours Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within the performance work statement when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the work force are essential.
1.6.6. Type of Contract:
The government contemplates award of a firm-fixed price purchase order.
1.6.7. Security Requirements:
Not Applicable.
1.6.7.1. Physical Security.
The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.6.8. Special Qualifications:
The contractor shall ensure any requirements and submissions are completed within the timeframe required by the government. DOL reserves the right to review and approve or disapprove all the security safeguards instituted to comply with the requirements of this contract.
1.6.9. Post Award Conference/Periodic Progress Meetings:
The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The CO, COR, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the CO will apprise the contractor of how the government views the contractor's performance and the contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.10. Contracting Officer Representative (COR):
A COR for this order shall be appointed under separate cover.
PART 2 DEFINITIONS & ACRONYMS
Contracting Officer’s Representative (COR). A representative from the requiring activity assigned by the Contracting Officer to perform surveillance and to act as liaison to the contractor.
Defective Service. A service output that does not meet the standard of performance associated with it in the Performance Work Statement.
Deliverable. Anything that can be physically delivered but may include non-physical things such as meetings.

PWS. Performance Work Statement
Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
Quality Control. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the
PWS.
Quality Assurance. Those actions taken by the government to assure services meet the requirements of the Performance Work Statement.
Term: Assembly Definition: A discrete job completed by a single type of trade contractor. Every job necessary to construct a building should be encompassed by a unique assembly.
Example: Concrete slab on grade, 5" thick, heavy industrial, reinforced.
Term: Component Definition: A unique line below the assembly level. A specific material or labor used in the completion of an assembly. A group of components are all the materials and labor necessary to complete the assembly.
Example: Ready mix, regular weight, 3500 psi. 1500 c.y. concrete for $11,500.
Term: ‘New’ and ‘New Construction’ Definition: A structure that is built from the ground up for the first time. The structure cannot be attached to, or a modification of, any previously existing structure. New construction includes erecting a building on a location where a previous building was demolished. Construction of the building must be done primarily on-site.
Term: Office (Proposed Definition Revision) Definition: In addition to the types of offices listed below, it also includes motion picture, television, and radio offices. Office buildings at manufacturing sites are classified as "manufacturing"; however, an office building owned by a manufacturing company and not located at a manufacturing site is classified as "office."
· General Includes administration buildings, office buildings, and professional buildings. Also includes State, local, and federal city halls, borough halls, municipal buildings, courthouses, and capitol buildings.
· Financial Includes banks, financial institutions, building & loans, saving & loans, and credit unions.
· Computer center/Data center Includes buildings composed of networked computers, storage systems and computing infrastructure that organizations use to assemble, process, store and disseminate large amounts of data.
Medical buildings are NOT included in the definition of offices. Medical buildings include clinics, medical offices, doctor and dentist offices, outpatient clinics, and medical research labs.
Term: Midwest Census Region Definition: One of the four major Census regions which includes the following states: Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Nebraska, North Dakota, Ohio, South Dakota, and Wisconsin.
Term: Northeast Census Region Definition: One of the four major Census regions which includes the following states: Connecticut, Maine, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, and Vermont.
Term: Parochial Office Definition: A type of office that includes religious education in addition to traditional education subjects.
Term: Private Office Definition: Any office that does not meet the definition of a public office.
Term: Public Office Definition: A office owned by a local, state, or federal government body. Local government bodies include local office districts which are funded by taxpayers.
Term: South Census Region Definition: One of the four major Census regions which includes the following states: Alabama, Arkansas, Delaware, District of Columbia, Florida, Georgia, Kentucky, Louisiana, Maryland, Mississippi, North Carolina, Oklahoma, South Carolina, Tennessee, Texas, Virginia, and West Virginia.
Term: Vocational Office Definition: A type of office that prepares students for careers based in a manual or specific trade.
Term: West Census Region Definition: One of the four major Census regions which includes the following states: Arizona, California, Colorado, Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington, and Wyoming.
PART 5 SPECIFIC TASKS
5.1 Basic Services
The Contractor shall provide services to perform office building construction data and price updates as defined in this Performance Work Statement (PWS)
1. Delivery of a comprehensive list of all new office (see definition of ‘new’ and ‘Office’ in Attachment B) buildings bid on or built in the United States between June 1, 2021, and June 1, 2024.
2. Development of four (1 per major Census region) new office building cost models that reflect the trends identified by the data gathered by the vendor.
3. Development of a methodology to update the costs in the four regional office models on a quarterly basis reflecting market price movement within each of the regions. This methodology shall also allow BLS to select up to four assemblies (as defined in Attachment B) in each region for which specific research will be performed by the vendor.
4. Aid BLS on an ‘as needed’ basis to understand the make-up of the office cost models and to evaluate any future updates to the models due to significant changes in ‘typical’ construction practices.
5. Delivery of quarterly cost updates for each of the four regional office cost models.

Deliverables Schedule
BASE PERIOD
1. “Project List.” A reasonably comprehensive list of all new office building projects (specified by size, type of office, and Census region) in the United States that were either: (1) bid, (2) under construction, or (3) completed construction during the period of June 1, 2021, to June 1, 2024. In preparing the list of new office building projects it is very important that the project meet the definition of a ‘new’ ‘office’ building.
The information requested for each project shall include:
· Project bid date
· Construction start date
· Construction completion date
· Physical address (including city and state) where the project will be, or is being, constructed.
· Total square footage of the building
· Total cost for construction of the building, excluding land cost, external athletic and parking facilities, architectural fees, permitting fees, and any other cost not directly associated with the construction of the building itself. Construction costs should include material cost, labor cost, and installation costs.
· Cost per square foot for the building
· Total number of floors in the building above and/or below grade
· Building frame material
· Roof covering material
· Exterior wall material
· Multi-building campus site (Y/N)
· An indicator as to whether building plans/specifications are available to the vendor for use in developing the cost model. It would be desirable to include an indicator of the extent of this plan/specification information. Project plan/specification should only be listed as a “yes” if it includes all plans, schedules, and information needed to create viable model. A ranking system for projects will be developed between the vendor and BLS after contractor award.
· An indicator (yes, no, or information unavailable) that notes whether the office includes solar panels or other forms of renewable energy (e.g. geothermal heating)
· Type of office building structure (General, Financial, or Computer center/Data center)
· Leadership in Energy and Environmental Design (LEED) Rating (when available)
Performance Measure: The project list is due to BLS forty (40) business days after the official award date. The vendor will be asked to classify the office projects in their database into the following categories: General, Financial, and Computer center/Data center.
The project list will be judged based largely (but not solely) on the accuracy of the: (1) Project total cost information; (2) Square footage information; (3) Cost per square foot information; and (4) Completeness of the project list. The completeness of the list will be evaluated by BLS independently identifying “high profile” office projects in each region and checking to see if these “high profile” projects are both included in the project list and project details (e.g. square footage and construction cost information) are similar to internet sources. This list does not have to be comprehensive but should contain a reasonable number of these “high profile” projects.
Similarly, details for these projects do not have to be the same but reasonably close to the BLS research details.
· Is the “total cost” estimate listed in the project file within ±30 percent of the “total cost” estimate listed on publicly available internet sites?
· Have unusually small or large “cost per square foot” estimates been reviewed for accuracy?
· Have unusually small or large “total cost” and “square footage” estimates been reviewed for accuracy?
· Do 70 percent of the “high profile” projects independently identified by BLS in any one region appear on the project list?
2. Four regional office cost models. The vendor will develop a cost model of the office building project selected by BLS for each of the four Census regions. The cost model must go down to a level of detail such that all tasks necessary to complete the building are specified (See Attachment A at the end of this document). All building systems (plumbing, heating, and air conditioning, electrical, roofing, siding, and substructure) must be included in the model submission. The cost models must include appropriate column headers. All assembly level cost information must accurately reflect the aggregation of its lower-level cost information. Similarly, the total cost (both with and without overhead and profit) for each line in the model must accurately aggregate the material and installation costs for that line. The cost information for the assemblies and components must reflect market costs for the region that the model represents. NOTE: No partial quantities shall be listed for items which are not divisible into partial quantities. For example, ‘1.5 toilets’ is not acceptable. All quantities shall be rounded as appropriate.
Performance Measure: One completed regional cost model is due by each of the following dates:
(1) 3 Calendar Months after the Award Date
(2) 3.5 Calendar Months after the Award Date
(3) 4 Calendar Months after the Award Date and
(4) 4.5 Calendar Months after the Award Date.
These dates are firm unless different dates are mutually agreed upon or additional time is granted by BLS, via contract modification, due to unforeseen circumstances. The models are to be delivered in a Microsoft Excel format and meet the criteria specified above.
3. “Cost Update Methodology.” Develop and document the methodology to be used to update the costs in the model.
The methodology shall:
· Only use price data as collected from companies without any adjustments.
· Reflect actual prices observed in the marketplace since the previous cost update.
· Be based on a minimum sample of three companies providing price information.
· Only use cost information for the region that the model encompasses.
· Attempt to incorporate all the various costs (material, labor, equipment, fuel, etc.) which are included in the total cost of constructing a new office building.
· Allow BLS to select four assemblies in each of the four regions which will be updated quarterly using material, labor, and installation cost information that the vendor collects as part of their normal commercial activities.
· Obtain a minimum of three price quotes for materials surveyed by the vendor.
The document written by the vendor shall explain the methods that will be employed to update the costs in the models such that they reflect actual market costs. This document shall also:
· Detail all survey methods to be employed in the collection of information used to update the model costs.
· State the average number of companies to be contacted as part of the survey process.
· Explicitly state what types of costs (material, labor, equipment, fuel, general conditions) are and are not incorporated by this update methodology.
· Fully explain how the costs in the model are moved via the update methodology.
· Indicate all costs that will not be updated (for every period) due to non-collection or some other reason.
The methodology documentation is due not later than May 17, 2025. A ‘Satisfactory’ rating will be given if the documentation is received by the specified date and clearly explains the methods that will be employed to update the cost models. A rating higher than ‘Satisfactory’ will be given if the documentation is received before the specified date and clearly explains the methods that will be employed to update the cost models.
4. Ongoing model support. Ongoing support regarding the contents of the four regional models and any quality adjustment information required by BLS due to changes in these models. In addition, BLS may request information for noteworthy cost changes or for cost information when models or cost updates change significantly.
The vendor will assist BLS in understanding how these cost models were developed and answer specific questions concerning the selection of various materials and building systems for inclusion.
FOUR OPTION PERIODS
Four Option Year “Quarterly Cost Updates.” One year of quarterly cost updates for the four office building models. The cost updates for each option year are due by: June 10, September 10, December 10, and March 10. Each option year begins June 1 (starting in the year 2025) and concludes on May 31 of the following year.
· Cost updates for each of the office building models are delivered by the 10th of June, September, December, and March for the relevant option year, unless an extension is granted by BLS. The first month of each option year will be June. The quarterly cost updates will reflect actual changes in costs for materials, installation, and fuels observed in the marketplace since the previous cost update for each region.
One year of ongoing support of quarterly cost changes for the regional models and any quality adjustment information required by BLS due to changes in the regional models. Along with the delivery of the quarterly cost updates the vendor provides an explanation for any significant cost changes due to these updates. In addition, BLS may request information for noteworthy cost changes or for cost information when models or cost updates change significantly.
Performance Measure: The vendor provides written explanations of significant cost changes along with the model updates. In addition, the vendor will provide, with each quarterly cost update, a response to the following questions:
· Was the model reviewed in its entirety for any needed assembly modifications or replacements?
· Does the model and all the assemblies still represent typical construction practices in the respective region since the previous cost update?
· What materials/assemblies/labor costs showed significant changes from the previous cost update?
· Were there any changes to the makeup of the crews since the last cost update?
· Have there been any noteworthy shifts in trends regarding the assemblies included in the model? Are any assemblies becoming more or less commonly used which may require a change at some point in the future?
· Were all the “specifically researched assemblies” updated to incorporate changes in material and labor costs that occurred since the previous cost update?
In addition, BLS may request information for noteworthy cost changes or for cost information when models or cost updates change significantly.
I - Contract Clauses
52.203-12 Limitation on Payments to Influence Certain Federal Transactions. (JUN 2020)

(a) Definitions.
Common parent, as used in this provision, means that corporate entity that owns or controls an affiliated group of corporations that files its Federal income tax returns on a consolidated basis, and of which the offeror is a member.
Taxpayer Identification Number (TIN), as used in this provision, means the number required by the Internal Revenue Service (IRS) to be used by the offeror in reporting income tax and other returns. The TIN may be either a Social Security Number or an Employer Identification Number.
(b) All offerors must submit the information required in paragraphs (d) through (f) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26 U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the IRS. If the resulting contract is subject to the payment reporting requirements described in Federal Acquisition Regulation (FAR) 4.904, the failure or refusal by the offeror to furnish the information may result in a 31 percent reduction of payments otherwise due under the contract.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services. Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to-
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to-
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that-

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services-
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
