QuestionAndAnswers - Heavy Construction Sheet
Question # Question Title RFQ Section Number/Page Number Vendor Questions Government Comment
1 FPIF Contract Box 20. Schedule of Supplies/Services How does a for profit contract affect a non-profit (501C3) organization, is the profit considered unintended business income (UIB)?
This answer would vary for different organizations.
For most organizations, unrelated business income is income from a trade or business, regularly carried on, that is not substantially related to the charitable, educational, or other purpose that is the basis of the organization's exemption.
2 Key Personnel Pg. 11, 1.7.8 Current key personnel titles do not line up with the list in the solicitation, can we use our personnel titles?
The offeror may use alternate titles, but the vendor should clearly indicate which position is responsible for directing/managing the programs, performing the functions of field coordination, and who is handling the accounting/invoicing functions
3 Program Offerings Pg. 21, bottom chart Turner Advanced Asphalt Slots lists 10 slots. The program is 10 Full-Time slots and needs to be described as such so the center operator is aware of the correct slot count.
In accordance with PRH Chapter 3.1 Training Management, R11, Advanced Training enrollees must hold a high school diploma or have obtained a HSE certificate. As such, all Advanced Programs within Job Corps are considered "Full-Time" slots.
4 Training Outcomes Pg. 23, 5.3.2, last sentence
Solicitation states "When apprenticeship exams are required for placement into affiliated apprenticeships, the NTC shall ensure that all students have passed the exam prior to graduation. Instructors shall certify that students have completed necessary training and certification (s)to fulfill program requirements." The Job Corps program is competency based and not all students will be able to pass said apprenticeship exams, thus how can we ensure that all students pass the exam?
To clarify - this requirement only applies to those students whose career pathway involves placement into a Registreed Apprenticeship Program. If placement into a RAP requires a student to pass a test, then the contractor will ensure the student takes and passes the required test prior to graduation.
5 Due Date Pg. 1, box 8
The solicitation was pubished on the evening of May 3, 2023 with a due date of May 26th @ 12:00 p.m. This is a total of 22 days to prepare and submit a proposal, however only 17 working days. We are requesting a 10 day extension, is that possible?
The due date has not changed.
6 Incentive Fee Pg. 52
It states amount of incentive fee you will receive based upon the overall CTT10 performance. How is the incentive fee established; if you have an A rating we would get 100% of what? Is it based upon a percentage of the target price total for a contract year, if not what is it based upon?
The incentive fee is established by taking the difference in the Target Cost and Actual Cost.
Incentive fees are also associated with performance.
Please review Section B of the slicitaiton for more information on cost underruns and overruns. Also review Technical Exhibit 3 for more information on the performance measures.

7 FPIF Contract Pg. 1
Does this type of contract allow for realignment of CLINS in the event an unexpected increase of cost takes place in a CLIN? For instance an insurance carrier unexpectedly raises insurance cost. Or will we be required to request a modification?
This contract will allow for budget realignments.
8 FPIF Contract Pg. 1
Will contract funds be distributed the same and will we bill DOL the same;
DOL provides incremental funding, contractor invoices DOL monthly through IPP for cost and DOL deposits monthly invoice amount into contractor account?
Correct. If you are a current incumbent contractor this will be the same.
9 FPIF Contract Pg. 1 Will the contractor need to set up a system to track the overruns and underruns to monitor profits or losses throughout the contract year?
The government will track this information on our end and the expectation is that the contractor tracks this information too.
10 FPIF Contract Pg. 1 Will all contract obligated funds that are not spent in a Contract Year returned to the government or will the balance be considered an underrun and shared 75/25?
Please review Section B of the solicitaiton to see how contract underruns will be calculated.
11 FPIF Contract Pg. 1 If property is purchased with funds from a contractor's profit, will that property be owned by the contractor vs. government owned property?
All property purchased using government contract funds will be government owned property.
12 Procurement and Transportation of Equipmet Pg. 38 This is a national contract, why is it being required to notify the Regional
Office COR/PM of equipment purchases approved by the NTC COR?
This requirement is to ensure that full communication is shared by all stakeholders, and also sends a clear message to center operators that the equipment will be on the NTC property book (EPMS) and not on the center operator proerty book. Including the Regional Office COR/PM on the cc line of any equipment purchase requests submited to the NTC COR may satisfy this requirement. The vendor may also "inform" the center operator of equipment purchases through other means, such as weekly center/staff meetings.
13 Uniforms Pg. 39, 5.11.2
Uniforms are added to the NTC solicitation. Does this include shirt and pants only, or does it also include winter coats, gloves, workboots, and coveralls? This clarification is needed so that an appropriate cost can be determined and the NTC and center operator are clear on which entity is responsible for each of these Items. If the items do include boots, coats, gloves, hats, etc. the NTC will have to purchase storage cabinets or storage buildings to store the items.
Refer to PRH Chapter 3.4. Career Success/Workplace Skills, R4 "Dress Code/Clothing Selection" paragraph "c" for guidance. If the clothing/shoes are required to perform work for the trade, then the NTC shall provide the items.
14 Cost Analysis Section B Is Indirect Cost/Overhead still entered on a separate CLIN on a detailed cost analysis?
Yes.
15 Detailed Cost Analysis Section B Do we still provide a detailed cost analysis on forms 8554 and 8555? If not what forms are required for the detailed cost analysis and pricing?
These forms are not required, but they can be used.
You are only required to provide your detailed costs on a MS Excel spreadsheet.
16 SAM.gov Pg. 108, Volume III, #3 Directions state to submit information generated from SAM website. What information do we are we required to submit from SAM.gov website?
This references your SAM.GOV registation. Also, your representations and certifications.
17 WBL Performance Threshold Pg. 45
80% goal for students to achieve 80 hours of WBL will be a challnge for our students, as WBL in our industry requires a person is 18 years old. Not all our students during their tenure meet this age requirement. Also, many centers are located in rural areas that are not near WBL employers and necessary staff to transport to WBL is not feasible, in addition to the hours spent in travel time. Will there be any exceptions to this performance threshold?
If the vendor can demonstrate that these goals are not feasible at a given center, then provide within the offer reasonable measurements that can be achieved.
