RFQ 15M70119QA3100005

· QUESTION: We’re considering quoting this one, but we’re confused over the instructions. A brand name justification is attached to the RFQ but the instructions say:

· Multiple solutions to the requirement should be offered as alternative quotes and will be evaluated as separate offers. Multiple solutions are encouraged. Innovative solutions are encouraged and will be evaluated in accordance with the intent of this requirement.

· ANSWER: The RFQ has been amended to remove this language. This was a mistake in posting the solicitation and has been corrected via an amendment. The brand name justification is still in effect for this requirement.

· QUESTION: Line item 002 is for “non-GoreTex, is that correct.

· ANSWER: Yes, line item 002 is for a non GoreTex boot.

· QUESTION: Line Item 1 is made in Cambodia and Line Item 2 is made in China, is this ok?

· ANSWER: Yes – this is OK. FAR 25.101 states that the Buy American statute restricts the purchase of supplies that are not domestic end products. However, per the FAR definition of a domestic end product, a Commercial Off the Shelf (COTS) item is considered a domestic end product. A COTS item is defined as any item of supply that is a commercial item that is sold in substantial quantities in the commercial marketplace, and is offer to the Government without modification, in the same for in which it is sold in the commercial marketplace. With that said, the Salomon boots under this requirement meet the definition of a COTS item and are not restricted under the Buy American statute.

This boot exceeds all expectations for a boot to give the optimal wear for comfort and safety. This boot provides superior ankle support, traction, and stability.

· QUESTION: What sizes would I need to make available for sample boots for sizing purposes? Would there need to be a set for men and women?

· ANSWER: Should sample boots be required for sizing, the most common sizes needed would be between a men’s size 8 through men’s size 12. There will not be a need for women’s sizes to be made available.
