About this file
This document contains a request for proposal for expansion of registered apprenticeship programs through industry intermediaries in emerging industries. The Department of Labor seeks to award multiple time and materials contracts to industry intermediaries to promote development, launch, and expansion of registered apprenticeship opportunities in emerging industries that have not traditionally utilized registered apprenticeship. The base period of performance is June 2023 through June 2024 with four optional one-year periods. The solicitation is set aside for small businesses. Incumbent registered apprenticeship intermediaries currently under contract with the Department are ineligible to apply as prime contractors or subcontractors. The document provides responses to clarification questions regarding requirements, pricing, evaluation factors, and other terms of the solicitation.

Request for Clarification (RFC) Reponses for RFP 1605C2-23-R-00006
1. On page 73 (F.2.2 Factor B), it is requested that the proposal detail the approach for the Tasks described in Section D.4 and Deliverables in Section D.5. Where are those two sections in the document? Should the reference possibly instead be to page 24, Part 5 Specific Tasks and more specifically, the Tasks 2-9? Or should the reference be to Technical Exhibit 2, the Deliverables Schedule, which also includes tasks?
Response: Proposals must detail the approach for the Tasks described in Part 5 of the RFP.
2. Also, in Technical Exhibit 2, page 38, Task 2 requires a “minimum of 75” of certain events. On page 25 for Task 2, it says a “minimum of 50”. Please clarify the amount required.
Response: See updated PWS issued as part of Amendment 0001.
3. In Technical Exhibit 2, there is missing a Task 2: page 34 has Task 1 and then page 35 shows Task 3. Is there supposed to be a Task 2?
Response: See updated PWS issued as part of Amendment 0001.
4. Technical Exhibit 1 and 2 contains duplicate information (e.g. participate in kick-off meeting) – was that intended?
Response: Technical Exhibit 1, is the Performance Requirement summary. The Vendor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success. Technical Exhibit 2, is the Deliverable schedule.
5. One last thing, the grant number on page 1 and page 68 are not the same (22 and 23).
Response: The solicitation number is 1605C2-23-R-00006.
6. The Expansion of Registered Apprenticeship (RA) Programs through Industry Intermediaries: Emerging Industries solicitation (1605C2-23-R-00006) states on page 10 that, “Current RA Intermediaries under contract with the Department cannot apply as the prime or a sub-recipient.” We have several questions related to this procurement limitation.
A. Especially for emerging RA industries, it would seem to be very helpful to have experienced apprenticeship intermediaries able to apply, as either a prime or a sub-recipient, given their experience with RA business development, registration, stakeholder technical assistance, and related issues. Currently, per the RFQ’s statement on eligibility on p. 10, the extensive expertise of current RA Intermediaries will not be able to be leveraged by the Department in service of growing RA in these industries. Can the Department reconsider its position and permit current RA Intermediaries under contract with the Department to apply as the prime or sub-recipient?
Response: No. The eligibility requirements established by the Department will not be changed.
B. Relatedly, the statement on eligibility in the other RA intermediary RFQ, for established RA industries (1605C2-23-R-0004), allows for current RA Intermediaries to apply as a team member on intermediary bids for the identified industries, while the RFQ for emerging RA industries (1605C2-23-R-0006) does not. It would seem to us that current experience as an RA Intermediary would be helpful to a prime in either Tier, but again, this would be the case even more so in an emerging RA industry. Can the Department reconsider its position on eligibility to allow for current RA Intermediaries to apply their expertise as a team member, if not also as a prime, in an application for an RA Intermediary in an emerging industry?
Response: No. The eligibility requirements established by the Department will not be changed.
C. The limitation outlined on page 10 of the Emerging Industries Intermediaries contract indicates that current RA intermediary contract holders may not apply as a prime contractor or as a sub-recipient. The federal code describes a sub-recipient as a non-federal entity that receives a subaward from a pass-through entity to carry out part of a federal program, but does not include an individual that is a beneficiary of such a program. Given this is a contract, is it possible for an existing RA intermediaries contract holder to fill a directed support role in a proposal as a sub-contractor? That is, the subcontracted entity would not have the authority to make decisions regarding the delivery of service, operations, or types of assistance provided within the terms of the agreement, as those authorizations are typical of a sub-recipient.
Response: No.
7. Given the due date for Requests for Clarifications, and accordingly the likelihood that the answers to technical questions will be posted closer to two weeks of the proposal due date, would the government consider an extension to May 26th to allow bidders time to adjust their responses?
Response: Proposal due date has been extended to May 26, 2023 at 11:00am EST; please refer to Amendment 0001 for revision.
8. In the description of Content Requirements on p 69, the RFQ states that each volume must include a Table of Contents. On p. 70, under Instructions for Technical Proposal Response, the RFQ references inclusion of either a proposal index or table of contents and then later states a requirement for a Proposal Index for the technical proposal. Can the Department please confirm that a Table of Contents for each volume is sufficient?
Response: Yes.
9. The Pricing Tables in Section B include line items for Consultants and Subcontractors under CLIN 0002. Are bidders permitted to include those costs outside of or in addition to the labor categories and associated labor hour projections described in CLIN 0001? If so, could the government please explain how that technical involvement of consultants and subcontractors differ from the role of the named labor categories under “Description of Work?” If consultant fees and subcontractor costs are permitted separate from the personnel hours, is there a limitation on those amounts for each year of this contract?
Response: Vendor can propose consultant fees and/or subcontractor costs outside of the Labor Categories. Vendor should review the PWS and propose its costs accordingly.
10. For the project references required under Factor A – Relevant Corporate Experience (pp. 72-73), may we include project references from both the prime applicant and its subcontractors/partner organizations?
Response: Yes.
11. May for-profit entities apply to Requisition 1605C2-23-00006, Expansion of Registered Apprenticeship Programs through Industry Intermediaries: 2023 Emerging Industries?
Response: Yes.
12. What is the definition of “target populations” referenced on pages 14 and 29 of the Request for Quote? This term is used in reference to the required 50% of apprentices to be served from underrepresented populations (comprised of at least two target populations)
Response: Vendor must identify two target populations from underrepresented populations (which may include women, people of color, and individuals with disabilities, as established in §29 Code of Federal Regulations [CFR] Part 30, where that population’s participation in RAPs is significantly less than would be reasonably expected given the availability of such individuals for Apprenticeship in the relevant industry, occupation, or recruitment area) and underserved communities (including veterans, justice-impacted individuals, youth, and those in rural communities) will be critical to advance RA.
13. When are the resumes of key personnel due? Page 24 notes resumes are to be submitted “within 30 days of contract award” and page 69 includes resumes for key personnel as part of the Technical Proposal.
Response: For the purpose of this RFP, resumes must be submitted as part of the Technical Proposal. For the purpose of Work plan implementation, the Vendor shall ensure Contracting Officer Representative receives all resumes for Key Personnel within 30 days of contract award.
14. May RA intermediaries under a current grant agreement with the Department apply to this solicitation? We are seeking confirmation of the exclusion of RA intermediaries under a federal contract with the Department referenced on page 10, not a grant agreement.
Response: As detailed in the PWS under the Background section, only current RA Intermediaries under contract with the Department cannot apply as the prime or a sub-recipient.
15. Will the Department provide the systems/platforms for webinars, podcasts, accelerators, trainings, etc. or are the technological tools to provide these deliverables to be built into the pricing of the contract?
Response: Vendor should build into its proposed pricing systems/platforms to host events, training, technical assistance, etc.
activities.
16. For Requisition 1605C2-23-00006, Expansion of Registered Apprenticeship Programs through Industry Intermediaries: 2023 Emerging Industries, may for-profit entities apply? The solicitation states that the Department “intends to invest in Industry Intermediaries (e.g., Industry Associations, Workforce Intermediaries, Unions and Joint Labor-Management organizations, national or state-wide college systems or consortia of colleges, nonprofit organizations, organizations, and others). We are unsure whether for-profit entities are included.
Response: Yes, the RFP is open to for-profit entities. Current RA Intermediaries under contract with the Department cannot apply as the prime or a sub-recipient.
17. In reviewing the RFP, on p. 10, we noted that "Current RA Intermediaries under contract with the Department cannot apply as the prime or a sub-recipient." We understand that there is a precedent of at least two current Intermediaries serving as both prime and sub-recipients on Intermediary contracts. We also appreciate the Department would want the prime to have the industry and apprenticeship expertise to deliver. Will the Department allow a current RA Intermediary to apply as prime for a different field if they can demonstrate both the industry expertise and the apprenticeship expertise?
Response: No. The eligibility requirements as established by the Department for this RFP will not be changed.
18. Page 69 table, is there a page limit for each factor (Factor A and Factor B), or combined they should be a total of 40 pages?
Response: Factors A and B are limited to 40 pages, since resumes of Key Personnel are excluded from the page count.
19. Page 69, Factor A - Relevant Corporate Experience - “Provide a maximum of 3…”. Can the government please clarify if the 3 projects should be the same as the Volume II Business, Factor D - Past Performance projects or if they can be different?
Response: Yes, the relevant corporate experience can be the same as the Past Performance submitted. If the Vendor does not have a Past performance from one of its relevant corporate experience, the Vendor can submit a different Past Performance for project that are similar to the scope (nature and size) of this RFP’s statement of work.
20. Page 71, “contractor past performance will be based on data from CPARS, for at most, three (3) most recent relevant contracts.”
Can the government confirm that if the contractor has all 3 CPARS they only need to include the CPARS and don’t need to complete the PPQs?
Response: Yes, the PPQs will not have to be completed and submitted if the CPARS are available for the most recent relevant (similar in scope) contracts.
21. Will the government consider extending the submission date by at least a week, since the response to these questions will have an impact on the ability to prepare a quality response?
Response: Proposal due date has been extended to May 26, 2023 at 11:00am EST; please refer to Amendment 0001 for revision.
22. Pg 10 states: “Current RA Intermediaries under contract with the Department cannot apply as the prime or a sub-recipient.” Does this include only RA Industry Intermediaries or all RA Intermediaries including RA Youth Apprenticeship Intermediaries?
Response: Current Intermediaries, for purposes of this RFP, include both Industry Intermediaries and Youth Intermediaries under contract with the Department.
23. Pg 17 lists the Key Personnel categories. If multiple individuals are included in a Key Personnel labor category, is each of those individuals Key Personnel, or just a single person in that labor category? For example, because at least 2 individuals will be required to fulfill the 2,300 “Marketing and business development specialist” labor hours, are they both required to be listed as Key Personnel?
Response: All individuals listed within a Labor Category are considered Key Personnel.
24. Pg 25, Task 2 describes 5 sets of 50 individual outreach and informational sessions per year. Can these efforts overlap? For example, could a session for industry associations and Minority Professional and Trade Organizations and Associations meet one of the requirements for both the 1st and 4th bullets?
Response: Yes.
25. Deliverables table
a. Pg 38 lists Task 2 deliverables 2A-2E as 75 individual outreach and informational sessions per year. Please confirm that each of these should be 50 efforts, not 75, consistent with the Task 2 description on pg 25.
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
b. Pg 39 lists the Task 3 requirement of enrolling 1,000 apprentices in the base period. Please confirm that this number should be 400, consistent with the Task 3 description.
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
c. Pg 39 lists the Task 4 requirements as 10 Accelerators and 4 Career Fairs per year. Please confirm that these numbers should be 5 and 2, respectively, consistent with the earlier Task 4 description.
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
26. On Pg 46, 52.232-7 a) 2) states “The amounts shall be computed by multiplying the appropriate hourly rates prescribed in the Schedule by the number of direct labor hours performed” and the Schedule is referenced several times over the next several pages.
What is the Schedule to which this refers?
Response: The information needs to be submitted in Section B. An excel spreadsheet can be provided as a backup for the information in Section B.
a. Is it the table outlined on pages 4-8?
Response: Yes.
b. Are contractors with approved GSA schedules required to use those approved rates?
Response: This is an open market procurement, the approved rates under your GSA contracts are not required. As detailed in the solicitation ANY/ALL DISCOUNT IS HIGHLY ENCOURAGED.
27. For Past Performance evaluation (pg 70-71):
a. Are the contracts required to be complete? Or, does a current contract with past base/option years assessments in CPARS meet this requirement?
Response: No, the contract does not have to be completed, however as detailed in the solicitation “references must be in relation to work that was at least six months in duration and was performed within the last three years”.
b. If a contractor has 1 or more subcontractors, is one of the 3 past performance references required to be from a subcontractor, or is that optional?
Response: The past performance information is for the prime contractor.
c. If a contract began more than 4 years ago but was active and completed within the past 4 years, can it be cited in the past performance section?
Response: References must be in relation to work that was at least six months in duration and was performed within the last three years
28. Pg 72, Factor F, pricing response. Please confirm that the hours for the base and option years should be 11,560 and 11,360, not 13,740 and 13,540 as listed.
Response: Please refer to the revised Pricing Response – Factor F: The offeror shall complete the five (5) Pricing Tables in Section B, for the one (1) year Base & four (4) Option periods, by multiplying their Hourly Labor Rate times the Estimated Number of Hours given in the Pricing Table for each Direct Labor Category to get a total cost for each Direct Labor Category. Offeror must use the Estimated hours given in the Pricing Tables, and the submitted number of total hours for; the 1-year Base must equal 11,560 hours, and for each of the four (4) Option years must equal 11,360 hours. Offeror can submit more than one (1) person for each Direct Labor Category, but the total number of shared hours must add up to/equal the total Estimated Hours given in the Pricing Table for that Direct Labor Category. The Offeror shall provide their Labor Category Descriptions and Hourly Rates that most closely match the Labor Category Descriptions given in this Request for Proposal (RFP) Pricing Table.
29. Per section c on page 72, if offerors submit more than one person for a labor category, can their rates differ?
Response: The rate is based on the labor category not the individual person.
30. For Offeror Representations and Certifications – Commercial Items (pg 72) no page number is given after the reference to Section F.2.7. Can you please confirm?
Response: Confirmed.
31. For F.2.5 Factor E (pg 75) are businesses to provide a statement attesting to their socioeconomic group?
Response: The offerors can provide this information however it is not required. The Government will validate through SAM.GOV.
32. May offerors add additional labor categories to their pricing tables to better reflect their available labor mix? Alternatively, may offerors deviate from the labor categories shown in Section B (pp. 4-8) to allow for more flexible and responsive pricing?
Response: No. The Vendor should map (to the extent possible) the labor category given in the pricing table to its labor mix.
33. May offerors add additional lines to their pricing tables for their indirect costs and applicable fees? 52.232-7 (b)(1)(ii)(D) lists Applicable indirect fees as a material cost, but (a)(4) states “hourly rates shall include wages, indirect costs . . .”.
Response: The submitted should be fully burdened. Any additional fees may be submitted under separate line items.
34. If a contractor’s cognizant agency allows for the application of indirect costs on non-labor items (Travel, ODCs, Subs), may those elements be included in the cost proposal?
Response: Yes. Any additional fees need to be clearly reflected as separate line items in the table provided in Section B.
35. Are the ‘NTE’ amounts in Section B for Supplies and Travel to be considered illustrative or definite?
Response: Definite.
36. Would deviations from the LOE totals in Section B jeopardize a best value determination in the Government’s price evaluation process?
Response: A justification for any deviation needs to be included as part of the submission.
37. Is a budget narrative required as part of the Business Volume?
Response: No.
38. Are letters of commitment required by subcontractors for the proposal? If so, in which volume should they be included?
Response: Letters of commitment can be provided but are not required. If provided they should be included in Volume I.
39. Can you confirm whether subcontract labor hours should be captured in labor category (top) section of the prime’s pricing table, or simply in the Subcontracts line under OTHER DIRECT COSTS? How should this work if some key personnel roles are fulfilled by subcontractor personnel?
Response: Yes, those should be captured under the labor part of the table for the corresponding labor category. The ODCs, subcontractor field, applies to any fees.
40. Page 10 of the Solicitation states, “Current RA Intermediaries under contract with the Department cannot apply as the prime or a sub-recipient.” Please define current RA Intermediaries. Does this include youth apprenticeship intermediaries funded in 2019 or limited to the Industry Apprenticeship Intermediaries funded in 2020 and 2021. Industry Intermediaries to Expand Registered Apprenticeship Programs (2020 funded) under Original Opportunity Notice:¿1630DC-20-R-00020 and the Expansion of Registered Apprenticeship Intermediaries (funded 2021).
Response: See response to Question 22.
41. Page 25 of the Solicitation states Task 2 includes a minimum of 50 outreach meetings, 50 information meetings, etc. However, the deliverables schedule on page 38 indicates the number is 75 for each. Please clarify if the contractor is to conduct 50 of these meetings or 75.
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
42. Page 10 of the Solicitation states the contractor is responsible for 400 new apprentices in base year and 600 thereafter. However, the deliverables schedule on page 39 states contractor is to recruit and enroll a minimum of 1,000 registered apprentices. Please clarify if it is 400 or 1,000.
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
43. The deliverables schedule on page 39 indicates the requirement of 10 Apprenticeship Accelerator meetings. On page 27, the number is 5. Which is correct?
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
44. The deliverables schedule on page 39 indicates the required number of Career Fairs is 4. On page 27, the number is 2. Which is correct?
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
45. The deliverables schedule on page 42 indicates the required number of one-time incentive funding for partners is 15. On page 31, the number is 10. Which is correct?
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
46. Is there a page limit for the business volume?
Response: No.
47. May offerors include additional responsive information in the Business Volume beyond the Factors listed on page 69 of the solicitation (Factor D, Factor E, Factor F and the Reps & Certs)?
Response: Yes.
48. May the Reps & Certs be included as an appendix to the business volume?
Response: Yes.
49. Should the Transmittal Letter be placed in both the Technical and Business Volumes?¿ If it should only be included in one volume, which one?
Response: It should be included in Volume I, however it can be included in both volumes.
50. Are Past Performance Questionnaires required of all vendors, or only those without sufficient CPARS records?
Response: PPQs are required if the CPARS are not available for the most recent relevant (similar in scope) contracts.
51. Shall FAR Clause 52.212-3 be completed by all offerors whether or not registered in SAM.gov?
Response: You MUST be registered in sam.gov at time of award. An award CANNOT be made to any offeror that is NOT registered in SAM.
52. Can the organizational chart and tables be on non-numbered pages?
Response: As detailed in the solicitation, for the Technical proposal, a 40-page limitation has been set. Excluded from this limit is the title page, proposal index or table of content, list of figures and abbreviations, organizational charts and Resumes of key personnel.
53. On page 10 of the Tier 1 RFQ it says: “Current RA Intermediaries under contract with the Department cannot apply as the prime or a sub-recipient.” We define sub-recipient differently than sub-contractor. Can DOL define sub-recipient in this context? Page 10 Response: For purposes of this RFP, sub-recipient is synonymous with sub-contractor.
54. Given the importance of experience in running registered apprenticeship intermediaries, can DOL confirm the statement above and that it intends to restrict organizations with intermediary experience from subcontracting or supporting bids in any capacity? Page 10
Response: Please refer to the responses to Questions 6, 14, 16, 17, and 22.
55. Does the DOL have an overall budget amount (or budget ceiling) for the education sector intermediary?
Response: This information will not be provided.
56. How many awards does the DOL plan to make in each sector?
Response: This information will not be provided.
57. If there is one intermediary for the education services sector, is there an expectation to recruit apprentices for all NAICS codes on page 11? Page 11
Response: The Department’s expectation of intermediaries under this contract award is to expand Registered Apprenticeship in its sector based on employer and industry sector demand.
58. How flexible are the NAICs codes in each category on page 11? For example, Teacher Assistants are included under ECE, but could be part of an ed services career pathway. Page 11
Response: The Department’s NAICS code focus are listed within Figure 1. Any deviation and/or expansion from that NAICS code must be approved through the Contracting Officer Representative after contract award.
59. The parentheticals after “Education Services” on page 11 (and elsewhere) imply that the Education Services intermediary is supposed to include the pre-K teacher occupation, but that NAICs code is under the early childhood education category. Please clarify.
Response: While it is the case that Pre-school / Pre-K teachers, except special education are predominantly employed in NAICS 6244 Child Care Services and a substantial portion (over 15%) are employed in either local public, or private elementary and secondary schools. So the occupation is found in both industries—when viewed by occupational employment across industry. The information was just presented by the primary employing industry, but it is not the sole employing industry.
60. Will the DOL please confirm the metrics in the Deliverables table on pages 37-42 as they do not align to the task write-ups in the RFP (e.g., 2A-2E notes “75 sessions” in the table, but notes “50 sessions” in the task write-up on page 25; 3D, 4A, and 4B also conflicted with the task write-ups)? Pages 37-42
Response: Please refer to the revised PWS incorporated as part of Amendment 0001.
61. On page 13, the RFP notes that the vendors shall “obtain commitments to train at least 400 new apprentices.” Does this mean that the 400 new apprentices do not need to be fully registered by the end of the year, as long as there is an employer commitment to register them? Page 13
Response: While incentive funding can be used to support employers who commit to recruit, register, and train an apprentice, the vendor cannot count that participant towards the total # of new apprentices, until the apprentice is registered in a Registered Apprenticeship program.
62. What will the target number be for new apprentices in option years 3-5? Page 14
Response: For Option Years 2-4, each Vendor shall recruit and enroll a minimum of 500 new registered apprentices during each PoP.
See Task 3 for additional information.
63. The RFP notes that a copy of the “proposed agreement” must be provided for any consultants or subcontractors. Would this include the agreed upon scope of work and their budget, and where should the agreement be included in the proposal (e.g., as an attachment in Volume I or should those be included in Volume II)? Page 74
Response: This information should be included in Volume I.
