J&A Number 16-15
JUSTIFICATION AND APPROVAL (J&A)
FOR OTHER THAN FULL AND OPEN COMPETITION
Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below:
JUSTIFICATION
1. Identification of Agency and Contracting Activity.
Department of the Navy, Office of Naval Research (ONR)
2. Nature/Description of Action.
This J&A requests authority to issue a sole source modification to extend the ordering period for the Indefinite Delivery Indefinite Quantity (IDIQ) contract N00014-10-D-0062 with Concurrent
Technologies Corporation (CTC). CTC is currently performing under the Navy Manufacturing
Technology (ManTech) Metalworking Center (NMC) of Excellence.
The ordering period extension will allow for new ManTech projects executed on a Cost Plus
Fixed Fee (CPFF) or Cost Share basis.
The extension will allow CTC to process all currently identified new projects and to process any future projects that fit within the general scope of the contract through the extended ordering period end date.
The period of performance for the proposed action is six (6) months. The action will extend the ordering period of the IDIQ award from five (5) years to five (5) years and six
(6) months.
The proposed contract action will not increase the contract ceiling for the existing IDIQ contract awards which has a maximum ordering amount of $99,000,000.
The fiscal year (FY) and appropriations associated with the proposed actions will be
FY15 and FY16 Research Development Test and Evaluation (RDT&E) funding. The
Program Element (PE) for FY15 is 0708011N and FY16 is 0603680N.
The authority to act on this J&A expires on 15 Aug 2015.
3. Description of Supplies/Services.
N00014-10-R-0001 was published on FedBizOpps on 25 Jan 2010. The solicitation was published IAW Section 2501(a) of United States Code (USC) Title 10 which requires that
ManTech solicitations be issued on a competitive basis.
J&A NUMBER 16-15
N00014-10-D-0062 J&A 2
CTC was awarded N00014-10-D-0062 on 16 Aug 2010 for the NMC. The effort requires CTC to identify, develop, and facilitate the deployment of potential solution sets to United States (US) shipyards and other industrial facilities, i.e. metalworking or related manufacturing technologies to reduce the cost and time to build and repair key naval platforms.
CTC performs all supporting functions for the Center of Excellence (CoE), which includes serving as a corporate repository of expertise, performing special projects, conducting industry surveys, planning and conducting outreach activities to increase awareness of the NMC, disseminating manufacturing technology throughout the nation’s shipyards and industrial base, and performing any other within scope requirements as assigned by the ONR ManTech Division.
Attachment 1 to this J&A provides a list of NMC ManTech projects that are in various stages of planning that have the potential to be developed and awarded during the extended 6 month period of performance contemplated in the J&A.
4. Identification of Statutory Authority.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1).
The Federal Acquisition Regulation is 6.302-1 entitled, “Only one responsible source and no other supplies or services will satisfy agency requirements.”
N00014-10-R-0001, the solicitation upon which resultant contract N00014-10-D-0062 was awarded, did not include FAR 52.217-8. As such, the contractor did not provide pricing for any period of time after 15 Aug 2015. The six month extension contemplated under this J&A is considered a new acquisition upon which a J&A IAW10 U.S.C. 2304(c) (1) is required.
5. Demonstration of Contractor’s Unique Qualification or the nature of the acquisition requires use of the cited authority.
The ManTech work contemplated during the extension period under this J&A is for critical research and development in support of Navy Metal Working Center (NMC).
CTC is uniquely qualified to continue their work for an additional 6 months.
CTC NMC program staff is knowledgeable in ManTech program execution (Center Operations and Project Development) and have over 10 years of technical expertise on various NMC platforms including CH-53K, CVN, DDG-51, Joint Strike Fighter, and various submarine class programs.
CTC has well developed relationships with shipyard contractors, various major platform suppliers, and well established prime/sub agreements in place to execute projects efficiently.
CTC also has access to commercial and military shipyards and appropriate clearances for the specific projects/platforms. CTC is part of Integrated Project Teams in which they have developed relationships with other NMC stakeholders to meet mission requirements.

N00014-10-D-0062 J&A 3
In addition, CTC has met or exceeded contract requirements and has no negative information entered into FAPIIS, PPIRS, or SAM under N00014-10-D-0062.
Based on this information, CTC is uniquely qualified to continue projects in Attachment 1 which are tied to specific transition window(s) in the ship and submarine production schedules. Failure to initiate the projects in a timely fashion will result in the inability of the ManTech Program
Office to meet critical cost reduction measures on the platforms. Note that program cost reduction is included in Section 2501(a) USC Title 10 – Armed Forces.
6. Description of Efforts to Ensure Other Potentials Sources Were Sought.
Market research has been performed as part of the acquisition process for N00014-15-R-0005, which is the solicitation for the follow on NMC IDIQ. The market research performed under the solicitation is germane to the current contract extension since it is for the same requirement.
Specifics on market research results are protected by FAR 2.101 and 3.104 Source Selection
Information and will not be discussed in this document; however, results can be overtly discussed.
Market research included a review of past NMC solicitation responses to determine if competitive proposal(s) were or were not received, publication of a DRAFT solicitation on
FedBizOpps (FBO), and request for capabilities statements from contractors with the capacity to operate the CoE.
The Contracting Officer published a DRAFT solicitation on FBO on 11 Mar 2015 and received multiple responses from offerors with the capacity and capability to competitively bid/propose on the upcoming NMC re-compete. The Contracting Officer has reason to believe that competition will occur under N00014-15-R-0005.
Yet, at this time, only CTC would have the ability to execute the 6 month action contemplated by the J&A. No other entities would be able to obtain additional staff, execute prime/sub agreements in a timely manner, and likely would not be willing to accept the risk of a short performance period that would require extensive “ramp up” of the NMC program. Not extending the contract for the 6 month period would result in a lapse of services which would prove to be detrimental to the ManTech program. As stated previously, the competition for the new contract will be in process while the extension is in place. They will happen simultaneously to avoid a lapse in services.
7. Determination of Fair and Reasonable Cost.
A fair and reasonable cost/price determination will be completed on the proposal(s) submitted for task order award(s). The Contracting Officer intends to make a fair and reasonable cost/price determination by performing a cost analysis on each proposal received to calculate the government evaluated cost for each proposal received. In addition, the Contracting Officer will conduct a cost realism analysis to determine what the Government should realistically expect to pay for the proposed efforts.
N00014-10-D-0062 J&A 4
8. Description of Market Research.
The Contracting Officer has performed market research techniques IAW FAR Part 10 for
N00014-15-R-0005. As stated previously, N00014-15-R-0005 market research is germane to this
J&A since it is the same as the requirement under N00014-10-D-0062.
The following actions have been taken:
DRAFT solicitation posted to FBO for contractor comments
Obtained capabilities statements from multiple offerors
In addition, each vendor responding to the DRAFT solicitation will be notified when the formal solicitation is posted to FBO.
9. Any Other Supporting Facts.
As stated previously, a complete list of projects and applicable platforms is noted in Attachment
1 of this J&A. Award of these projects is critical to the Navy to reduce the acquisition and life cycle costs of the platforms in question. It is also critical for the success of the Navy ManTech
Program Office to maintain expenditure benchmarks.
Currently, there is no other known contract vehicle that will allow the NMC program to meet program requirements.
The follow on NMC requirement is currently in source selection; however, the projects in
Attachment 1 could not be easily transferred to the new contract vehicle due to changes in terms and conditions, contract type changes, and the need for CTC to negotiate new base order agreements with the respective industry subcontractors. Typically, the first ManTech project award under a new CoE is 6-9 months after date of IDIQ award. This amount of time is needed in order for the NMC prime contractor to initiate new prime/subcontractor agreements and submit proposal paperwork. Potentially, up to an additional 2-3 months would be required for
ONR to analyze the technical and cost/price proposal and award the Task Order.
10. Listing of Interested Sources.
While more than one affirmative response was submitted for the follow on NMC recompete, CTC is the only source that can fulfill the Government’s requirement at this time while maintaining various platform transition schedules and meeting requirements of the ManTech statute for cost reduction.
The extension to the IDIQ will only be utilized from the date that N00014-10-D-0062 expires
(15 Aug 2015) until the new NMC contract is made. The extension will not exceed 6 months.
N00014-10-D-0062 J&A 5
11. Actions Taken to Remove Barriers to Competition.
The follow on NMC requirement will be competed using full and open competition.
12. Reference to the Approved Acquisition Plan (AP) or Equivalent Documentation.
The Acquisition Plan for the ManTech IDIQ contract, N00014-10-D-0062, was reviewed and approved on 11 July 2005 by the ONR Executive Director for Acquisition Management.
The Acquisition Plan for the 2015 NMC re-compete was signed on 8 Dec 2015 by the ONR
Executive Director for Acquisition Management.
13. Explanation of all actions attempted to make the immediate acquisition competitive and the cost /benefit analysis reflecting costs associated with obtaining competition and anticipated benefits.
The basis for this Class Justification and Approval is FAR 6.302-1. It is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements. The follow on to this requirement is solicited for using full and open competition procedures and the
Contracting Officer has received information from the sources sought notice under N00014-15-
R-0005 that competition will likely occur. For the six month extension, the ONR Contracting
Officer, with inputs from the ONR ManTech Program Office, will complete a cost analysis to ensure that the Government is getting a fair and reasonable price on all requirements.
