5Is the contractor expected to arrange the travel for claimant if it is needed for the SECOP? Under what scenarios should the contractor arrange the travel instead of the claimant or the government?Yes, the contractor is expected to arrange claimant travel, as needed. The contractor will be reimbursed at the General Services Administration (GSA) Per Diem Rate.
6C.5.1.3. Task 3 - Qualified and Appropriate Medical Specialists,In section C.5.1.3. Task 3 - Qualified and Appropriate Medical Specialists, “all physicians shall possess an M.D. degree, D.O. degree or DPM Degree”; will OWCP request examinations by a Psychologist or Neuropsychologist? If so, will OWCP add a Ph.D. degree to the list?
The language defines the minimal requirements of the Government.
7C.1.5. Period of Performance7. In section C.1.5. Period of Performance, please clarify how the “Transition-In Services” for other contracts is related to the period of performance for the Philadelphia contact.
The period of performance for each OWCP Office location is a Base Period and 3 Option Periods as defined by Seciton C.1.5. Transition-in services.
8B.5, page 5The RFP states that “The Contractor shall provide pricing for services in the format described in the SF-1449 “Solicitation/Contract/Order for Commercial Items”, Blocks 20-26 Schedule of Supplies/Services and Technical Exhibit 3.” The SF-1449 content identifies the scope of the RFP as services only for claimants who reside within the area served by the Philadelphia District Office (Delaware, Maryland, Pennsylvania, and West Virginia). Technical Exhibit 3 is structured by District Office starting with Philadelphia and then a Transition In of the remaining eleven District Offices, which is also identified in PWS Section C.1.5. PWS Section B.2 identifies the quantities in Technical Exhibit 3 as the minimum and maximum estimated quantities and that the contractor shall provide services required for at least the minimum i.e. provide services for all 12 District Offices and not solely for Philadelphia.

It is our assumption that services under a resulting contract will support all 12 District Offices and that proposed pricing shall conform to the format in Technical Exhibit 3 (i.e. pricing by individual District Office using the estimated quantities for totals). Is this assumption correct? If not, please clarify the format for proposed prices.

Yes, the assumption is correct in that services under the resulting contract will support all 12 District Offices and proposed pricing shall conform to the format in Technical Exhibit 3 (i.e. pricing by individual District Office using the estimated maximum quantities for totals).
9B.5, page 5RFP states “all other services will be reimbursed at the OWCP Fee Schedule Rate.” We assume OWCP Fee Schedule Rates pertains to Diagnostic Testing and Procedures, Interpreter Services, and Appointment Cancellation Fees.” Is this correct? If not, please clarify.
Assumption is correct. OWCP Fee Schedule Rates pertains to Diagnostic Testing and Procedures, Interpreter Services, and Appointment Cancellation Fees.
10B.5, page 5Please provide the OWCP Fee Schedule Rate for Appointment Cancellation Fee (Item Number/CLIN 0010).
The OWCP Fee Schedule Rate for Appointment Cancellation is $50.00.
11C.1.3, page 9Please clarify if the services are restricted to the Philadelphia District Office as identified in the SF-1449 or if all 12 District Offices will be supported under a resulting contract (e.g. PWS Section C.1.5, Technical Exhibit 3).

RFP states “The Government’s objective is to procure Medical Second Opinion (SECOP) and Examination services for covered claimants who reside within the area specified in Part 2: Region to be Served/Metropolitan Statistical Area.” This is found beginning on page 22 of the RFP and lists all OWCP Locations. Please clarify if this solicitation is for services serviced by the Philadelphia District Office (states of Delaware, Maryland, Pennsylvania and West Virginia) or all OWCP locations.

The services are not restricted to the Philadelphia District Office but are for all OWCP locations nationwide. Each location will transition in at the specified time per page 11 and 12 Section C.1.5, Technical Exhibit e of the Performance Work Statement.
12C.5.1.3, pages 37-39The solicitation identifies required documents for Physicians and Specialists in PWS Section C.5.1.3 which are to be submitted to DOL. It is our assumption that these required documents are to be provided post-award (i.e. not submitted with the proposal). The solicitation does not state that this documentation is required to be submitted with the proposal and it is not included in the Section L instructions for Volume II. In addition, the quick turnaround time from RFP release (December 15, 2020) to proposal submission (January 4, 2021) which is less than 13 business days indicates that they are not to be provided with the proposal.

Is this assumption correct? If this assumption is not correct, please clarify the proposal submission requirements for these documents (e.g. only for the Philadelphia District Office jurisdiction) and provide an extension as additional time for submission will be required.

The contractor must provide sign and return the Certification and Acknowledgement Statement identified under 52.212-1. The Physicians and Specialists in PWS Section C.5.1.3 which are to be submitted to DOL will be provided to the Government prior to transitioning-in of additional locations.
13G.8, page 88The RFP states “The past performance questionnaire in Section J of the solicitation may be used for this purpose.” A past performance questionnaire (PPQ) is not provided with the RFP and Section L does not outline instructions for PPQs nor does it identify a past performance proposal volume. It is our assumption that PPQ(s) are not required as part of the proposal submission. Is this assumption correct? If not please clarify.

And if PPQs are required, additional time for submission will be required due to the quick turnaround time and end of year schedule for many references.

Past Performance Questionnaire is not required. Please see Clauses 52.212-1 and 52.212-2 for additional instructions.
14J.2, page 129The RFP states “The offeror is required to electronically complete the Company Profile (Attachment J.2) if no relevant past performance exists or previous past performance is not available through the Contractors Performance Assessment Reporting System (CPARS).” Section L does not outline instructions for submission of Attachment J.2 nor does it identify a past performance proposal volume.

It is our assumption that submission of a completed Attachment J.2 is not required. Is this assumption correct? If not, please provide instructions.

All documents are to be submitted electronically in accordance with ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2020). The contractor is not required to submit Past Performance as the Government will use methods available by FAR 42.15 however, for contractors with no relevant corporate past performance, the Government may take into account information regarding the past performance of predecessor companies, key personnel with relevant past performance so the offeror should provide such information as applicable.

15 Section L, page 146 The RFP states “Price quotation (Volume I – Price Evaluation Quotation) which lists all labor categories, hours, hourly rates, and materials required to complete the statement of work requirements on a firm-fixed-price basis, in a Microsoft Excel format.”

The identified contract type is firm fixed price IDIQ for commercial items. PWS Section B.5 states that services shall be provided at a firm fixed price per unit rate and that price is inclusive of any/all labor, indirect costs, materials, pick-up and delivery, ancillary costs and applicable fees. The firm fixed price also includes the notable costs for the medical specialists and physicians across all required and other medical specialties which are not necessarily structured as an hourly rate. The healthcare industry standard for commercial services from private providers is the use of firm fixed prices. For example, the reimbursement methods for healthcare insurance fixed price per service identified by a CPT Code or HCPCS codes.

Request reconsideration of the Volume I instructions to align with the contract type and commercial items (i.e. replace instructions to provide only the firm fixed prices per unit and remove breakout and spreadsheet).

Clarification: Volume 1 Pricing instructions requires submission of only the firm fixed prices per unit for each CLIN. A breakdown of labor, indirect costs, materials, pickup and delivery, ancillary costs and applicable fees are not required however, they should be included in the contractors firm fixed price.
16C.1.2, page 10Please provide the size of records to be reviewed for the Directed Medical Advisor (DMA) File Reviews. What specialty(ies) is required to perform this service?
Physician specialties for Black Lung file reviews are mainly Pulmonology and occasionally Pathology.

Physician specialties for FECA file reviews may include the following, as appropriate:

Cardiology Dentist Dermatology Emergency Medicine General Surgery Medical Toxicology Neurology Neurosurgery Ophthalmology Orthopedic Surgeon Otolaryngology Physical Medicine and Rehabilitation Plastic Surgery Psychiatrist Pulmonology Reviewing Pharmacist Urology Vascular Surgery Internal Medicine Occupational Medicine

17C.4.1, page 26The RFP states “The Contractor shall possess or be eligible to receive all necessary clearances for these services.” Please clarify any clearance requirements and provide further details if clearances are required. And if required, our assumption is that clearances would only be required for contractor staff and not providers. The requirement for provider clearances negatively impacts the ability to recruit and retain providers and reduces the number of willing qualified providers to support the contract.
The Contractor shall ensure compliance with all DOL, OWCP and federal policy and data security guidelines or requirements necessary to access the OWCP's systems and will promptly address any misuse of information obtained through the access of the DOL applications or data, logon ID, password, or any other protected information.
18C.5.1.4, page 44Please provide the turnaround time requirement from date of receipt of referral to date of delivery of completed report for Black Lung Pulmonary Services, Directed Medical Advisor (DMA) File Reviews and File Review Only.
Please see Section 5 Task and Government's Performance Requirements Summary.
19C.5.1.4 and C.5.1.6, pages 46 & 48On page 46, the RFP states “When the government notifies the Contractor that the report does not meet the government’s requirements, the Contractor shall take immediate action within forty eight (48) hours and obtain clarification from the physician/specialist at no additional cost.” On page 57, it states the contractor shall submit an acceptable addendum report within twenty-one (21) days. It is our assumption that the contractor shall reach out to the provider within forty eight (48) hours of notification and deliver the addendum report addressing the clarification within 21 days of notification. Is this assumption correct? If not, please clarify.
The assumption is correct.
20G.3, page 85Please clarify when the following process is applicable to the required services as this language appears to apply to treating physicians:

• “In some cases, however, bills are submitted to the employee’s health insurance carrier. The carrier may request reimbursement for such charges by submitting a completed OWCP-approved form.”

• “An employee who has paid a provider may request reimbursement by submitting either receipted bills from the provider or a OWCP approved form signed by the provider. Hospital bills must be stamped paid or otherwise certified to indicate that payment was made. Cash sales receipts that bear imprints of mechanical cash registers may be accepted if the nature of sale is identified. Photocopies of cancelled checks may be accepted in lieu of receipts but must be accompanied by itemized bills or other evidence of the charge for which payment was made. Prescription receipts must include the name of the drug and the date the prescription was filled.”

Clarification: "When appropriate and in some cases bills are submitted to the employee's health insurance carrier. The carrier may request reimbursement for such charges by submitting a completed OWCP-approved form."An employee who has paid a provider may request reimbursement by submitting either receipted bills from the provider or a OWCP approved form signed by the provider. 21I.3, page 104Please delete FAR 52.222-41, Service Contract Labor Standards. This is a contract to be performed overwhelmingly by physicians, who are not “service employees.” In addition, Wage Determination(s) are not provided with the RFP.The Government considers a Physician to be a “Professional Employee” in accordance with 29 CFR 541. The term “Professional Employee,” means any person meeting the definition of “employee employed in a bona fide . . . professional capacity”.

The the Service Contract Act (SCA) does not cover bona fide executive, administrative, or professional employees. As a result, Federal Acquisition Regulation (“FAR”) Part 52.222-41—Service Contract Act of 1965 and the corresponding Wage Determination requirement of FAR 22.1007 do not apply to Solicitation Number 1605C3-21-R-00003.

22 I.3, page 105 Section I.3(e)1 of the RFP requires the Service Contract Act clause as a flow down to subcontractors. Offeror requests removal of the Service Contract Act and related clauses. This is a contract to be performed overwhelmingly by physicians, who are not “service employees.”

Since the Act requires the payment of minimum compensation for work performed under the contract, and recordkeeping to prove that such compensation was paid, the compliance burden for the average medical practice would be burdensome. The flow down of the Act will make it very difficult to obtain medical practices as subcontractors.

The physicians themselves are exempt from the Act as “professionals.” 29 C.F.R. § 541.304 (a) & (b). Moreover, some nurses and physician assistants are also exempt. 29 C.F.R. § 541.301(e). Other nurses and medical technicians are apparently covered, and will have to be paid the minimum compensation in the wage determination applicable to their locality. These individuals may work for the prime and/or a subcontractor. In addition, other individuals performing duties on the contract may be exempt as “administrative” workers.

Please see response to Question 21 above.
25J.2, page 129It is our assumption that completion and submission of Attachment J.2 is not required as there are no instructions for inclusion and there is no separate past performance volume. Is this assumption correct? If not, please clarify.
Please see revised language under Section 52.212-1 and 52.212-2.
