Statement of Work (SOW) for Calibration Services
Background:
MSHA’s Approval and Certification Center (A&CC) approves and certifies certain mining products for use in underground coal and gassy underground metal and nonmetal mines.
Technical experts evaluate and test equipment, instruments, and materials for compliance with Federal regulations.
Products evaluated and tested range from extremely small electronic devices to very large mining systems. Following successful completion of evaluation and testing of a product, an approval is issued authorizing a manufacturer to produce and distribute products for use in mines. The MSHA approval issued by the Center is internationally recognized.
The Center also performs other technical functions in support of MSHA's programs where engineering, scientific, and technical expertise is provided to other Agency project areas.
Scope of Work:
Reference Attachment A (A&CC Calibration Bid Sheet) for list of instruments. The COR will provide an updated instruments list to the contractor, as applicable.
The Mine Safety and Health Administration (MSHA) Approval & Certification Center (A&CC) requires calibration of:
electrical measurement instruments such as multi-meters, oscilloscopes, waveform generators, power supplies, chart recorders, RF analyzer, etc.
fluid and gas measurement instruments such as pressure gauges, pressure and barometric transducers, electrical and mechanical flow instruments, anemometers etc.
mechanical and electrical tension, weight, and force instruments such as brake meters, strain gages, dead weight tester, load cells, accelerometers, scales, etc.
miscellaneous instruments such as temperature indicators (both mechanical and electrical), thermometer calibrators, light meters, tachometers, dynablenders, vibration monitors, acidity meters, flash point ignition temperature meters, etc.
measuring instruments such as calipers, micrometers, torque wrenches, gage blocks, dial indicators, compression and tension gauges, depth gauges, pin gages, etc.
Contractor Accreditation:
The contractor must be accredited by a nationally recognized organization for standardization in accordance with ISO/IEC 17025:2017 (General Requirements for the Competence of Testing and Calibration Laboratories) and provide documentation to this regard.
Traceability:
All calibrations must be traceable through National Institute of Standards and Technology (NIST) or another National Metrology Institute to the international system of units (SI units).
A certificate of calibration will be provided for every instrument calibrated. This certificate shall comply with ISO/IEC 17025:2017. In addition, the following information will be included on the calibration certificate:
A&CC Equipment ID number, instrument manufacturer, model number, and serial number;
Calibration date and calibration due date. A traceability statement is provided. Complete before/after measurement data is provided, listing the test name, measured value and test limits for each parameter tested during the calibration process.
Calibration intervals shall be one year
Provide an out of tolerance notification for any instrument found out of tolerance with the manufacturer's specifications. The notification will identify all parameters that are out of tolerance and the margin of error detected.
Contractor Bids:
Contractor must supply a list of instruments that will be subcontracted to other companies. The bid cost for each subcontracted instrument must include all shipping and insurance charges, if any.
Contractor must supply a list of instruments that will be calibrated by the contractor but must be performed off-site. The bid cost for each subcontracted instrument must include all shipping and insurance charges, if any.
Contractor must provide shipping costs for calibration equipment that will be used at the A&CC facility to calibrate the instruments.
A&CC personnel may visit the facilities of all potential contractors to evaluate the suitability of their laboratories.
Calibration Process:
Calibration must be in accordance with full manufacturer's specifications and within the range of the adjustments for each instrument. Instruments that cannot be adjusted to meet the manufacturer’s specifications will be identified with a tag or label. The tag or label shall indicate the instrument did not meet the manufacturer’s specification. Notations such as “reject”, “failed”, etc. are acceptable.
Where part of an instrument’s function is out of tolerance, but the remainder of the instrument functions are in tolerance, a limited certification shall be issued. The limitations of the instrument will be adequately identified on the certification and on the instrument.
Instruments taken off-site for calibration must be signed out by the contractor and returned no later than 30 days from the date taken off-site.
Instruments that will not function and therefore cannot be calibrated will be returned to the Contracting Officer’s Representative (COR). The calibration cost for these instruments will be deducted from the purchase order price. The calibration contractor is responsible for any shipping costs.
Non-functional instruments that can be made functional (for example - replacing dead batteries) will be returned to the calibration contractor for calibration. The A&CC is responsible for any shipping costs. Instruments made functional by the A&CC will be added back to the purchase order price.
Calibration certificates must be delivered within 4 weeks from the start of the on-site calibration process. Calibration certificates shall be provided in portable document (pdf) format on CD/DVD. The instrument identification number shall be the first number in the certificate file name, followed by the instrument type/name and calibration certificate number.
For example: “1193 DEAD WEIGHT TESTER-496235.pdf”.
All on-site calibration must be performed between 8:00 am and 4:00 pm, Monday through Friday. The A&CC facility is closed on US Federal holidays and no on-site calibration can be performed. Scheduling of the calibration will be based upon a mutually agreeable date and time between the contractor and the COR.
The contractor must repair or replace any item damaged by improper handling and/or operation with an equivalent instrument deemed suitable by the COR with cost of replacement at the responsibility of the contractor. If it is not possible to repair or replace an instrument, the value of the damaged instrument will be deducted from the purchase order price. The contractor will not be held liable for instruments which fail to function or become damaged through normal calibration procedures.
Travel Requirements:
Travel shall be in accordance with the Federal Travel Regulations (FTR) and shall be approved by the Contracting Officer’s Representative prior to any travel taking place.
Period of Performance:
Period of performance for this effort shall be for one 12-month base period and four 12-month option periods as follows:

Security:
All contractor equipment, personnel and vehicles are subject to inspection and search by security officials (or designated representatives) upon entry to any government owned and/or operated installations and facilities.
Contractor personnel shall comply with all facility security procedures required to gain access to the facility.
The Government reserves the right to visit and inspect the contractor’s assets/facilities used in support of this requirement.
Authorized Changes:
The Contracting Officer is the only person authorized to approve changes in any of the requirements of this purchase order and notwithstanding provisions contained elsewhere in this purchase order, the said authority remains solely the Contracting Officer’s.

REQUIRED QUOTE CONTENTS:
RFQ INSTRUCTIONS:
52.212-1 Instructions to Offerors –Commercial Products and Commercial Services. Quoters must comply with all instruction contained in FAR 52.212-1, Instructions to Offerors–Commercial Services.
FAR 52.212-1 is supplemented per follow addenda:
Submission shall be submitted prior to the closing date and include the following: name, address, and telephone number of the contractor, unit price, and overall total price, of the item/services being offered in sufficient detail to evaluate compliance with the requirements.
All quotes shall include the following documentation/information:
1. Quoters shall complete Blocks 8 (a)(b)(c)(d)(e) and (f) on the SF 18, page 1. These blocks contain the name and address of the Contractor, signature of the person authorized to sign quotation, and date of quotation. Contractor agrees to hold the prices in its quotation firm for 90 calendar days from the date specified for the receipt of quotations unless another time period is specified in an amendment to the solicitation.
2. The contractor shall also submit completed solicitation provisions and clauses 52.204-24 and 52.204-26.
PLEASE NOTE: All items highlighted in yellow in this RFQ must be completed and returned along with the quote. If these items are not completed and submitted at time of quote, you may be rated technically unacceptable. The Government encourages the quoters to provide discounts from their published pricing.
Quote shall be submitted in accordance with block 10 of the SF 18 via GSA E-Buy.
SUBMISSION DEADLINES:
Quotes shall be submitted by GSA E-Buy NLT 11/02/2022 @ 5:00 p.m. EST.
Note: Contractor is responsible for ensuring that quotes are submitted in accordance with required date and time.
EVALUATION CRITERIA:
52.212-2 Evaluation–Commercial Services shall be used. The evaluation as Commercial Services applies to this procurement and that the Government expect to award a single purchase order resulting from this RFQ to the responsive responsible quoter whose technically acceptable quote conforming to the RFQ will be the most advantageous to the Government, price and other factors considered. The following factor shall be used to evaluate offers:
Factor 1 - Technical
Factor 2 – Price
Acceptable The quote is technically acceptable as it meets and/or exceeds the minimum technical acceptability requirements of the RFQ.
Unacceptable The quote is technically unacceptable as it does not meet the minimum technical acceptability requirements of the RFQ.
The quoter must demonstrate an understanding of the requirement and that their technical quotes must meet the requirements set forth in the Statement of Work.
EVALUATION FACTORS
The Government intends to award a purchase order to the Offeror whose quote for the services described herein conforms to the solicitation and represents the overall best value to the Government based on evaluation of the following factors:
1. Factor 1 – Technical
The Government will evaluate the degree to which the technical approach demonstrates a thorough understanding of the requirements and provides a viable plan and means for successful completion.
2. Factor 2 – Price
The Government will evaluate the proposed pricing for completeness and accuracy. Additionally, the pricing will be evaluated for fair and reasonableness. All proposed prices shall include all anticipated costs to fully perform all objectives as stated in the Statement of Work. Firm-fixed pricing (FFP) shall be proposed for all required pricing.
BASIS FOR AWARD
The Government contemplates award of a single order resulting from this solicitation to the responsive, responsible vendor whose quotation conforms to the solicitation, found technically acceptable and represents the best value to the Government, at a fair and reasonable price.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) of this paragraph in a subcontract for commercial products or commercial services.
